17.36.010 - Parcel map—Required.

(a)

A parcel map shall be filed and recorded by any subdivision for which a final map is not required by this title or the Subdivision Map Act, except for:

(1)

Subdivisions created by short-term leases (terminable by either party on not more than thirty days' notice in writing) of a portion of an operating right-of-way of a railroad corporation, defined as such by Section 230 of the Public Utilities Code; or

(2)

Land conveyed to or from a governmental agency, public entity, public utility or for land conveyed to a subsidiary of a public utility for conveyance to such public utility for rights-of-way; provided, however, that upon a showing made

to the planning commission based on substantial evidence that public policy necessitates such a map, this exception shall not apply. Such maps shall meet all the requirements for parcel maps of the Subdivision Map Act and this title and shall conform substantially to the tentative map as approved.

(b)

The planning commission may waive the requirement for a parcel map, provided that the planning commission makes the following findings:

(1)

That the contiguous parcels to be created by the parcel map as shown on the tentative map thereof existed as separate, legally created, contiguous units shown on the last equalized county assessment role prior to the date of adoption of this section into this code.

(2)

That the proposed division of land meets all city requirements as to area, improvement and design, flood water drainage control, appropriate improved public roads, sanitary disposal facilities, potable water supply availability, environmental protection and all other requirements of the Subdivision Map Act, this title and Title 18 of this code. The subdivider shall in any case file a tentative map, drawings and such other information on any of the foregoing subjects as may be required by the planning commission.

(3)

Where the planning commission waives the requirement for a parcel map, recordation may be accomplished by record of survey or resolution as determined by the city engineer.

17.36.020 - Parcel map—Application for approval.

(a)

Application for approval of the parcel map shall consist of the submission of the original of the map to the city engineer for his approval together with such other exhibits, documents and fees required by this title, the conditions of approval of the tentative map, and the Subdivision Map Act to allow filing of the map for recordation with the county recorder.

(b)

No application for approval of a parcel map shall be accepted for final processing by the city engineer if less than the statutory time provided under the Government Code for the officer's examination and certification remains to the date of expiration of the tentative map, except that if an application for extension of approval of any such tentative map has been accepted by the planning commission, the city engineer may proceed with processing such tentative map subject to the planning commission granting of such time extension.

17.36.030 - Parcel map—Processing.

(a)

If dedications or offers of dedication are made by separate instrument, such dedications or offers of dedication shall be recorded prior to the parcel map being filed for record and the record date for the dedication or offers of dedication shown on the parcel map. If dedications or offers of dedication are required to be made by separate instrument, the parcel map, when completed in conformance with all the requirements of this title, the Subdivision Map Act and the conditions of approval of the tentative map, shall be transmitted by the city engineer, together with all fees and documents required to allow filing of the map for record with the county recorder, to the appropriate official of the county for processing and recordation.

(b)

As an optional procedure, if offers of dedication are made by certificate on the parcel map, when the map is completed in conformance with all the requirements of this title, the Subdivision Map Act and the conditions of approval of the tentative map, the city engineer shall transmit the original and five copies of the map to the city council for their action on the offers of dedication. The city engineer shall, after action by the city council on offers of dedication, transmit the parcel map, together with all required supporting documents and fees to the appropriate county official for processing and recordation in the office of the county recorder.

The city council may, by resolution, authorize the city clerk to accept, accept subject to improvement, or reject on behalf of the city council offers of dedication made by certificate on a parcel map. Prior to such action by the city clerk on behalf of the city council, the city clerk shall have the written statement of the city engineer that rights-ofway or easements or both, which are the subject of the particular offer of dedication, conform to the conditions of approval of the tentative map, including provisions for all public improvements required therefor, and the provisions of the Subdivision Map Act and this title.

(c)

The subdivider shall provide the city with one brownline sepia reproducible copy of the parcel map produced from the original parcel map after recordation in the office of the county recorder.

17.36.040 - Parcel map—Form and data required.

(a)

The size of each sheet of the map shall be eighteen by twenty-six inches with marginal line drawn completely around each sheet, leaving an entirely blank margin one inch in width and with a marginal line insert block conforming to the county recorder's standards.

(b)

The parcel map shall be legibly drawn, printed or reproduced by a process guaranteeing a permanent record in black on tracing cloth or polyester base film. Certificates, affidavits and acknowledgments may be legibly stamped or printed upon the map with opaque ink. If ink is used on polyester base film, the ink surface shall be coated with a suitable substance to assure permanent legibility. All signatures shall be in opaque ink.

(c)

The scale of the map shall be large enough to show all the details clearly. The map shall be so drawn and shall be in such condition when filed that good legible prints and negatives can be made therefrom.

(d)

The exterior boundary of the land included within the subdivision shall be delineated by a solid line which shall be wider than those other lines showing the boundaries of lots, blocks, parcels, easements, rights-of-way, streets or centerlines thereof such that the subdivision boundary will definitely contract with all other lines on the map proper. The subdivision boundary line shall be identified on the map proper or by legend. The parcel map shall show the definite location of the subdivision and particularly its relationship to surrounding surveys.

(e)

The subdivider shall, prior to approval of the parcel map, furnish to the city engineer a copy of a current preliminary title report, or a subdivision title guarantee issued by a title company authorized by the laws of the state to write the same, showing the record owner and the easements, rights-of-way and encumbrances affecting the property.

17.36.050 - Parcel map—Title sheet.

The first sheet of the map shall be the title sheet. The map proper may be placed on the title sheet. The title of each such parcel map shall consist of a parcel map number conspicuously placed at the top of the title sheet, followed by the words, "In the City of Victorville." The height of lettering in the words "Parcel Map No." and the height of the numbers of the parcel map shall not be less than one-half inch.

17.36.060 - Parcel map—Description of property.

Below the title shall appear a subtitle consisting of a description of all property subdivided by reference to such map or maps of the property shown thereon as shall have been last previously filed with the county recorder's office, or shall have been previously filed with the county clerk pursuant to a final judgment in any action in partition, or shall have been last previously filed in the office of the county recorder under the authority of Cal Gov Code Section 66499.55, or by reference to the plot of any United States survey. Each reference in such description to any tract or subdivision shall be spelled out and worded identically with the records thereof and must show a complete reference to the book and pages of records of the county. The description shall also include reference to any public area which has been vacated with the number of the ordinance or resolution therefor and the recording data thereof.

17.36.070 - Parcel map—Reversion to acreage or amending map.

(a)

A parcel map filed for the purpose of reverting to acreage land previously subdivided shall be conspicuously designated on the title sheet by the words, "Reversion to acreage of …" inserting a legal description as required in Section 17.36.060 of this chapter. Maps and petitions for reversion to acreage shall conform to and be processed in accordance with provisions of Chapter 17.96 of this title and the Subdivision Map Act.

(b)

A parcel map filed for the purpose of amending a previously filed parcel map shall be conspicuously labeled above the title on the title sheet with the words, "Amending Map of …".

17.36.080 - Parcel map—Required information.

When a soils report has been prepared, this fact shall be noted upon the title sheet immediately below the description of the property within the boundaries of the map, the notation to include the date of the report and the name of the engineer making the report. The basis of bearing shall be that of the California Plain Coordinate System or other basis specifically approved for each map by the city engineer. The basis of bearing shall be noted on the title sheet of the map. Notes setting forth the various symbols and abbreviations used to indicate

monuments found and set and easements and such other information as may be required to adequately show the subdivision shall also be noted on the title sheet or the first sheet following the title sheet. Every sheet of the parcel map showing the proper map shall bear the title, the scale of the map, the north arrow indication and a sheet number.

17.36.090 - Parcel map—Certificates and acknowledgments.

The following certificates and acknowledgments shall appear on the title sheet of the parcel map. Those certificates and acknowledgments for which a form is not specifically set forth in the Subdivision Map Act shall be in a form set forth by the Standard Specifications for Public Improvements.

(1)

Certificate signed and acknowledged by the legal owner of record in the real property subdivided consenting to the preparation and recordation of the parcel map, subject to the provisions of the Subdivision Map Act. Offers to dedicate interest in real property for specified public purposes may be made by a certificate on the parcel map signed and acknowledged by the legal owner of record in the real property being subdivided subject to the provisions of the Subdivision Map Act. For purposes of this section, legal owners of record shall not include trustees of deeds of trust.

(2)

Certificate of the city clerk as to city council action on offers of dedication if offers of dedication have been made by certificate on the parcel map.

(3)

Certificate of the engineer with his registered engineer's number or of the surveyor with his licensed land surveyor's number.

(4)

Certificate of approval of the city engineer.

(5)

Record of recording data by the county recorder.

17.36.100 - Parcel map—Mathematical and survey data.

(a)

The parcel map shall show all survey and mathematical information and data necessary to locate all monuments and to locate and retrace any and all interior and exterior boundary lines appearing on the map. The length and bearing of all straight lines and the radii, arc length, central angle and tangent distance for all curves shall be shown.

(b)

The parcel map shall particularly define, delineate and designate each separate lot or parcel shown on the parcel map and any public streets and private streets, if any, with all dimensions, boundaries and courses clearly shown and defined. Street names shall be shown in accordance with the approved tentative map. Building setback lines shall be shown on each lot for which the planning commission approves a deviation from the building setback requirements of Title 18 of this code.

(c)

Parcels offered for dedication other than for streets or easements shall be designated by letter.

(d)

Private streets shall be designated by name and shall have inserted within the limits thereof the words "Private Street" and shall designate the lots or parcels appurtenant thereto.

(e)

Existing subdivisions bordering on the subdivision for which the parcel map is being prepared shall be shown in dotted lines on the map to the extent practicable and shall be identified by tract or parcel map number and shall have all lots and blocks and parcels having a common boundary with the subdivision identified in dotted line numerals or letters as originally designated on the maps of the bordering subdivisions.

(f)

The map shall show the location of each parcel and its relation to surrounding surveys. The location of any remainder of the original parcel shall be shown, but need not be shown as a matter of survey, but only by reference to the existing record boundaries of such remainder, if such remainder has a gross area of five acres or more.

17.36.110 - Parcel map—Existing monuments.

The parcel map shall show found monuments or other evidence of previous surveys on the boundaries of the subdivision. Such monuments or evidence shall be identified both as to survey point designation and type of monument, whether iron pipe or stake, or other type of monument. Existing lot corner stakes on the common boundary with adjacent subdivisions for which a final map was required need not be shown. Existing lot or parcel corner stakes on the common boundary adjacent subdivisions for which a parcel map was required shall be shown.

17.36.120 - Parcel map—Monuments and bench marks.

The location of monuments installed shall be shown on the parcel map and the form of monument shall be as set forth in this title and shall be identified by the symbol as designated on the parcel map. All monuments required to be installed by this title, the Subdivision Map Act and the Land Surveyor's Act on the exterior boundary of the land being subdivided and on the interior corners of the various parcels created by the parcel map shall be installed

prior to the approval of the parcel map for recordation in those instances where the parcel map is based on a field survey.

17.36.130 - Parcel map—Summary.

(a)

The exterior boundary of the subdivision shall be designated by a solid line in conformance with Section 17.36.040 (d) of this title.

(b)

All lines shown on the map which do not constitute a part of the subdivision itself shall be clearly distinguishable from those lines which are a part of the subdivision and any area enclosed by such lines shall be labeled "Not a Part of This Subdivision."

(c)

Common boundaries between offers of dedication made by separate instrument for streets and parcels or lots created by the subdivision shall be indicated by a broken line.

17.36.140 - Parcel map—City boundary.

The provisions of Section 17.32.170 of this title shall apply also to parcel maps. Where the term "final map" appears in Section 17.32.170 of this title, it shall also be interpreted to mean "parcel map."
