2.53.010. - Created.¶
There is hereby created within the County of Yuba the Office of Clerk of the Board of Supervisors, pursuant to the authority of Government Code § 25100.5.

2.53.020. - County Clerk not to serve ex officio.¶
The County Clerk shall not serve as ex officio Clerk of the Board of Supervisors.

2.53.030. - Duties.¶
The Clerk of the Board of Supervisors or his or her designee shall perform the following duties and responsibilities:
(1) Attend each session of the Board of Supervisors and attend committee meetings when requested to so do.
(2) Keep and enter in the minute book of the Board a full and complete record of the proceedings of the Board at all regular and special meetings, including the entry in full of all resolutions, and of all decisions on questions concerning the allowance of accounts. The vote of each member of every question shall be recorded.
(3) Immediately after each meeting of the Board, deliver to, leave with the auditor all demands allowed for the payment of money.
(4) File and preserve or dispose of pursuant to law, all petitions, applications, and other papers and records deposited with him or her.
(5) Authenticate with his or her signature and the seal of the Board and file each ordinance passed by the Board.
(6) Receive, open, date and distribute all correspondence addressed to the Board of Supervisors of the County of Yuba.
(7) Take acknowledgments and administer and certify oaths in the performance of the Clerks official duties.
(8) Act as clerk to the Assessment Appeals Board.
(9) All other duties and responsibilities imposed by law on the Clerk of the Board of Supervisors or on the County Clerk as ex officio Clerk of the Board of Supervisors.

2.53.040. - Appointment; salary.¶
The Clerk of the Board of Supervisors shall be appointed by a majority vote of the Board at a salary to be determined by the Board.

2.53.050. - Removal.¶
The Clerk of the Board of Supervisors shall serve at the pleasure of the Board and may be removed by majority vote of the Board at any regular meeting thereof.

2.53.060. - Severability.¶
If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
