10.30.010 Definitions.¶
As used in this Chapter, the following terms are defined:
A. “Off-road Vehicle” means any motor driven vehicle designed to be utilized on other than improved roadways for recreational purposes such as, but not limited to, dune buggies, motorcycles, “quads,” ATV’s and the like.
B. “Event” means any gathering of more than ten (10) off-road vehicles or motorcycles for a recreational outing such as, but not limited to, hound and hare races, rallies, closed course races, hill-climbs and enduro races.
10.30.020 Regulation of Operation of Motor Vehicles, including Motorcycles and Off-road Vehicles.¶
No person shall drive any motor vehicle, including a motorcycle, motor driven cycle or off-road vehicle, on any land belonging to or occupied by another without having and, upon request of a peace officer, displaying written permission from the owner of such land or his agent, or the person in lawful possession thereof, provided that this Section shall not be applicable to persons having visible or lawful business with said owner, agent or person in lawful possession.
10.30.030 Motor Vehicle Operation - Off-road Dust Provision.¶
No person shall drive any motor vehicle, including a motorcycle, motor driven cycle or off-road vehicle, on any land in such a manner as to create any dust or dirt emission beyond any boundary line of the parcel upon which the off-road vehicle is being operated.
10.30.040 Violation of Section 10.30.020 or 10.30.030 - Removal of Motor Vehicle.¶
Any person who violates any provision of Section 10.30.020 or 10.30.030 of this Chapter is guilty of an infraction on the first violation. On the second and any subsequent violation of the same Section, the offender is guilty of a misdemeanor and may be arrested by any peace officer for such violation. If such peace officer arrests a violator of Section 10.30.020 or 10.30.030, he may remove such motor vehicle from the private property. Within two (2) working days of the removal of the motor vehicle, the removing agency shall make all notification required to comply with Vehicle Code Section 22852.
10.30.050 Exemptions.¶
The provisions of this Chapter shall not apply to the operation of vehicles upon property used for raceways or racing facilities in accordance with a license or permit issued by the City.
10.30.060 Permit Required; Application.¶
A. It is unlawful for any person, firm or corporation to organize, conduct or participate in an off-road vehicle or motorcycle event within the corporate limits of the City, unless a permit for such event has first been issued by the City.
B. Applications for a permit to organize or conduct an off-road vehicle or motorcycle event shall be in the form of a letter requesting permission to organize and conduct an event. The letter shall describe the proposed event. The City shall grant the permit if it determines that the event will apparently be conducted in compliance with all applicable laws and regulations, that the proposed location will be desirable to the public convenience and welfare, that the proposed operation will not create any undue fire hazard, and that such operation is of sufficient distance from occupied areas so as not to cause excessive noise, dust or fumes affecting the occupied areas. The City, upon granting of said permit, may attach whatever conditions and terms are necessary or appropriate to carry out the objectives stated in this Section.
10.30.070 Incorporation of Vehicle Code Art. 2.5 and Section 27150.¶
Cal. Vehicle Code, Art. 2.5 (commencing with § 27200) and Section 27150 are incorporated by reference.
10.30.080 Noise Level.¶
No person shall operate a motor vehicle whose noise level is in excess of that provided in Cal. Vehicle Code, Art. 2.5 (commencing with § 27200).
10.30.090 Spark Arrester and Muffler.¶
Any motor vehicle operated within the City shall be equipped with a spark arrester and also with a muffler as defined in Vehicle Code Section 27150. No person shall operate a motor vehicle unless it is so equipped with a spark arrester and muffler.
10.30.100 Exemptions.¶
A. The provisions of this Chapter shall not apply to operation of vehicles upon property used for raceways or racing facilities in accordance with a license or permit issued by the City.
B. The provisions of this Chapter shall not apply on land that is vacant or unimproved private property unless that land is immediately adjacent and contiguous to residential property, or enclosed by fence, or under cultivation, or posted with signs forbidding trespass displayed at intervals of not less than three (3) to a mile along all exterior boundaries and at all roads and trails entering the private land.
10.30.110 Riding on Motorcycles and Bicycles.¶
No person shall ride upon a highway on either a motorcycle or bicycle on a portion of said vehicle which is not specifically designed for the carrying of passengers, nor shall any person operating a motorcycle or bicycle upon a highway permit another to do so.
10.30.120 Clinging to Moving Vehicles.¶
It is unlawful for any person traveling upon any bicycle, motorcycle, motor scooter or any moving vehicle of any nature whatever, on any public highway, to cling to or attach himself or his vehicle to any other moving vehicle.
