Administration & scope of Chapter 3
Chapter 3 of the CEBC sets the administrative rules and universal provisions (§301–§309+) that determine applicability, enforcement and which compliance method to use.

Overview
Chapter 3 of the California Existing Building Code (CEBC) contains the provisions that apply across all three CEBC compliance methods and explains how those methods are selected and used. Section §301 identifies the three paths — Prescriptive (Chapter 5), Work‑Area (Chapters 6–12) and Performance (Chapter 13) — and establishes how alterations, additions and changes of occupancy are to be processed.
Chapter 3 also sets the administrative and cross‑code rules a project must follow: §301 contains the administration and method choices, §302 gives general authority to the code official (dangerous conditions, interplay with other California codes), and subsequent sections cover technical provisions such as structural loads (§304), accessibility (§306), smoke alarms (§307), carbon monoxide detection (§308) and exterior wall coverings (§309). These sections orient the user to which requirements apply “for all compliance methods.”
Because Chapter 3 defines scope, agency adoption, and how the CEBC integrates with other Title 24 parts (including OSHPD adoptions and exceptions), it’s the starting point for determining applicability, enforcement and which chapter(s) control a particular alteration or repair. Repairs are governed by Chapter 4 and relocated buildings by Chapter 14.

Chapter 1 establishes the limits of applicability of the code and describes how the code is to be applied and enforced. The provisions of Chapter 1 establish the authority and duties of the code official appointed by the authority having jurisdiction and also establish the rights and privileges of the design professional, contractor and property owner.
Chapter 2 Definitions.
Chapter 2 is the repository of the definitions of terms used in the body of the code. The user of the code should be familiar with and consult this chapter because the definitions are essential to the correct interpretation of the code and because the user may not be aware that a term is defined.

Chapter 3 Provisions for All Compliance Methods.
Chapter 3 guides the use of the three compliance methods of the CEBC and provides requirements that apply globally. The globally applicable requirement include general requirements related to buildings materials and other applicable codes, storm shelters, structural loads, in-situ load tests, accessibility, smoke alarms, carbon monoxide detection and exterior wall coverings.
Chapter 3A Provisions for All Compliance Methods.
Chapter 3A controls the compliance options for alteration, repair, addition, evaluation and change of occupancy of existing structures regulated by the Department of Health Care Access and Information/Office of Statewide Hospital Planning and Development, which include hospitals and correctional treatment centers (applications listed in Sections 1.10.1 (OSHPD 1).
Chapter 4 Repairs.
Chapter 4, a chapter independent of the three compliance methods, governs the repair of existing buildings. The provisions define conditions under which repairs may be made using materials and methods like those of the original construction or the extent to which repairs must comply with requirements for new buildings.

Chapter 4A governs the repair of existing buildings regulated by the Department of Health Care Access and Information/Office of State- wide Hospital Planning and Development, which include hospitals and correctional treatment centers (applications listed in Sections 1.10.1 (OSHPD 1).

CEBC § 1.10.1 High relevance — show source text
**_ The provisions of adopted sections in Chapters 3 through 5 shall control the alteration, repair and change of occupancy or function of existing structures for applications listed in Section 1.10.1, 1.10.2, 1.10.4 and 1.10.5 regulated by the Department of Health Care Access and Information/Office of Statewide Hospital Planning and Development (OSHPD). Functional service spaces shall comply with the requirements in the California Building Code, Sections 1224, 1225, 1226, 1227 and 1228.
301.1.1 Bleachers, folding and telescopic seating and grandstands. Existing bleachers, folding and telescopic seating and grandstands shall comply with ICC 300.
301.2 Repairs. Repairs shall comply with the requirements of Chapter 4.
301.3 Alteration, addition or change of occupancy. The alteration, addition or change of occupancy of all existing buildings shall comply with one of the methods listed in Section 301.3.1, 301.3.2 or 301.3.3 as selected by the applicant. Sections 301.3.1 through 301.3.3 shall not be applied in combination with each other. [OSHPD 1R, 2, 4 and 5] Sections 301.3.2 and 301.3.3, not adopted by OSHPD.
Exception: Subject to the approval of the code official, alterations complying with the laws in existence at the time the building or the affected portion of the building was built shall be considered in compliance with the provisions of this code. New structural

PROVISIONS FOR ALL COMPLIANCE METHODS
members added as part of the alteration shall comply with the California Building Code . This exception shall not apply to the following:
Alterations for accessibility required by the California Building Code, Chapter 11A.
Alterations that constitute substantial improvement in flood hazard areas, which shall comply with Sections 503.2, 701.3 or 1303.1.3.
Structural provisions of Section 304, Chapter 5 or to the structural provisions of Sections 706, 805 and 906.
301.3.1 Prescriptive compliance. Alterations, additions and changes of occupancy complying with Chapter 5 of this code in buildings complying with the California Fire Code shall be considered in compliance with the provisions of this code.
Exception: Hospital buildings removed from acute care service, skilled nursing facilities, intermediate-care facilities, correctional treatment centers and acute psychiatric hospitals [OSHPD 1R, 2, 4 and 5]. The provisions of adopted sections in Chapters 3 through 5 shall control the alteration, repair and change of occupancy or function of existing structures for applications listed in Section 1.10.1, 1.10.2, 1.10.4 and 1.10.5 regulated by the Department of Health Care Access and Information/Office of Statewide Hospital Planning and Development (OSHPD). Refer to Chapter 3A for services, systems and utilities that serve OSHPD 1 buildings.

1 ADMINISTRATION
DIVISION I CALIFORNIA ADMINISTRATION
SECTION 1.1—GENERAL
1.1.1 Title. These regulations shall be known as the California Existing Building Code, may be cited as such and will be referred to herein as “this code.” The California Existing Building Code is Part 10 of thirteen parts of the official compilation and publication of the adoption, amendment and repeal of building regulations to the California Code of Regulations, Title 24, also referred to as the California Building Standards Code. This part incorporates by adoption the 2024 International Existing Building Code of the International Code Council with necessary California amendments.
1.1.2 Purpose. The purpose of this code is to establish the minimum requirements to safeguard the public health, safety and general welfare through structural strength, means of egress facilities, stability, access to persons with disabilities, sanitation, adequate lighting and ventilation and energy conservation; safety to life and property from fire and other hazards attributed to the built environment; and to provide safety to firefighters and emergency responders during emergency operations.
1.1.3 Scope. The provisions of this code shall apply to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures throughout the State of California. [HCD 1 & 2] The provisions of this code shall apply to repair, alteration, change of occupancy, addition to and relocation of every existing building or structure or any appurtenances connected or attached to such buildings or structures throughout the State of California.
1.1.3.1 Nonstate-regulated buildings, structures and applications. Except as modified by local ordinance pursuant to Section 1.1.8, the following standards in the California Code of Regulations, Title 24, Parts 2, 2.5, 3, 4, 5, 6, 7, 9, 10 and 11 shall apply to all occupancies and applications not regulated by a state agency.

Application— Correctional treatment centers.
Enforcing agency— Health Care Access and Information/Office of Statewide Hospital Planning and Development (OSHPD). The office shall enforce the California Energy Commission – Energy Regulations, the Division of the State Architect—Access Compliance regulations, and the regulations of the Office of the State Fire Marshal for the above-stated facility types.

This code provides three main options for a designer in dealing with alterations of existing buildings. These are laid out in Section 301 of this code:
Option 1: Work for alteration, change of occupancy or addition of all existing buildings shall be done in accordance with the Prescriptive Compliance Method given in Chapter 5. It should be noted that this method originates from the former Chapter 34 of the IBC (2012 and earlier editions).
Option 2: Work for alteration, change of occupancy or addition of all existing buildings shall be done in accordance with the Work Area Compliance Method given in Chapters 6 through 12.

Option 3: Work for alteration, change of occupancy or addition of all existing buildings shall be done in accordance with the Performance Compliance Method given in Chapter 13. It should be noted that this option was also provided in the former Chapter 34 of the IBC (2012 and earlier editions).
Under limited circumstances, a building alteration can be made to comply with the laws under which the building was originally built, as long as the accessibility requirements are met, there has been no substantial structural damage and there will be limited structural alteration. Flood hazard provisions also must still be addressed where there is a substantial improvement.
Note that all repairs must comply with Chapter 4 and all relocated buildings are addressed by Chapter 14.

The provisions of Title 24, Part 10, as adopted and amended by the Division of the State Architect—Structural Safety/Community Colleges [DSA-SS/CC], shall apply to the applications listed in Section 1.9.2.2.

1.9.2.2.3 Amendments. Division of the State Architect—Structural Safety/Community Colleges amendments in this code appear preceded with the acronym [DSA-SS/CC].

SECTION 1.10—DEPARTMENT OF HEALTH CARE ACCESS AND INFORMATION/ OFFICE OF STATEWIDE HOSPITAL PLANNING AND DEVELOPMENT
1.10.1 OSHPD 1 and OSHPD 1R. Specific scope of application of the agency responsible for enforcement, enforcement agency and the specific authority to adopt and enforce such provisions of this code, unless otherwise stated.
Application [OSHPD 1] General acute care hospital buildings. [OSHPD 1R] Nonconforming hospital SPC or freestanding buildings that have been removed from acute care service.
Enforcing agency— Health Care Access and Information/Office of Statewide Hospital Planning and Development (OSHPD). The office shall enforce the California Energy Commission – Energy Regulations, the Division of the State Architect—Access Compliance regulations, and the regulations of the Office of the State Fire Marshal for the above-stated facility types.

1.10.1.2 Applicable building standards. California Building Standards Code, Title 24, Parts 2, 3, 4, 5, 6, 9, 10 and 11.

Plans and spec-_ ifications shall be prepared by an engineer duly qualified in that branch of engineering necessary to perform such services. Administration of the work of construction shall be under the charge of the responsible architect or engineer except that where plans and specifications involve alterations or repairs, such work of construction may be administered by an engi- neer duly qualified to perform such services and holding a valid certificate under Chapter 7 (commencing with Section 65700) of Division 3 of the Business and Professions Code for performance of services in that branch of engineering in which said plans, specifications and estimates and work of construction are applicable.
This section shall not be construed as preventing the design of fire-extinguishing systems by persons holding a C-16 license issued pursuant to Division 3, Chapter 9, Business and Professions Code. In such instances, however, the responsibility charge of this section shall prevail.
1.11.3.4 Existing high-rise buildings. 1. Complete plans or specifications, or both, shall be prepared covering all work required by California Fire Code Chapter 11 and California Existing Building Code for existing high-rise buildings. Such plans or specifications shall be submitted to the enforcing agency having jurisdiction. 2. When new construction is required to conform with the provisions of these regulations, complete plans or specifications, or both, shall be prepared in accordance with the provisions of this subsection. As used in this section, “new construction” is not intended to include repairs, replacements or minor alterations which do not disrupt or appreciably add to or affect the structural aspects of the building.
1.11.3.5 Retention of plans. Refer to Building Standards Law, Health and Safety Code Sections 19850 and 19851 for permanent retention of plans.
1.11.4 Fees.
1.11.4.1 Other fees. Pursuant to Health and Safety Code Section 13146.2, a city, county or district which inspects a hotel, motel, lodg- ing house or apartment house may charge and collect a fee for the inspection from the owner of the structure in an amount, as determined by the city, county or district, sufficient to pay its costs of that inspection.
1.11.4.2 Large family day-care. Pursuant to Health and Safety Code Section 1597.46, Large Family Day-Care Homes, the local government shall process any required permit as economically as possible, and fees charged for review shall not exceed the costs of the review and permit process.
1.11.4.3 High-Rise. Pursuant to Health and Safety Code Section 13217, High-Rise Structure Inspection: Fees and costs, a local agency which inspects a high-rise structure pursuant to Health and Safety Code Section 13217 may charge and collect a fee for the inspection from the owner of the high-rise structure in an amount, as determined by the local agency, sufficient to pay its costs of that inspection.

SECTION 310 [OSHPD 1R, 2 AND 5]—SERVICES/SYSTEMS AND UTILITIES
310.1 Services/systems and utilities. Services/systems and utilities shall only originate in, pass through or under structures which are under the jurisdiction of the Office of Statewide Hospital Planning and Development (OSHPD).
SECTION 311 [OSHPD 1R, 2 AND 5]—MEANS OF EGRESS
311.1 General. Means of egress through existing buildings shall be in accordance with the California Building Code, except as modified in this section.
311.1.1 Jurisdiction. Means of egress shall only pass through buildings that are under the jurisdiction of the Office of Statewide Hospital Planning and Development (OSHPD).
SECTION 312 [OSHPD 1R]—HOSPITAL SPC AND FREESTANDING BUILDINGS REMOVED FROM
GENERAL ACUTE CARE SERVICE REMAINING UNDER THE JURISDICTION OF OSHPD
312.1 General. The provisions of this section shall apply to hospital SPC and freestanding buildings that have been removed from Acute Care Service in accordance with California Existing Building Code Section 312A but remain under the jurisdiction of the Office of Statewide Hospital Planning and Development (OSHPD). These buildings may house various occupancies, uses and functions in accordance with this section. The requirements for those various occupancies, uses and functions shall be in accordance with the provisions of the California Building Standards Code, specific to each. The designation OSHPD 1R shall be limited to provisions applicable to the overall hospital SPC or freestanding building.
312.1.1 Non-general acute care hospital (non-GACH) SPC buildings. Non-GACH SPC buildings shall conform to the requirements of Section 1.10.1 [OSHPD 1R].
312.1.2 Freestanding buildings. Application and enforcement of freestanding buildings removed from general acute care services but remaining under OSHPD jurisdiction shall be in accordance with Section 1.10.1 [OSHPD 1R].
Freestanding hospital-owned clinics shall be permitted to be under the jurisdiction of OSHPD in accordance with the California Administrative Code Sections 7-2104, 7-2105 and 7-2106.
312.1.3 Non-General Acute Care Building (non-GACH SPC building) access. All access points into hospital SPC buildings removed from general acute care service shall prominently display signage at each access point stating “NO GENERAL ACUTE CARE SERVICES BEYOND THIS POINT.”
312.2 Definitions.
FREESTANDING. Refer to Part 1, California Administrative Code, Chapter 7.
SPC BUILDING. Refer to Part 2, California Building Code, Chapter 2.
312.3 Buildings to remain under OSHPD jurisdiction.
