7.06.010. - Definitions.

For purposes of this Chapter, a "solid waste disposal facility" means any facility or location where disposal of solid waste occurs.

7.06.020. - Imposition of fee.

Every person engaged in the business of operating a solid waste disposal facility within the unincorporated area of the County of Yuba shall pay for solid waste disposed in the facility as a tipping fee the amount established in Section 13.20.400.

7.06.030. - Date of payment; supporting records.

The fee imposed under the provisions of Section 7.06.020 shall be paid on a calendar quarter basis and the fee for each such calendar quarter shall be due and payable not later than 30 days after the close of each calendar quarter. The solid waste disposal facility operator shall submit to the County, at the time such operator remits the fee imposed by this Chapter, a statement, together with supporting documentation, setting forth the amount of solid waste disposed of within the facility site for each calendar month during the calendar quarter. Such statement shall be in a form satisfactory to the County.

7.06.040. - Maintenance of records.

Each solid waste disposal facility operator shall keep and maintain at the local office of such solid waste disposal facility all records (including, but not limited to, weigh tickets if such are generated in the normal course of business) relating to any and all solid waste received or disposed of on the facility site. Such records shall be kept and maintained for not less than three years from the date such solid wastes were received or disposed of. All such records shall be available for inspection by the County Treasurer/Tax Collector, the County Auditor, the County Counsel and their designees, upon reasonable prior written notice sent to the solid waste disposal facility operator.

7.06.050. - Severability.

If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
