When the building of residential structures for sale or lease by the subdivider or his agent or others is a part of the subdivision proposal, the planning commission may require the subdivider to submit a development plan for commission approval. The subdivider shall submit twenty prints of the development plan and accompanying data which shall be reviewed by all city departments and other governmental agencies or utilities as may be concerned with the development plan.

The development plan shall be legibly drawn at a scale large enough to show clearly all details thereof, and the plan shall contain the following information:

(1)

Finished grades and/or contours;

(2)

The circulation system within the subdivision and the connection with the system outside of the subdivision, incorporating any pedestrian and/or bicycle paths;

(3)

Relationship of shape and size of each house to shape, size and finished contours of its lot or typicals thereof;

(4)

Relationship of one house to another and to any living areas, planting areas or screening between houses;

(5)

Planting to serve as screens, buffers, shade control or decoration to enhance neighborhood design or outdoor and indoor living areas;

(6)

A complete unit of the subdivision with houses correctly located and any main planting areas shown, to indicate that houses are located on their lots to obtain the best possible utilization of their lots considering grade, views, wind and relationship of adjacent or neighboring houses or structures;

(7)

Detailed drawings of typical dwellings, including floor plan, site plan and exterior elevations indicating application to the typical dwelling of the provisions of this section.

Upon receipt of comments and recommendations from the departments and the agencies reviewing the development plan, the city planning commission shall approve, approve conditionally or disapprove the development plan.

When the subdivision shall be deemed by the city planning commission to comprise a planned unit development, as defined in Title 18 of this code, variation from the strict and literal interpretation of this title and Title 18 may be permitted.

Action of the city planning commission shall follow the procedure outlined in Chapter 17.20 of this title for the tentative map. Nothing in this section shall prevent the subdivider from presenting the tentative map and development plans for concurrent review by the city planning commission. Submittal of the development plan for such concurrent review may be required by the planning commission.

The authorization of a development plan shall lapse and be void five (5) years after the date of final approval, unless plans associated with the development have been accepted by the Development Department and are actively being processed. A tentative tract modification or extension of time shall not extend the approval of an associated development plan unless approved by the Planning Commission. Any new tentative tract, tentative tract modification or tentative tract extension of time request shall require any existing development plans to be brought into full conformance with Titles 17 and 18 as well as any approved Design Guidelines.
