    904.2 Fire alarm and detection systems. Fire alarm and detection shall be provided in accordance with Section 907 of the California Building Code as required for new construction in accordance with California Fire Code Sections 907 and 1103.7.

    904.2.1 Systems out of service. Existing fire alarm and detection systems shall be maintained in accordance with Section 901.7 of the California Fire Code. Site fire protection during construction shall be in accordance with Chapter 33 of the California Building and California Fire Codes.

    SECTION 905—MEANS OF EGRESS

    905.1 General. The means of egress shall comply with the requirements of Section 804 except as specifically required in Sections 905.2 and 905.3.

    905.2 Means-of-egress lighting. Means of egress from the highest work area floor to the floor of exit discharge shall be provided with artificial lighting within the exit enclosure in accordance with the requirements of the California Building Code .

    SECTION 906—STRUCTURAL

    [BS] 906.1 General. Where buildings are undergoing Level 3 alterations, the provisions of this section shall apply.

    [BS] 906.2 Existing structural elements resisting lateral loads. Where work involves a substantial structural alteration,the lateral load-resisting system of the altered building shall be shown to satisfy the requirements of Section 1609 of the California Building Code and Section 304.3.2 of this code. Where the building is assigned to Seismic Design Category D or F, supports and attachments for nonstructural components required to serve any portion of the building with a use included in Risk Category IV shall comply with Section 1613 of the California Building Code or shall comply with ASCE 41 using an objective of Position Retention nonstructural performance with the BSE-1E earthquake hazard level.

    Exceptions:

    1. Buildings of Group R occupancy with not more than five dwelling or sleeping units used solely for residential purposes that are altered based on the conventional light-frame construction methods of the California Building Code or in compliance with the provisions of the California Residential Code .
    2. Where the intended alteration involves only the lowest story of a building, structural components of the lateral load resisting system above that story need not comply with this section.

    [BS] 906.3 Seismic Design Category F. Where the building is assigned to Seismic Design Category F, the lateral force-resisting system of the altered building shall meet the requirements of Section 1609 of the California Building Code and Section 304.3.2 of this code.     903.2.1 Separation required. Where the work area is in any attached dwelling unit in Group R-3 or any multiple single-family dwelling (townhouse), walls separating the dwelling units that are not continuous from the foundation to the underside of the roof sheathing shall be constructed to provide a continuous fire separation using construction materials consistent with the existing wall or complying with the requirements for new structures. Work shall be performed on the side of the dwelling unit wall that is part of the work area.

    Exception: Where alterations or repairs do not result in the removal of wall or ceiling finishes exposing the structure, walls are not required to be continuous through concealed floor spaces.

    903.3 Interior finish. Interior finish in exits serving the work area shall comply with Section 802.4 between the highest floor on which there is a work area to the floor of exit discharge.

    903.4 Enhanced classroom acoustics. In Group E occupancies, where the work area is a Level 3 alteration, enhanced classroom acoustics shall be provided in all classrooms with a volume of 20,000 cubic feet (565 m [3] ) or less. Enhanced classroom acoustics shall comply with the reverberation time in Section 808 of ICC A117.1.

    SECTION 904—FIRE PROTECTION

    904.1 Automatic sprinkler systems. An automatic sprinkler system shall be provided in accordance with Section 903 of the California Building and California Fire Codes.

    904.2 Fire alarm and detection systems. Fire alarm and detection shall be provided in accordance with Section 907 of the California Building Code as required for new construction in accordance with California Fire Code Sections 907 and 1103.7.

    904.2.1 Systems out of service. Existing fire alarm and detection systems shall be maintained in accordance with Section 901.7 of the California Fire Code. Site fire protection during construction shall be in accordance with Chapter 33 of the California Building and California Fire Codes.

    1009.12 Alarms and emergency warning systems and two-way communication systems. Required emergency warning systems shall activate a means of warning the hearing impaired. Emergency warning systems provided as part of the fire-alarm system and two-way communication systems required by Chapter 10 shall be designed and installed in accordance with NFPA 72 as amended in Chapter 80.

    SECTION 1010—DOORS, GATES AND TURNSTILES

    In contrast, Level 1 alterations do not involve space reconfiguration, and Level 2 alterations involve extensive space reconfiguration that does not exceed 50 percent of the building area. Depending on the nature of alteration work, its location within the building, and whether it encompasses one or more tenants, improvements and upgrades could be required for the open floor penetrations, sprinkler system or the installation of additional means of egress such as stairs or fire escapes. At times and under certain situations, this chapter also is intended to improve the safety of certain building features beyond the work area and in other parts of the building where no alteration work might be taking place.

    SECTION 901—GENERAL

    901.1 Scope. Level 3 alterations as described in Section 604 shall comply with the requirements of this chapter.

    901.2 Compliance. In addition to the provisions of this chapter, work shall comply with all of the requirements of Chapters 7 and 8. The requirements of Sections 802, 803, 804 and 805 shall apply within all work areas whether or not they include exits and corridors shared by more than one tenant and regardless of the occupant load.

    Exception: Buildings in which the reconfiguration of space affecting exits or shared egress access is exclusively the result of compliance with the accessibility requirements of Section 306.7.1 shall not be required to comply with this chapter.

    SECTION 902—SPECIAL USE AND OCCUPANCY

    902.1 Reserved.

    902.2 Group R-2.1 occupancies. Group R-2.1 occupancies shall be classified in accordance with Section 308.2 of the California Build- ing Code .

    902.2.1 Smoke barriers in Group R-2.1 . In Group R-2.1 occupancies where the work area is on a story used for sleeping rooms for more than 30 care recipients, the story shall be divided into not fewer than two compartments by smoke barrier walls in accordance with Section 420.6 of the California Building Code .

    902.3 Ambulatory care facilities. Where a Level 3 work area includes an existing ambulatory care facility, the following shall be provided:

    1. A smoke compartment in accordance with Section 422.3 of the California Building Code, where the alteration results in an ambulatory care facility greater than 10,000 square feet on one story.
    2. Separation from adjacent spaces in accordance with Section 422.2 of the California Building Code, where any such facility has the potential for four or more care recipients incapable of self-preservation at any time.

    SECTION 903—BUILDING ELEMENTS AND MATERIALS

    903.1 Existing shafts and vertical openings. Existing stairways that are part of the means of egress shall be enclosed in accordance with Section 802.2.1 from the highest work area floor to, and including, the level of exit discharge and all floors below.

    903.2 Fire partitions in Group R-3. Fire separation in Group R-3 occupancies shall be in accordance with Section 903.2.1.

    Exception: The adjoining compartment shall not be required to have a stairway or door leading directly outside, provided that the refuge area into which a horizontal exit leads has stairways or doors leading directly outside and are so arranged that egress shall not require the occupants to return through the compartment from which egress originates.

    1026.5 Standpipes. Standpipes and standpipe hose connections shall be provided where required by Sections 905.3 and 905.4.

    1026.6 Two-way communication. Where a refuge area does not contain a two-way communication system at an elevator landing or within an area of refuge, a two-way communication system shall be installed in an approved location in a public area and shall comply with Sections 1009.8.1, 1009.8.2 and 1009.11.

    Exception: Two-way communication systems are not required in Group I-2 and I-3 facilities.

    SECTION 1027—EXTERIOR EXIT STAIRWAYS AND RAMPS

    1027.1 General. Exterior exit stairways and ramps serving as an exit component in a means of egress system shall comply with the requirements of this section.

    1027.2 Use in a means of egress. Exterior exit stairways shall not be used as an element of a required means of egress for Group I-2 occupancies. For occupancies in other than Group I-2, exterior exit stairways and ramps shall not be used as an element of a required means of egress for buildings exceeding six stories above grade plane or that are high-rise buildings.

    1027.3 Open side. Exterior exit stairways and ramps serving as an element of a required means of egress shall be open on not less than one side, except for required structural columns, beams, handrails and guards. An open side shall have not less than 35 square feet (3.3 m [2] ) of aggregate open area adjacent to each floor level and the level of each intermediate landing. The required open area shall be located not less than 42 inches (1067 mm) above the adjacent floor or landing level.

    1027.4 Side yards. The open areas adjoining exterior exit stairways or ramps shall be either yards, courts or public ways; the remaining sides are permitted to be enclosed by the exterior walls of the building.

    The fire-resistance rating shall be not less than that required for the interior exit stairway and ramp. A fire door assembly complying with Section 716 of the California Building Code shall be installed in the fire barrier to provide a means of egress from the interior exit stairway and ramp to the exit passageway. Openings in the fire barrier other than the fire door assembly are prohibited. Penetrations of the fire barrier are prohibited.

    Exceptions:

    1. Penetrations of the fire barrier in accordance with Section 1023.5 shall be permitted.
    2. Separation between an interior exit stairway or ramp and the exit passageway extension shall not be required where there are no openings into the exit passageway extension.
    3. Separation between an interior exit stairway or ramp and the exit passageway extension shall not be required where the interior exit stairway and the exit passageway extension are pressurized in accordance with Section 909.20.4 of the California Building Code .

    [BE] 1023.4 Openings. Interior exit stairway and ramp opening protectives shall be in accordance with the requirements of Section 716 of the California Building Code .

    Openings in interior exit stairways and ramps other than unprotected exterior openings shall be limited to those required for exit access to the enclosure from normally occupied spaces and for egress from the enclosure.

    Elevators shall not open into interior exit stairways and ramps.

    [BE] 1023.5 Penetrations. Penetrations into or through interior exit stairways and ramps are prohibited except for the following:

    1. Equipment and ductwork necessary for independent ventilation or pressurization.

    2. Fire protection systems.

    3. Security systems.

    4. Two-way communication systems.

    5. Electrical raceway for fire department communication systems.

    6. Electrical raceway serving the interior exit stairway and ramp and terminating at a steel box not exceeding 16 square inches (0.010 m [2] ).

    7. Structural elements, such as beams or joists, supporting the interior exit stairway or ramp or enclosure.

    8. Structural elements, such as beams or joists, supporting a roof at the top of the interior exit stairway or ramp.

    Such penetrations shall be protected in accordance with Section 714 of the California Building Code . There shall not be penetrations or communication openings, whether protected or not, between adjacent interior exit stairways and ramps.

    Exception: Membrane penetrations shall be permitted on the outside of the interior exit stairway and ramp. Such penetrations shall be protected in accordance with Section 714.4.2 of the California Building Code .

    [BE] 1023.6 Ventilation. Equipment and ductwork for interior exit stairway and ramp ventilation as permitted by Section 1023.5 shall comply with one of the following items:

    1. Such equipment and ductwork shall be located exterior to the building and shall be directly connected to the interior exit stairway and ramp by ductwork enclosed in construction as required for shafts.
    2. Where such equipment and ductwork is located within the interior exit stairway and ramp, the intake air shall be taken directly from the outdoors and the exhaust air shall be discharged directly to the outdoors, or such air shall be conveyed through ducts enclosed in construction as required for shafts.
    3. Where located within the building, such equipment and ductwork shall be separated from the remainder of the building, including other mechanical equipment, with construction as required for shafts.

    405.4.3 Elevators. Where elevators are provided, each compartment shall have direct access to an elevator. Where an elevator serves more than one compartment, an enclosed elevator lobby shall be provided and shall be separated from each compartment by a smoke barrier in accordance with Section 709. Doorways in the smoke barrier shall be protected by fire door assemblies that comply with Section 716, shall comply with the smoke and draft control assembly requirements of Section 716.2.2.1 with the UL 1784 test conducted without an artificial bottom seal, and shall be automatic-closing by smoke detection in accordance with Section 716.2.6.6.

    405.5 Smoke control system. A smoke control system shall be provided in accordance with Sections 405.5.1 and 405.5.2.

    405.5.1 Control system. A smoke control system is required to control the migration of products of combustion in accordance with Section 909 and the provisions of this section. Smoke control shall restrict movement of smoke to the general area of fire origin and maintain means of egress in a usable condition.

    405.5.2 Compartment smoke control system. Where compartmentation is required, each compartment shall have an independent smoke control system. The system shall be automatically activated and capable of manual operation in accordance with Sections 907.2.18 and 907.2.19.

    [F] 405.6 Fire alarm systems. A fire alarm system shall be provided where required by Sections 907.2.18 and 907.2.19.

    [BE] 405.7 Means of egress. Means of egress shall be in accordance with Sections 405.7.1 and 405.7.2.

    [BE] 405.7.1 Number of exits. Each floor level shall be provided with not fewer than two exits. Where compartmentation is required by Section 405.4, each compartment shall have not fewer than one exit and not fewer than one exit access doorway into the adjoining compartment.

    [BE] 405.7.2 Smokeproof enclosure. Every required stairway serving floor levels more than 30 feet (9144 mm) below the finished floor of its level of exit discharge shall comply with the requirements for a smokeproof enclosure as provided in Section 1023.12.

    [F] 405.8 Standby and emergency power. A standby power system complying with Section 2702 shall be provided for the standby power loads specified in Section 405.8.1. An emergency power system complying with Section 2702 shall be provided for the emergency power loads specified in Section 405.8.2.

    [F] 405.8.1 Standby power loads. The following are classified as standby power loads:

    1. Smoke control system.
    2. Ventilation and automatic fire detection equipment for smokeproof enclosures.
    3. Elevators, as required in Section 3003.

    9 ALTERATIONS—LEVEL 3

    User notes:

    About this chapter : Chapter 9 provides the technical requirements for those existing buildings that undergo Level 3 alterations. The purpose of this chapter is to provide detailed requirements and provisions to identify the required improvements in the existing building elements, building spaces and building structural system. This chapter is distinguished from Chapters 7 and 8 by involving alterations that cover 50 percent or more of the aggregate area of the building. In contrast, Level 1 alterations do not involve space reconfiguration, and Level 2 alterations involve extensive space reconfiguration that does not exceed 50 percent of the building area. Depending on the nature of alteration work, its location within the building, and whether it encompasses one or more tenants, improvements and upgrades could be required for the open floor penetrations, sprinkler system or the installation of additional means of egress such as stairs or fire escapes. At times and under certain situations, this chapter also is intended to improve the safety of certain building features beyond the work area and in other parts of the building where no alteration work might be taking place.

    SECTION 901—GENERAL

    901.1 Scope. Level 3 alterations as described in Section 604 shall comply with the requirements of this chapter.

    901.2 Compliance. In addition to the provisions of this chapter, work shall comply with all of the requirements of Chapters 7 and 8. The requirements of Sections 802, 803, 804 and 805 shall apply within all work areas whether or not they include exits and corridors shared by more than one tenant and regardless of the occupant load.

    Exception: Buildings in which the reconfiguration of space affecting exits or shared egress access is exclusively the result of compliance with the accessibility requirements of Section 306.7.1 shall not be required to comply with this chapter.

    SECTION 506 A —CHANGE OF OCCUPANCY

    506 A .1 Compliance. A change of occupancy shall not be made in any building unless that building is made to comply with the requirements of the California Building Code for the use or occupancy. Changes of occupancy in a building or portion thereof shall be such that the existing building is not less complying with the provisions of this code than the existing building or structure was prior to the change. Subject to the approval of the building official, changes of occupancy shall be permitted without complying with all of the requirements of this code for the new occupancy, provided that the new occupancy is less hazardous, based on life and fire risk, than the existing occupancy.

    Exception: The building need not be made to comply with Chapter 16 A of the California Building Code unless required by Section 506 A .5.

    506 A .1.1 Change in function . A change in function shall require compliance with all the functional requirements for new construc- tion in the California Building Code, including requirements in California Building Code Section 1224. Compliance shall be only as necessary to meet the specific provisions and is not intended to require the entire building be brought into compliance.

    Exception: Minimum room clearances, areas and dimensions may meet the requirements of the 2001 California Building Code for existing rooms re-used for a similar purpose, subject to the approval of OSHPD.

    506 A .2 Certificate of occupancy. A certificate of occupancy shall be issued where it has been determined that the requirements for the new occupancy classification have been met.

    914.3.4 Automatic smoke detection. Smoke detection shall be provided in accordance with Section 907.2.13.1.

    914.3.5 Emergency voice/alarm communication system. An emergency voice/alarm communication system shall be provided in accordance with Section 907.5.2.2.

    914.3.6 Emergency responder communication coverage. In-building, two-way emergency responder communication coverage shall be provided in accordance with Section 510.

    914.3.7 Fire command. A fire command center complying with Section 508 shall be provided in a location approved by the fire department.

    914.3.8 Smoke control.

    914.3.8.1 Smoke control system. All portions of high-rise buildings shall be provided with a smoke control system in accordance with California Building Code, Section 909.

    914.3.8.2 Smokeproof exit enclosures. Every exit enclosure in high-rise buildings shall comply with California Building Code, Sections 909.20 and 1023.12. Every required stairway in Group I-2 occupancies serving floors more than 75 feet (22 860 mm) above the lowest level of fire department vehicle access shall comply with Sections 909.20 and 1023.12 of the California Building Code.

    Exception: In high-rise buildings, exit enclosures serving three or less adjacent floors where one of the adjacent floors is the level of exit discharge.

    914.4 Atriums. Atriums shall comply with Sections 914.4.1 and 914.4.2.

    914.4.1 Automatic sprinkler system. An approved automatic sprinkler system shall be installed throughout the entire building.

    Exceptions:

    1. That area of a building adjacent to or above the atrium need not be sprinklered, provided that portion of the building is separated from the atrium portion by not less than a 2-hour fire barrier constructed in accordance with Section 707 of the California Building Code or horizontal assemblies constructed in accordance with Section 711 of the California Building Code, or both.
    2. Where the ceiling of the atrium is more than 55 feet (16 764 mm) above the floor, sprinkler protection at the ceiling of the atrium is not required.

    914.4.2 Fire alarm system. A fire alarm system shall be provided where required by Section 907.2.14.

    914.5 Underground buildings. Underground buildings shall comply with Sections 914.5.1 through 914.5.5.

    914.5.1 Automatic sprinkler system. The highest level of exit discharge serving the underground portions of the building and all levels below shall be equipped with an automatic sprinkler system installed in accordance with Section 903.3.1.1. Waterflow switches and control valves shall be supervised in accordance with Section 903.4.1.

    914.5.2 Smoke control system. A smoke control system is required to control the migration of products of combustion in accordance with Section 909 and provisions of this section. Smoke control shall restrict movement of smoke to the general area of fire origin and maintain means of egress in a usable condition.

    SECTION E106—GENERAL STANDARDS FOR EMERGENCY USES

    E106.1 Scope. The provisions of Sections E106.2 through E106.7 shall apply to all existing structures being repurposed and to all structures relocated to support the response to an emergency.

    E106.2 Intent. The intent of this section is to provide a reasonable level of safety in a structure repurposed for emergency use.

    E106.3 Change of use or occupancy. Existing buildings used in a way that was not originally intended by occupancy class or use shall be allowed without formally changing the occupancy. The previous occupancy and use shall resume upon the conclusion of the emergency . Where the temporary live load of the floor is more than that required by Section 1607 of the California Building Code for the original use, the area designated for the temporary live load shall be posted with placards for the approved live load.

    E106.4 Fire safety provisions. Determination of the fire safety requirements by the code official shall be in accordance with Section E106.4.1 through E106.4.5 in order to make determinations of safe conditions rather than strict adherence to the provisions of the California Fire Code .

    APPENDIX E—TEMPORARY EMERGENCY USES

    E106.4.1 Fire safety and evacuation plans. Fire safety and evacuation plans shall be provided in accordance with Sections 403 and 404 of the California Fire Code . Submittal documents shall be updated where there are any physical changes to the layout of the structure.

    E106.4.2 Training and practice drills. Training of staff and practice drills shall comply with Sections 405 and 406 of the California Fire Code . Structures in place for longer than 30 days shall conduct evacuation drills in accordance with Section 405.3 of the Cali- fornia Fire Code based on the temporary use.

    E106.4.3 Fire protection. An evaluation shall be performed to decide on fire protection needed utilizing NFPA 550.

    E106.4.4 Emergency access. Emergency vehicle access roads shall be approved by the fire code official.

    E106.4.5 Fire watch. A fire watch in accordance with Section 403.11.1 of the California Fire Code shall be permitted to be provided in lieu of other fire protection systems.

    E106.5 Means of egress. Means of egress shall comply with Section 1011.5, in addition to Sections E106.5.1 through E106.5.3.

    Exception: In Group I-2 occupancies, in areas where corridors are used for movement of care recipients in beds, the clear width of ramps and corridors shall be not less than 48 inches (1219 mm).

    E106.5.1 Exit discharge. Exit discharge shall provide access to a public way or to a safe dispersal area in accordance with Section 1028.5 of the California Building Code.

    E106.5.2 Means of egress lighting. The means of egress shall be illuminated when the space is occupied.

    E106.6 Accessibility. A facility that is constructed to be accessible shall be maintained accessible during occupancy.

    E106.7 Temporary connection. The code official shall have the authority to authorize the temporary connection of the building or system to the utility, the source of energy, fuel or power, or the water system or sewer system in accordance with Section 111. Water closets and lavatories shall be either permanent plumbing fixtures installed within the structure or temporary water closets or lavatories, such as chemical toilets or other means approved by the code official.

    E106.7.1 Portable heating, cooling and cooking equipment. Portable heating, cooling and cooking equipment shall be used in accordance with the California Fire Code, their listing and manufacturer’s instructions.

    SECTION E107—USE OF SPECIFIC STANDARDS

    E107.1 Increased occupant load. Allowing for additional occupants in existing buildings shall comply with Sections E107.1.1 through E107.1.3.

    E107.1.1 Authorization. The code official is authorized to allow for an increase in the number of occupants or a change of use in a building or portion of a building during an emergency.

    E107.1.2 Maintenance of the means of egress. The existing means of egress shall be maintained.

    E107.1.3 Sleeping areas. Where a space is used for sleeping purposes, the space shall be equipped with smoke alarms in accordance with Sections 907.2.6.2 and 907.2.11 of the California Fire Code or be provided with a fire watch in accordance with Section 403.11.1 of the California Fire Code . Carbon monoxide alarms shall be installed in accordance with Section 915 of the California Fire Code where the structure uses any fossil fuel or wood burning appliances.
