812.05005 Earth Material.

“Earth Material”: Rock, natural soil, or combination thereof

812.05010 Educational Institutions.

“Educational Institutions”: Colleges or universities supported wholly or in part by public funds, and other colleges and universities giving general academic instruction as prescribed by the California State Board of Education.

812.05011 Emergency Shelter.

“Emergency Shelter”: A residential facility, other than a community care facility, operated by a provider that provides temporary accommodations to homeless persons with low income. The term “temporary accommodations” means that a person will be allowed to reside at the shelter for a time period not to exceed six months. For purposes of this definition, a “provider” shall mean a government agency or private non-profit organization which provides or contracts with recognized community organizations to provide emergency or temporary shelter, and which may also provide meals, counseling and other services, as well as common areas for residents of the facility. Such a facility may have individual rooms, but it is not developed with individual dwelling units, with the exception of the manager’s unit. (Added by Ord. 296 § 9, 2010)

812.05012 Employee.

“Employee” is a person who works in and/or performs for a Sexually-Oriented Business, regardless of whether or not said person is paid a salary, wage, or other compensation by the operator or owner of said business, or is an independent contractor. (Ord. 151 § 4, 1996; amended by Ord. 296 § 9, 2010)

812.05015 Environmental Constraints.

“Environmental Constraints”: Environmental factors which limit or inhibit the potential for land development, including, but not limited to, flood hazards, seismic hazards, air quality, and water supply.

812.05020 Environmental Impact.

“Environmental Impact”: Projected long- or short-term effects (adverse or beneficial) which a development project or plan may have on the natural and built environment if the project is carried out.

812.05025 Environmental Impact Report (EIR).

“Environmental Impact Report (EIR)”: An EIR is the public document used by a governmental agency to analyze the significant environmental effects of a proposed project, to identify alternatives, and to disclose possible ways to reduce or avoid possible environmental damage.

812.05035 Environmental Review Guidelines.

“Environmental Review Guidelines”: Written procedures adopted by the City Council for the purpose of implementing the requirements of the California Environmental Quality Act (CEQA).

812.05040 Erosion.

“Erosion”: The wearing away of the ground surface as a result of the movement of wind or water or machine.

812.05045 Erosion, Accelerated.

“Accelerated Erosion”: Accelerated erosion is erosion caused by a human-induced alteration of the vegetation, land surface, topography, or runoff pattern. Evidence of accelerated erosion is often indicated by exposed soils, gullies, rills, sediment deposits, or slope failures caused by human activities.

812.05050 Erosion Hazard.

“Erosion Hazard”: The term erosion hazard refers to the susceptibility of a site to erode, based on condition of slope, rock type, soil, and other site factors. Hazard may be determined based on a site-specific investigation, and such soil disturbance may be caused by wind, water, or machine.

812.05051 Escort.

“Escort” is any person who, for any form of consideration, agrees or offers to act as a companion, guide, or date for another person, or who agrees or offers to privately model lingerie or to privately perform a “striptease” for another person. Escort shall not include any person hired by a State licensed school for purposes of modeling in any art education class while such person acts in that capacity. (Ord. 151 § 4, 1996)

812.05052 Establishment.

“Establishment” shall include any of the following:

(a) The opening or commencement of any Sexually-Oriented Business as a new business; or

(b) The conversion of an existing business, whether or not it is a Sexually-Oriented Business, to any SexuallyOriented Business; or

• (c) The addition of any Sexually-Oriented Business to any other existing Sexually-Oriented Business; or to another existing non-Sexually-Oriented Business, with or without expansion of floor area; or

• (d) The relocation of any Sexually-Oriented Business; or

(e) The expansion or enlargement of the premises by ten (10) percent or more of the existing floor area as originally approved by the City’s Building Official. (Ord. 151 § 4, 1996)

812.05055 Exotic Animal.

“Exotic Animal”: Any warm or cold-blooded animal of the biological kingdom Animalia generally considered as wild, exotic, dangerous, venomous, or not normally domesticated.

812.05060 Exploration or Prospecting.

“Exploration or Prospecting”: These terms refer to the search for minerals by geological, geophysical, geochemical, or other techniques. These include, but are not limited to, sampling, assaying, drilling, or any surface or underground works needed to determine the type, extent, or quantity of mineral present.
