Yuba County Municipal Code Ch. 2.95 Procedure for Filing of Inventories of County of Properties

2.95.010. - Definitions.

For the purpose of this Chapter the following phrases and words shall have the meanings given herein:

(1) Department head means any County officer or person in charge of any agency, office, department, service, or institution of the County, each judge or the clerk, secretary, or other administrative officer of each court of record, and the executive head of each special district whose affairs and funds are under the supervision and control of the Board of Supervisors or for which the Board is ex-officio governing board thereof.

(2) Property means any item of County property which initially costs in excess of $500.00 and which has a useful life of three years or more.

2.95.030. - Procedure of maintaining annual inventory.

The procedure for the annual inventory of property belonging to the County of Yuba is as follows:

(1) On or before July 1, of each year, the County Auditor shall deliver to each department head a list setting forth the County property indicated to be in the possession and charge of said department head by the inventory previously filed by such department head and the items of property acquired and charged to said department head during the preceding fiscal year.

(2) On or before July 10 of each year, each department head shall return and file said list with the County Auditor with a statement, under oath, that all of the County property shown on said list is presently in his possession or custody. The filing of said list shall constitute compliance with the provisions of Government Code § 24051.

2.95.040. - Lost, stolen, or otherwise unaccounted for property.

Each department head shall promptly report to the Auditor any lost or destroyed or unaccounted for County property. The auditor shall submit the statement to the Board of Supervisors together with his or her recommendations thereon. The Board of Supervisors may, when good cause exists therefor, order that the department head involved be discharged from responsibility for said County property and, further, that said items be removed from the inventory list of County property chargeable to said department head. No item of County property claimed to be lost, stolen, or otherwise unaccounted for shall be removed from the inventory list without prior approval of the Board of Supervisors. The action of the Board shall be reported to the County Auditor for property adjustment to accounting and inventory records.

2.95.050. - Extension of time for compliance.

The Board of Supervisors may, in its discretion, extend time for compliance of any of the requirements contained herein.

2.95.060. - Severability.

If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
