What is the Code Compliance Agency and its role?

The Mechanical Code requires each jurisdiction to name an enforcement agency and appoint an official (often called the building or code official) who — with deputies as needed — implements, administers and enforces the code; the official is appointed by the chief appointing authority and may interpret but not waive code requirements.

What the code requires — 2-4 sentences

The Code requires a local enforcement agency to be established and staffed so the mechanical code can be implemented, administered and enforced. The agency is created by the jurisdiction (name inserted locally) and the official in charge (the code official / building official depending on code adoption) is appointed by the chief appointing authority. See § 103.1, § 103.2 and § 103.3 for creation, appointment and deputies.

The single most important rule: a local agency must be designated and an official appointed to implement, administer and enforce the Mechanical Code (see § 103.1).

Requirements in detail

Core duties and structure (what § 103 requires)

  • Creation of the agency: The jurisdiction must identify the enforcement department (the text provides an “[INSERT NAME OF DEPARTMENT]”) and thereby create the agency responsible for this code. See § 103.1.
  • Title and appointment of the official: The official in charge is given a title by the adoption (examples: building official, code official, or another title) and must be appointed by the chief appointing authority of the jurisdiction. See § 103.2.
  • Deputies and delegated authority: The official may appoint deputy officials, inspectors and technical officers in accordance with local procedures; those employees exercise the powers delegated to them by the official. See § 103.3.

Relationship with specialized enforcing agencies

  • Some building types are enforced by state or other agencies (for example, OSHPD for certain hospitals, or DSA for state buildings). The Mechanical Code identifies adopting/enforcing agencies in the adoption matrix and in sections describing special jurisdictions (see agency-specific adoption notes such as the OSHPD entries and the adoption matrix).
  • Local enforcing agencies (city/county building departments) are specifically charged with enforcing the code for most occupancies; those duties and powers are set out elsewhere in Chapter 1 (local enforcing agency duties). See CMC Local Enforcing Agency notes.

Exceptions & special cases

  • Special-state enforcing agencies: When a state agency (for example, OSHPD for hospitals or the Division of the State Architect for certain facilities) has statutory enforcement authority, that agency — not the local building department — is the enforcing agency for the portions of code listed in the adoption tables. See the OSHPD / DSA adopting-agency language in the code.
  • Different official titles in other parts of the Code: The code text uses different titles depending on the code part (e.g., “building official,” “fire code official,” or generically “code official”); the local insert determines the specific title used for the enforcement official for the Mechanical Code. See the examples in § 103.1 and adopting‑agency entries.
  • Delegation must follow local procedures: § 103.3 requires deputies and technical officers to be appointed “in accordance with the prescribed procedures of this jurisdiction”; local charter, civil service, or personnel rules can limit delegation.

Common mistakes

  • Misreading the agency name: assuming the state named a single statewide enforcing department — the code requires the jurisdiction to insert the actual department name (local or state) at adoption; it is not automatic. See § 103.1.
  • Treating the code official as having unilateral authority to waive code provisions: the code permits interpretations and policies but they “shall not have the effect of waiving requirements specifically provided for in this code” (see § 104.2). Don’t conflate interpretation with waiver.
  • Overlooking special enforcing agencies: projects under OSHPD, DSA or other state bodies may not be under the local building department — check the adoption matrix and the specific agency entries. Missing this can result in applying the wrong permit or review path.
  • Assuming deputies have independent authority without delegation: deputies and inspectors only have the powers delegated by the official; confirm delegation in writing per local procedure. See § 103.3.

Worked example — concrete scenario

Scenario: A mid‑sized city adopts the CMC and must establish the enforcement agency.

  1. City council passes an ordinance naming the “City Building Department” as the Code Compliance Agency (local insertion to satisfy § 103.1). Action: the name is published in local ordinance and posted with permit application instructions. Reference: § 103.1.
  2. The city manager (the city’s chief appointing authority) appoints Jane Doe as the building official to lead the agency, per § 103.2. Action: appointment document signed, job description issued. Reference: § 103.2.
  3. The building official hires two deputy inspectors and delegates inspection authority by written directive consistent with city HR rules, per § 103.3. Action: deputies perform mechanical inspections, exercising delegated authority; the building official retains ultimate authority. Reference: § 103.3.
  4. A developer asks the building official to waive a prescriptive venting requirement. The official issues an interpretation and requests a technical report to determine compliance, but cannot waive code-mandated requirements; any alternative must be approved under the code’s alternative materials/design provisions and consistent with § 104.2.     SECTION 104—DUTIES AND POWERS OF BUILDING OFFICIAL

    [A] 104.1 General. The building official is hereby authorized and directed to enforce the provisions of this code.

    [A] 104.2 Determination of compliance. The building official shall have the authority to determine compliance with this code, to render interpretations of this code and to adopt policies and procedures in order to clarify the application of its provisions. Such interpretations, policies and procedures:

    1. Shall be in compliance with the intent and purpose of this code.
    2. Shall not have the effect of waiving requirements specifically provided for in this code.

    [A] 104.2.1 Listed compliance. Where this code or a referenced standard requires equipment, materials, products or services to be listed and a listing standard is specified, the listing shall be based on the specified standard. Where a listing standard is not specified, the listing shall be based on an approved listing criteria. Listings shall be germane to the provision requiring the listing. Installation shall be in accordance with the listing and the manufacturer’s instructions, and where required to verify compliance, the listing standard and manufacturer’s instructions shall be made available to the building official.

    [A] 104.2.2 Technical assistance. To determine compliance with this code, the building official is authorized to determine compliance with this code, to require the owner or owner’s authorized agent to provide a technical opinion and report.

    [A] 104.2.2.1 Cost. A technical opinion and report shall be provided without charge to the jurisdiction.

    [A] 104.2.2.2 Preparer qualifications. The technical opinion and report shall be prepared by a qualified engineer, specialist, laboratory or specialty organization acceptable to the building official. The building official is authorized to require design submittals to be prepared by, and bear the stamp of, a registered design professional.

    101.7 Maintenance. [BSC, DSA-SS, DSA-SS/CC, HCD 1, HCD 2] Buildings and structures, and parts thereof, shall be maintained in a safe and sanitary condition. Devices or safeguards which are required by this code shall be maintained in conformance with the code edition under which installed. The owner or the owner’s designated agent shall be responsible for the maintenance of buildings and structures. The requirements of this chapter shall not provide the basis for removal or abrogation of fire protection and safety systems and devices in existing structures.

    SECTION 102—APPLICABILITY

    [A] 102.1 General. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable. Where, in any specific case, different sections of this code specify different materials, methods of construction or other requirements, the most restrictive shall govern.

    [A] 102.2 Other laws. The provisions of this code shall not be deemed to nullify any provisions of local, state or federal law.

    [A] 102.3 Application of references. References to chapter or section numbers or to provisions not specifically identified by number shall be construed to refer to such chapter, section or provision of this code.

    [A] 102.4 Referenced codes and standards. The codes and standards referenced in this code shall be considered part of the requirements of this code to the prescribed extent of each such reference and as further regulated in Sections 102.4.1 and 102.4.2.

    Exception: Where enforcement of a code provision would violate the conditions of the listing of the equipment or appliance, the conditions of the listing shall govern.

    Appendix G Voluntary Home-Hardening Recommendations.

    Appendix G is an informational appendix that provides discussion of some elements of the proposed self-defense mechanisms and their role in enhancing the protection of exposed structures in the wildland-urban interface. The items provided in this appendix provide owners with suggestions for increasing the survivability of their structure. These items are not mandatory but can be considered by owners to increase the safety of structures.

    Appendix H Referenced California Documents.

    Appendix H contains portions of California statutes and regulations located in other documents. They are reprinted in Appendix H to aid the user in understanding the requirements applicable to wildland-urban interface areas and to provide a background for the provi- sions. Much of the text in the CWUIC is based on the requirements found in these other documents.

    R104.2.2 Alternative materials, design and methods of construction and equipment. The provisions of this code are not intended to prevent the installation of any material or to prohibit any design or method of construction not specifically prescribed by this code, provided that any such alternative has been approved.

    R104.2.2.1 Approval authority. An alternative material, design or method of construction shall be approved where the building official finds that the proposed alternative is satisfactory and complies with Sections R104.2.2 through R104.2.2.6.2, as applicable.

    R104.2.2.2 Application and disposition. Where required, a request to use an alternative material, design or method of construction shall be submitted in writing to the building official for approval. Where the alternative material, design or method of construction is not approved, the building official shall respond in writing, stating the reasons the alternative was not approved.

    R104.2.2.3 Compliance with code intent. An alternative material, design or method of construction shall comply with the intent of the provisions of this code.

    R104.2.2.4 Equivalency criteria. An alternative material, design or method of construction shall, for the purpose intended, be not less than the equivalent of that prescribed in this code with respect to all the following, as applicable:

    1. Quality.
    2. Strength.

Nothing herein shall derogate from the authority of the fire code official to determine compliance with codes or standards for those activities or installations within the fire code official’s jurisdiction or responsibility.

    [A] 102.12 Application of references. References to chapter or section numbers, or to provisions not specifically identified by number, shall be construed to refer to such chapter, section or provision of this code.

    102.13 Wildland-urban interface. The provisions of the California Wildland-Urban Interface Code shall apply to buildings and struc- tures built in the wildland-urban interface.

    PART 2—ADMINISTRATION AND ENFORCEMENT

    SECTION 103—CODE COMPLIANCE AGENCY

    [A] 103.1 Creation of agency. The [ INSERT NAME OF DEPARTMENT ] is hereby created and the official in charge thereof shall be known as the fire code official. The function of the agency shall be the implementation, administration and enforcement of the provisions of this code.

    [A] 103.2 Appointment. The fire code official shall be appointed by the chief appointing authority of the jurisdiction.

    [A] 103.3 Deputies. In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the fire code official shall have the authority to appoint a deputy fire code official, other related technical officers, inspectors and other employees. Such employees shall have powers as delegated by the fire code official.

    SECTION 104—DUTIES AND POWERS OF THE FIRE CODE OFFICIAL

    [A] 104.1 General. The fire code official is hereby authorized to enforce the provisions of this code.

    [A] 104.2 Determination of compliance. The fire code official shall have the authority to determine compliance with this code, to render interpretations of this code and to adopt policies and procedures in order to clarify the application of its provisions. Such interpretations, policies and procedures:

    1. Shall be in compliance with the intent and purpose of this code.
    2. Shall not have the effect of waiving requirements specifically provided for in this code.

Who actually becomes the Code Compliance Agency?

The jurisdiction identifies (in ordinance or administrative adoption) the enforcing department by inserting the department name required by § 103.1; most commonly this is the local building department.

Who appoints the official in charge?

The official is appointed by the local governing chief appointing authority (for example the city manager or county executive) as required by § 103.2.

Can the code official waive a code requirement?

No—while the code official can render interpretations and adopt policies, those interpretations cannot waive requirements specifically provided in the code (see § 104.2).

What if my building is under OSHPD or another state agency?

Special-state agencies (OSHPD, DSA, etc.) may be the enforcing agency for some building categories; check the CMC adoption matrix and the agency-specific entries in Chapter 1 to confirm jurisdiction.

Are deputies allowed to sign permits and perform inspections?

Yes—deputies and inspectors can exercise powers delegated by the official, but their authority must be delegated following the jurisdiction’s prescribed procedures (see § 103.3).
