2.120.010. - Established.

There hereby is established pursuant to and under the authority of the Education Code § 19100, a County Free Library for the area of the County of Yuba described in Section 2.120.020.

2.120.020. - Area served.

The County Free Library established shall be for the residents of the County of Yuba.

2.120.030. - General supervision.

The County Free Library shall be under the general supervision of the Board of Supervisors. Subject to the exercise of its general powers of supervision, the Board of Supervisors may delegate to a library board of trustees or other lawfully created entity authority to operate, manage, control and administer the County Free Library.

2.120.040. - Powers of Board of Supervisors.

The Board of Supervisors shall have the following powers:

(1) Make general rules and regulations regarding the policy of the County Free Library.

(2) Establish, upon the recommendation of the County librarian, branches and stations throughout the County and may locate the branches and stations wherever deemed advisable.

(3) Determine the number and kind of employees of the library.

(4) Such additional powers as are granted by law to do any and every lawful act necessary to provide, improve, and extend free library services to the inhabitants of Yuba County.

2.120.050. - Severability.

If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
