17.08.010 - Definitions generally.

In the construction of this title, certain words and terms are defined as follows. Whenever any words or phrases used in this title are not defined in this chapter, but are defined in the Subdivision Map Act as last amended, such definitions are incorporated in this chapter and shall be deemed to apply as though set forth in this title.

17.08.020 - Advisory agency.

The "advisory agent" shall be the city planning commission.

17.08.030 - Clerk of the advisory agency.

"Clerk of the advisory agency" means the secretary to the planning commission who is the director of planning.

17.08.040 - Appeal board.

The "appeal board" shall be the city council.

17.08.050 - Alley.

An "alley" means a public way which affords a secondary means of access to abutting property which has been dedicated for public use.

17.08.060 - Block.

A "block" means a tract of land bounded by streets, or a combination of streets, public parks, cemeteries, railroad rights-of-way, bulkhead lines or shorelines of waterways or corporate boundary lines of the city.

17.08.070 - City.

"City," unless otherwise noted, shall refer to the city of Victorville.

17.08.080 - County.

"County" means the county of San Bernardino.

17.08.090 - Cul-de-sac.

"Cul-de-sac" means a street which connects to other streets only at one end, and having a provision for a turnaround at its other end.

17.08.100 - Development plan.

"Development plan" means a site plan showing the design, location and all proposed improvements of streets, with particular reference to the location of buildings in relation to lot lines and to finish grade elevations.

17.08.110 - Final map.

"Final map" means a map designed to be placed on record in the office of the county recorder and prepared in accordance with the provisions of this title and the Subdivision Map Act of the state, and conforming more specifically to the requirements of this title and the Subdivision Map Act for a subdivision map creating five or more parcels, five or more condominiums as defined in Section 783 of the Civil Code, or a community apartment project containing five or more parcels, except where:

(a)

The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedications or improvements are required by the legislative body;

(b)

Each parcel created by the division has a gross area of twenty acres or more and has an approved access to a maintained public street or highway; or

(c)

The land consists of a parcel or parcels of land having approved access to public street or highway which comprises part of a tract of land zoned for industrial or commercial development and which has the approval of the governing body as to street alignments and widths; or

(d)

Each parcel created by the division has a gross area of not less than forty acres or is not less than a quarter of a quarter section.

A parcel map shall be required for those subdivisions described in subsections (a), (b), (c) and (d).

17.08.120 - Freeway.

"Freeway" means a thoroughfare designed for through traffic with no crossings at grade or access from abutting property, and which provides movement of traffic in opposite directions on either side of a dividing strip, and as further defined in Section 23.5 of general provisions of the Street and Highways Code of the state.

17.08.130 - Frontage road.

"Frontage road" means a street which is approximately parallel to and adjacent to a major thoroughfare, freeway, railroad or other facility to which access is limited, and which provides access to abutting properties, and protection from through and fast traffic.

17.08.140 - General plan.

"General plan" means the general plan of the city.

17.08.150 - Improvement plan.

"Improvement plan" shall mean a plan showing the location and construction detail of streets, roads, drainage facilities, sanitary sewers and structures, water systems and other improvements for a subdivision both within and outside the boundary thereof.

17.08.155 - Legislative body.

"Legislative body" means the city council.

17.08.160 - Lot.

"Lot" means that portion of land in a subdivision to be occupied by a building or group of buildings and accessory buildings, together with such yards and lot area as are required by this title and by the zoning regulations of the city, and having its principal frontage on a public street.

17.08.170 - Lot area.

"Lot area" means the number of square feet of land area contained within the property lines of the lot.

17.08.180 - Lot, corner.

A "corner lot" means a lot situated at the intersection of two streets, the interior angle of such intersection not exceeding one hundred degrees.

17.08.190 - Lot depth.

"Lot depth" means the horizontal distance between the front and rear lot lines, measured along the median between the two side lot lines.

17.08.200 - Lot, interior.

"Interior lot" means a lot other than a corner lot or reversed corner lot.

17.08.210 - Lot, key.

"Key lot" means a lot the sides of which adjoin the rear line of one or more adjoining lots.

17.08.220 - Lot lines.

"Lot lines" means the lines bounding a lot as defined in Section 17.08.160 of this chapter.

17.08.230 - Lot median.

"Median of a lot" means a line any point on which is equidistant from the side lot lines measured along lines drawn perpendicular to the side lot lines from the median.

17.08.240 - Lot merger.

"Lot merger" means the combining of contiguous parcels or units of land into a single parcel or unit.

17.08.250 - Lot, reversed corner.

"Reversed corner lot" means a corner lot, the side street line of which is substantially a continuation of the front line of the lot to its rear.

17.08.260 - Lot, through.

"Through lot" means a lot having frontage on two parallel or approximately parallel streets. The design of through lots into subdivisions is to be avoided.

17.08.270 - Lot width.

"Lot width" means the horizontal distance between the side lot lines, measured along the line parallel to the front lot line and distant therefrom by a distance equal to the required depth of front yard on the lot.

17.08.280 - Lot width, effective.

"Effective lot width" means the distance between side lot lines, or side lot lines extended, measured perpendicular to the median at the point of intersection of the median and the front lot line.

17.08.290 - Path.

"Path" means a way designed for use by pedestrians, animals and cyclists and not intended for use as a way for motor-driven vehicular traffic.

17.08.300 - Parcel map.

"Parcel map" means a map designed to be placed on record in the office of the county recorder and prepared in accordance with the provisions of this title and the Subdivision Map Act pertaining to parcel maps. A parcel map is required for subdivisions for which a final map, as defined in Section 17.08.110 of this chapter, and as set forth in the Subdivision Map Act, is not required, except as set forth in Section 17.36.010 of this title.

17.08.310 - Preliminary plan.

A "preliminary plan" describes and outlines existing conditions of a site and its proposed development thereof and is for the purpose of informal review.

17.08.315 - Public utility distribution line.

"Public utility distribution line" means a line which is intended solely for the distribution of electricity, natural gas, water or communications to residential, commercial, industrial or other public and private uses.

17.08.317 - Public utility transmission line.

"Public utility transmission line" means a line which is intended solely for the transmission of electricity, natural gas, water or communications between utility distribution facilities.

17.08.320 - Public way.

"Public way" means any street, alley or path as defined in this chapter, which is dedicated to public use or owned by the city.

17.08.330 - Specifications.

"Specifications" means the standard specifications for public improvements in the city including all amendments thereto. These are specifications adopted by resolution of the city council prescribing the design standards, materials and workmanship to be used in subdivision design and construction of improvements and map standards to be applied in the preparation of subdivision maps all pursuant this title.

17.08.340 - Street.

"Street" means a way for vehicular traffic whether designated as a street, highway, thoroughfare, parking road, avenue, boulevard, lane, place, court, circle, drive or way. It does not include a path or alley.

17.08.350 - Streets, arterial.

"Arterial street" means a street designed for the through movement of high vehicular traffic volumes in each direction and which is designated as a major or secondary arterial street on the general plan of the city.

17.08.360 - Street, collector.

"Collector street" means a street which, because of its design and location with reference to other streets and other sources of traffic shall be used to carry traffic from minor streets to a major thoroughfare and which is designated as a collector street on the general plan of the city.

17.08.370 - Street, local.

"Local street" means a street intended wholly or principally for access to the abutting property.

17.08.380 - Street, private.

"Private street" means any parcel of land not dedicated to or owned in fee by the city, county or state, and which is used or intended to be used for ingress or egress from a lot or lots which do not have frontage on a public street.

17.08.390 - Subdivider.

"Subdivider" means a person, firm, corporation, partnership or association who proposed to divide, divides or causes to be divided, real property into a subdivision for himself or for others.

17.08.400 - Subdivision.

"Subdivision" means the division of any improved or unimproved land shown on the last equalized county assessment roll as a unit or as contiguous units for the purpose of sale, lease or financing, whether immediate or future, except for leases of agricultural land for agricultural purposes. Property shall be considered as contiguous units even if it is separated by roads, streets, utility easements or railroad rights-of-way. Subdivision includes a condominium project as defined in Section 1350 of the Civil Code or a community apartment project as defined in Section 11004 of the Business and Professions Code. Any conveyance of land to the governmental agency, public entity or public utility shall not be considered a division of land for purposes of computing the number of parcels.

17.08.410 - Subdivision, commercial.

"Commercial subdivision" means a subdivision in which the primary use of the land is commercial as defined by Title 18 of this code, and which such other uses may be permitted as are clearly incidental to the commercial development.

17.08.420 - Subdivision, industrial.

"Industrial subdivision" means a subdivision in which the primary use of the land is industrial as defined by Title 18 of this code, and in which such other uses may be permitted as are clearly incidental to the industrial development.

17.08.430 - Subdivision, residential.

"Residential subdivision" means a subdivision in which the primary use of the land is residential as defined by Title 18 of this code, and in which such uses may be permitted as are clearly incidental to residential development.

17.08.450 - Tentative map.

"Tentative map" means a map conforming to Chapter 17.20, Tentative Map, of this title and the provisions of the Subdivision Map Act pertaining to tentative maps. The purpose of the tentative map is to show the design of a proposed subdivision and the existing conditions around it. Failure to comply with the requirements for tentative maps as set forth in this title and the Subdivision Map Act will result in rejection of the map for filing.
