Editor's note— Ord. No. 1487, adopted 10-20-2009, added section 7.13 to the prior code. At the discretion of the editor, the designation of this Section was changed to a Chapter numbered 7.13 and entitled "Prohibition of Trash Scavenging From Refuse and Recycling Receptacles." In addition, at the discretion of the editor, the designation of the subsections from this Chapter have been changed into separate sections now appearing under Chapter 7.13.
7.13.010. - Purpose.¶
This Chapter is necessary to preserve the public health and safety. When trash scavengers enter business and residential refuse and recyclable containers it can cause refuse to be scattered about the area of the containers causing an unnecessary public health risk to scavengers as well as others. This Chapter regulates such behaviors County-wide.

7.13.020. - Garbage trespass.¶
It shall be unlawful for any person other than an authorized refuse collector or authorized recycling agent to remove or otherwise handle any solid waste or recyclables contained in any refuse or recycling receptacle that has been placed curbside or elsewhere, for collection by an authorized refuse collector or authorized recycling agent, without the prior written consent of the refuse collector or authorized recycling agent, or the property owner, tenant or agent thereof having exclusive use of such receptacle. This Section shall not apply to any peace officer, fire personnel or code enforcement officials in the performance of their duty.

7.13.030. - Violation.¶
This Chapter applies to all unincorporated areas of Yuba County. Any person violating any of the provisions of this Section shall be deemed guilty of an infraction and subject to a fine of no less than $250.00.
