§ 9.28

The purpose of this chapter is to set forth guidelines for sign permits as well as structural requirements to prevent the use of unsafe or unlawful signs.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a)

"Sign" means any words, lettering, parts of letters, figures, numerals, phrases, sentences, devices, designs, pictures, trade names, or trademarks by which anything is made known, such as are used to designate a firm, an association, a corporation, a profession, a business, a service or commodity or product, or any type of publicity or propaganda, whether placed on the ground, rocks, trees, tree stumps, or other natural objects or on a building, wall, roof, frame, support, fence, or other manmade structure, which are visible from any public street, public highway, or public road right-of-way.

"Incombustible material" means any material which will not ignite at or below a temperature of 1,200 degrees Fahrenheit and will not continue to burn or glow at the temperature and such combustible plastics as are approved by the National Board of Fire Underwriters.

"Erect" means to build, construct, place, relocate, enlarge, alter, attach, repair, or convert. Normal maintenance is not included in this definition, including painting or repainting.

Except as otherwise provided in this chapter, it shall be unlawful for any person to erect, alter, or relocate within the City any sign or other advertising structure as defined in this chapter without first obtaining a sign permit from the Building Official and making payment of the fee required by section 9.32.040 of this chapter. All illuminated signs shall, in addition, be subject to the provisions of the Electrical Code and the permit fees required thereunder.

Prior to the issuance of any such permits, such signs shall be approved by the Community Development Department in accordance with the procedures prescribed by article 35 of chapter 2 of title 10 of this code.

Applications for sign permits shall be made upon application forms provided by the Building Official and shall contain or have attached thereto the following information:

(a)

The name, address, and telephone number of the applicant;

(b)

Two (2) sets of plans showing the location of all buildings or structures to which signs are to be attached and/or the lot upon which the sign is to be erected, showing the exact location of the sign;

(c)

The name of the person erecting the sign or advertising structure;

(d)

Two (2) sets of drawings showing the construction details of the signs, including attachment details, sufficient to make a comprehensive appraisal of the engineering requirements, including engineering calculations; and

(e)

Drawings and calculations by a civil or structural engineer registered in the State shall be furnished when requested by the Building Department.

Each application for a sign for which a permit is required by this chapter shall be accompanied by a permit fee computed in accordance with the provisions of section 107 of the California Building Code as adopted by section 9.04.030 of this title.

If the Building Official shall find any sign or other advertising structure regulated by this chapter unsafe or insecure, or a menace to the public, or constructed or erected or being maintained in violation of the provisions of this chapter, she/he shall give written notice to the permittee thereof. If the permittee fails to remove or alter the structure so as to comply with the standards set forth in this chapter within ten (10) days after such notice, such sign or other advertising structure may be removed or altered to comply by the Building Official at the expense of the permittee or owner of the property upon which such sign is located. No permit shall be issued thereafter to any permittee or owner who has not paid the cost so assessed. The Building Official may cause any sign or other advertising structure which is an immediate peril to persons or property to be removed summarily and without notice.

The owner of any sign as defined and regulated by this chapter, including supporting structures, shall keep the same in presentable condition at all times. All painted signs and all supporting structures of a sign shall be repainted whenever such action is necessary to keep them in good condition.

Any sign or advertising structure, all parts of which are less than thirty (30′) feet above the ground, shall be designed and constructed to withstand pressures of fifteen (15) pounds per square foot. Those signs having a height of thirty (30′) feet or greater shall be designed to resist all wind and dead loads as required by the California Building Code and/or other laws of the City.

The permittee shall be required to indemnify and save harmless the City from all claims for injuries to persons or damages to property by reason of accidents resulting from the existence of any sign or other advertising structure owned, erected, or maintained by the permittee, or resulting from the negligence or willful acts of the permittee, his/her agents, employees, or workers, in the construction, maintenance, repair, or removal of any sign or other advertising structure erected by virtue of a permit issued pursuant to the provisions of this chapter.

The provisions and regulations of this chapter shall not apply to the following signs; provided, however, such signs shall be subject to the provisions of section 9.32.050 of this chapter and shall be erected in conformance with the provisions of article 35 of chapter 10.08 of title 10 of this Code:

(a)

Any sign which does not exceed twenty (20) square feet in area per sign face, or a total aggregate of twenty (20) square feet per sign face, and not exceeding five (5′) feet above grade at its highest point, provided there is no electrical wiring or lighting in any manner attached to the sign; and

(b)

Painted wall signs.

Any applicant not satisfied with the decision of the Building Official relative to the denial, suspension, or revocation of any permit applied for or held by such person pursuant to the provisions of this chapter, or to any action taken by any official of the City concerning such permit, may appeal in accordance with the provisions set forth in the California Building Code adopted by chapter 9.04.

The Building Official is authorized and empowered to revoke any permit issued by him/her upon the failure of the holder thereof to comply with the provisions of this chapter.
