This hub explains how the CWUIC manages applications, required construction documents, permit actions and final certificates to ensure WUI‑specific fire‑safety compliance.

Overview

This part of the California Wildland‑Urban Interface Code (CWUIC) covers how work in WUI areas is applied for, reviewed, documented, inspected and authorized — from submitting construction documents and plan review through permit issuance, inspections and final certificates of completion/occupancy. Key responsibilities (application intake, review authority and enforcement) are set out for the code official in §104, and the permit rules (what needs a permit, issuance, refusal, validity and expiration) are in §105 .

The code requires submittal of construction documents, supporting data and specific plan content (including vegetation‑management and fire‑protection plans where applicable) and authorizes the code official to require registered design professionals, peer review, or additional substantiation where needed — see §106 for construction‑document requirements and related plan content (site plan, vegetation management, fire protection plans) . Final authorization to occupy or use a building is controlled by the certificate provisions (certificate of completion/occupancy and temporary occupancy) in §110–§111, which tie issuance to demonstrated compliance with the CWUIC requirements .

Together these sections (notably §104, §105, §106, §109, §110 and §111) establish the administrative workflow that ensures WUI‑specific design, vegetation and fire‑safety measures are reviewed, enforced and documented before and after construction .

    DIVISION II SCOPE AND ADMINISTRATION

    (2) Describe the land upon which the proposed work is to be done by legal description, street address, or similar description that will readily identify and definitely locate the proposed building or work.

    (3) Indicate the use or occupancy for which the proposed work is intended.

    (4) Be accompanied by construction documents and other data in accordance with Section 104.3.1.

    (5) Be signed by the permittee or the permittee’s authorized agent. The Authority Having Jurisdiction shall be permitted to require evidence to indicate such authority.

    (6) Give such other data and information in accordance with the Authority Having Jurisdiction.

    104.3.1 Construction Documents. Construction documents, engineering calculations, diagrams, and other data shall be submitted in two or more sets, or in a digital format where permitted by the Authority Having Jurisdiction, with each application for a permit. The construction documents, computations, and specifications shall be prepared by, and the mechanical system designed by, a registered design professional. Construction documents shall be drawn to scale with clarity to identify that the intended work to be performed is in accordance with the code.

    Exception: The Authority Having Jurisdiction shall be permitted to waive the submission of construction documents, calculations, or other data where the Authority Having Jurisdiction finds that the nature of the work applied for is such that reviewing of construction documents is not necessary to obtain compliance with the code.

    104.3.2 Plan Review Fees. Where a plan or other data is required to be submitted in accordance with Section 104.3.1, a plan review fee shall be paid at the time of submitting construction documents for review.

    The plan review fees for mechanical system work shall be determined and adopted by this jurisdiction.

    The plan review fees specified in this subsection are separate fees from the permit fees specified in Section 104.5.

    Where plans are incomplete or changed so as to require additional review, a fee shall be charged at the rate shown in Table 104.5.

    104.3.3 Time Limitation of Application. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, plans and other data submitted for review thereafter, shall be returned to the applicant or destroyed by the Authority Having Jurisdiction. The Authority Having Jurisdiction shall be permitted to extend the time for action by the applicant for a period not to exceed 180 days upon request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application

    after expiration, the applicant shall resubmit plans and pay a new plan review fee.

    104.4 Permit Issuance. The application, construction documents, and other data filed by an applicant for a permit shall be reviewed by the Authority Having Jurisdiction. Such plans shall be permitted to be reviewed by other departments of this jurisdiction to verify compliance with applicable laws under their jurisdiction. Where the Authority Having Jurisdiction finds that the work described in an application for permit and the plans, specifications, and other data filed therewith are in accordance with the requirements of the code and other pertinent laws and ordinances and that the fees specified in Section 104.5 have been paid, the Authority Having Jurisdiction shall issue a permit therefore to the applicant.

    [A] 105.6.1 Refusal to issue a permit. Where the application or construction documents do not conform to the requirements of pertinent laws, the code official shall reject such application in writing, stating the reasons therefor.

    [A] 105.7 Validity of permit. The issuance or granting of a permit or approval of plans, specifications and computations shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code or of any other ordinance of the jurisdiction. Permits presuming to give authority to violate or conceal the provisions of this code or other ordinances of the jurisdiction shall not be valid.

    [A] 105.8 Expiration. On or after January 1, 2019, every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 12 months after its issuance or if the work authorized on the site by such permit is suspended or aban- doned for a period of 12 months after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demon- strated. (See Health and Safety Code Section 18938.5 and 18938.6.)

    [A] 105.9 Retention of permits. Permits shall at all times be kept on the premises designated therein and shall at all times be subject to inspection by the code official or other authorized representative.

    [A] 105.10 Revocation of permits. Permits issued under this code can be suspended or revoked where it is determined by the code official that:

    1. It is used by a person other than the person to whom the permit was issued.
    2. It is used for a location other than that for which the permit was issued.
    3. Any of the conditions or limitations set forth in the permit have been violated.
    4. The permittee fails, refuses or neglects to comply with any order or notice duly served on him or her under the provisions of this code within the time provided therein.
    5. There has been any false statement or misrepresentation as to material fact in the application or plans on which the permit or application was made.
    6. The permit is issued in error or in violation of any other ordinance, regulations or provisions of this code.

    The code official is allowed to, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any ordinance or regulation or any of the provisions of this code.

    SECTION 106—CONSTRUCTION DOCUMENTS

    [A] 106.1 General. Plans, engineering calculations, diagrams and other data shall be submitted in not fewer than two sets, or in a digital format where allowed by the code official, with each application for a permit. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed. Where special conditions exist, the code official is authorized to require additional documents to be prepared by a registered design professional.

    Exception: Submission of plans, calculations, construction inspection requirements and other data, if it is found that the nature of the work applied for is such that reviewing of plans is not necessary to obtain compliance with this code.

    [A] 104.2.2.6.2 Other reports. Reports not complying with Section 104.2.2.6.1 shall describe criteria, including but not limited to any referenced testing or analysis, used to determine compliance with code intent and justify code equivalence. The report shall be prepared by a qualified engineer, specialist, laboratory or fire safety specialty organization acceptable to the code official. The code official is authorized to require design submittals to be prepared by, and bear the stamp of, a registered design professional.

    [A] 104.2.2.7 Peer review. The code official is authorized to require submittal of a peer review report in conjunction with a request to use an alternative material, design or method of construction, prepared by a peer reviewer that is approved by the code official.

    [A] 104.2.3 Modifications. Where there are practical difficulties involved in carrying out the provisions of this code, the code official shall have the authority to grant modifications for individual cases, provided that the code official shall first find that one or more special individual reasons make the strict letter of this code impractical, that the modification is in conformance with the intent and purpose of this code, and that such modification does not lessen health, life and fire safety requirements. The details of the written request and action granting modifications shall be recorded and entered into the files of the code enforcement

    agency.

    [A] 104.3 Applications and permits. The code official is authorized to receive applications, review construction documents and issue permits for construction regulated by this code, issue permits for operations regulated by this code, inspect the premises for which such permits have been issued and enforce compliance with the provisions of this code.

    [A] 104.4 Right of entry. Where it is necessary to make an inspection to enforce the provisions of this code, or where the code official has reasonable cause to believe that there exists in a structure or on any premises a condition that is contrary to or in violation of this code that makes the structure or premises unsafe, dangerous or hazardous, the code official is authorized to enter the structure or premises at all reasonable times to inspect or to perform the duties imposed by this code. If such structure or premises is occupied, the code official shall present proper credentials to the occupant and request entry. If such structure or premises is unoccupied, the code official shall first make a reasonable effort to locate the owner, the owner’s authorized agent or other person having charge or control of the structure or premises and request entry. If such entry is refused, then the code official shall have recourse to every remedy provided by law to secure entry.

    [A] 104.4.1 Warrant. Where the code official has first obtained a proper inspection warrant or other remedy provided by law to secure entry, an owner, the owner’s authorized agent, occupant or person having charge, care or control of the structure or premises shall not fail or neglect, after a proper request is made as herein provided, to permit entry therein by the code official for the purposes of inspection and examination pursuant to this code.

    [A] 104.5 Identification. The code official shall carry proper identification when inspecting structures or premises in the performance of duties under this code.

    [A] 104.6 Notices and orders. The code official shall issue all necessary notices or orders to ensure compliance with this code. Notices of violations shall be in accordance with Section 110.2.

State the valuation of the proposed work. 6. Be signed by the applicant, or the applicant’s authorized agent. 7. Give such other data and information as required by the building official.

    [A] 105.3.1 Action on application. The building official shall examine or cause to be examined applications for permits and amendments thereto within a reasonable time after filing. If the application or the construction documents do not conform to the requirements of pertinent laws, the building official shall reject such application in writing, stating the reasons therefor. If the building official is satisfied that the proposed work conforms to the requirements of this code and laws and ordinances applicable thereto, the building official shall issue a permit therefor as soon as practicable.

    [A] 105.3.2 Time limitation of application. An application for a permit for any proposed work shall be deemed to have been abandoned 180 days after the date of filing, unless such application has been pursued in good faith or a permit has been issued; except that the building official is authorized to grant one or more extensions of time for additional periods not exceeding 90 days each. The extension shall be requested in writing and justifiable cause demonstrated. [OSHPD 1, 1R, 2, 4 & 5] Time limitation shall be in accordance with the California Administrative Code, Chapter 7, Section 7-129.

    [A] 105.4 Validity of permit. The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code or of any other ordinance of the jurisdiction. Permits presuming to give authority to violate or cancel the provisions of this code or other ordinances of the jurisdiction shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the building official from requiring the correction of errors in the construction documents and other data. The building official is authorized to prevent occupancy or use of a structure where in violation of this code or of any other ordinances of this jurisdiction.

    [A] 105.5 Expiration. Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after its issuance, or if the work authorized on the site by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. Exception: Special occupancy parks where the Department of Housing and Community Develop- ment is the enforcing agency. 1.8.3.2.4 Employee Housing Act. Refer to the Employee Housing Act, California Health and Safety Code, Division 13, Part 1, commencing with Section 17000 and California Code of Regulations, Title 25, Division 1, Chapter 1, Subchapter 3, commencing with Section 600 for employee housing administrative and enforcement authority, permits, fees, violations, inspections, and penalties. 1.8.3.2.5 Factory-Built Housing Law. A written construction permit shall be obtained from the enforcing agency prior to the erection, construction, reconstruction, installation, relocation, or alteration of any mechanical system. Exceptions: (1) Work exempt from permits as specified in Chapter 1, Scope and Administration, Division II, Section 104.2 Items (1) through (5) of this code. (2) Changes, alterations, or repairs of a minor nature not affecting structural features, egress, sanitation, safety, or accessibility as determined by the enforcing agency.

    (3) Retroactive permits issued in accordance with Health and Safety Code Section 17958.12.

    Exemptions from permit requirements shall not be deemed to grant authorization for any work to be done in any manner in violation of other provisions of law or this code. 1.8.4.2 Fees. Subject to other provisions of law, the governing body of any city, county, or city and county may prescribe fees to defray the cost of enforcement of rules and regulations promulgated by the Department of Housing and Community Development. The amount of the fees shall not exceed the amount reasonably neces- sary to administer or process permits, certificates, forms, or other documents, or to defray the costs of enforcement.     STRUCTURAL DESIGN

    SECTION 1603 A —CONSTRUCTION DOCUMENTS

    1603 A .1 General. Construction documents shall show the material, size, section and relative locations of structural members with floor levels, column centers and offsets dimensioned. The design loads and other information pertinent to the structural design required by Sections 1603 A .1.1 through 1603 A .1.10 shall be indicated on the construction documents.

    Appendix G Voluntary Home-Hardening Recommendations.

    Appendix G is an informational appendix that provides discussion of some elements of the proposed self-defense mechanisms and their role in enhancing the protection of exposed structures in the wildland-urban interface. The items provided in this appendix provide owners with suggestions for increasing the survivability of their structure. These items are not mandatory but can be considered by owners to increase the safety of structures.

    Appendix H Referenced California Documents.

    Appendix H contains portions of California statutes and regulations located in other documents. They are reprinted in Appendix H to aid the user in understanding the requirements applicable to wildland-urban interface areas and to provide a background for the provi- sions. Much of the text in the CWUIC is based on the requirements found in these other documents.

    Appendix I Board of Appeals.

    Appendix I contains the provisions for appeal and the establishment of a board of appeals. The provisions include the application for an appeal, the makeup of the board of appeals and the conduct of the appeal process.

    Population growth and the expanding urban development into traditionally nonurban areas have increasingly brought humans into contact with wildfires. According to the National Fire Protection Agency (NFPA), every year, wildfires burn across the United States and a growing number of people are living where wildfires are a real risk. In 2018 more than 58,000 fires burned nearly 9 million acres across the US. More than 25,000 structures were destroyed, including 18,137 residences and 229 commercial structures. California accounted for the highest number of structures lost in one state due to the number of significant fires, including the Mendocino Complex, Carr, Camp and Woolsey fires.

    The IWUIC is a model code that is intended to be adopted and used supplemental to the adopted building and fire codes of a jurisdiction. The unrestricted use of property in wildland-urban interface areas is a potential threat to life and property from fire and resulting erosion. The IWUIC has as its objective the establishment of minimum special regulations for the safeguarding of life and

    property from the intrusion of fire from wildland fire exposures and fire exposures from adjacent structures and to prevent structure fires from spreading to wildland fuels, even in the absence of fire department intervention.

    Safeguards to prevent the occurrence of fires and to provide adequate fire protection facilities to control the spread of fire in wildland-urban interface areas are provided in a tiered manner commensurate with the relative level of hazard present.

    ARRANGEMENT AND FORMAT OF THE 2025 CWUIC

    The format of the CWUIC allows each chapter to be devoted to a particular subject. The following table shows how the CWUIC is divided. The chapter synopses detail the scope and intent of the provisions of the CWUIC.

    Chapter 1 Scope and Administration.

    Chapter 1 establishes the limits of applicability of the code and describes how the code is to be applied and enforced. The provisions of Chapter 1 establish the authority and duties of the code official appointed by the authority having jurisdiction and also establish the rights and privileges of the design professional, contractor and property owner.

    Chapter 2 Definitions.

    Chapter 2 is the repository of the definitions of terms used in the body of the code. The user of the code should be familiar with and consult this chapter because the definitions are essential to the correct interpretation of the code and because the user may not be aware that a term is defined.

    Chapter 3 Wildland-Urban Interface Areas.

    Chapter 3 provides for the fundamental aspect of applying the code—the legal declaration and establishment of wildland-urban interface areas within the adopting jurisdiction, mapping of the area, periodic review and updates.

    Chapter 4 Wildland-Urban Interface Area Requirements.

    The requirements of Chapter 4 apply to all occupancies in the wildland-urban interface and pertain to all of the following:

    1. Fire service access to the property that is to be protected, including fire apparatus access roads and off-road driveways.

    2. Premises identification.

Frequently asked questions

Who must prepare and sign construction documents?

Construction documents must be submitted with each permit application and, where required by statute or when the code official so directs, shall be prepared and stamped by a registered design professional; the code official may also require additional substantiation or peer review for alternative methods or special conditions (§106) .

How long before a CWUIC permit becomes invalid if work doesn't start?

On and after Jan 1, 2019, a permit becomes invalid unless work authorized by the permit commences within 12 months of issuance or is not suspended/abandoned for 12 months after starting; the code official may grant written extensions (see §105.8) .

When will a certificate of occupancy or completion be issued?

A certificate of completion/occupancy is issued only after the code official determines the project complies with the CWUIC (final inspections and required documentation); temporary certificates of occupancy may be issued for portions of work that are safe to occupy (§110) .
