2.160.010. - Definitions.

(a) Yuba County Seal: The official seal of the County of Yuba, as shown in subdivision (a) of Section 2.160.030. The Yuba County Seal is sometimes referred to in this Chapter as the "Seal" or the "County Seal."

(b) Yuba County Logo: The graphic design created on behalf of the Yuba County, Office of the County Administrator to serve as a logo for Yuba County. The Yuba County Logo is sometimes referred to as the "Logo".

2.160.020. - Purpose.

The purpose of this Chapter is to prevent:

(1) Use of the Seal or Logo that conveys, or is reasonably calculated to convey, a false impression of sponsorship, endorsement, or approval by the County or any department, agency, or instrumentality thereof;

(2) Confusion, deception or mistake as to the County's official position on any matter;

(3) Loss of the County's substantial investment of time, effort, and expense in designing and developing its Seal and Logo;

(4) Loss of the value of the Seal and Logo as unique signifiers of the government of the County of Yuba; and

(5) Use of the Seal or Logo for commercial purposes.

2.160.030. - Design.

(a) The Yuba County Seal, is hereby re-established and re-adopted as set forth in the following representation. The Seal shall still constitute the Seal whether in black and white, color, or other hue or tone combination and regardless of the size, character, or medium in which it is depicted.

(b) The Yuba County Logo, is hereby re-established and re-adopted as set forth in the following representation. The logo shall still constitute the Logo whether in black and white, color, or other hue or tone combination and regardless of the size, character, or medium in which it is depicted.

2.160.040. - Use of Yuba County Seal.

(a) The Yuba County Seal is the property of the County of Yuba. The County Administrative Officer (CAO) is the custodian of the Yuba County Seal. The Seal shall be used for purposes directly connected with official business of the County and for use only in those matters approved by the Yuba County Administrator's Office or by resolution of the Board of Supervisors. Specifically, it may be used by County departments and elected and appointed officials acting in their official capacity to emboss official county documents, instruments, and communications for the purpose of validating their authenticity and indicating institutional sanction. The County Seal may also be used for official, legal, and ceremonial activities of the county. The Seal may not be used in any manner that would violate existing law governing the use of public property for campaign activity.

(b) As custodian, the CAO is authorized to determine appropriate usage of the Yuba County Seal beyond those uses set forth in subsection (a). In making such determinations, the CAO shall be guided by and limited to the purposes set forth in Section 2.160.020, and shall not prohibit or regulate use in any manner that would violate or infringe upon any rights guaranteed by the United States or California Constitutions.

(c) The Board of Supervisors may adopt regulations regarding proper design and form (e.g., colors, size, background, etc.) of the Seal which shall be applicable to all uses of the Seal upon adoption.

2.160.050. - Use of Yuba County Logo.

(a) The Yuba County Logo is the property of Yuba County. The County Administrative Officer (CAO) is the custodian of the Yuba County Logo. The logo shall be used to emboss written materials, documents, presentations, products, banners, or other marketing materials which have been endorsed, sponsored, or approved by the County Administrator or the Board of Supervisors, and which generally have as their purpose or effect, the promotion of Yuba County as a tourist destination, the economic development of the County or the conveyance of official sanction or sponsorship by the County. In addition, the logo may be used by county departments and elected and appointed officials acting in their official capacity for all purposes for which use of the Seal is authorized under Section 2.160.040 subsection (a). The logo may not be used in any manner that would violate existing law governing the use of public property for campaign activity.

(b) As custodian, the CAO is authorized, in consultation with County Counsel, to determine appropriate usage of the logo beyond those uses set forth in subsection (a). In making such determinations, the CAO shall be guided by and limited to the purposes set forth in section 2.160.020, and shall not prohibit or regulate use in any matter that would violate or infringe on any rights guaranteed by the United States or California Constitutions.

(c) The CAO may adopt regulations regarding proper design and form (e.g., colors, size, background, etc.) of the Logo which shall be applicable to all uses of the Logo upon adoption.

2.160.060. - Non-Department Agency Requests.

(a) Any non-department agency request(s) for use of the Yuba County Seal and/or Logo, including decals depicting the Seal and/or Logo, shall be in writing and shall provide a clear description of how the Seal and/or Logo will be utilized. All fonts used in addition to the original Seal and/or Logo design shall be larger and more prominent than all fonts on the Seal and/or Logo. The request(s) shall be submitted to the County Administrative Officer for action. Ultimate approval or denial for use of the County Seal and/or Logo Seal shall be by the County Administrative Officer in writing. All requests approved by the County Administrative Officer shall require an executed copy of the Yuba County Seal Use Agreement and/or the Yuba County Logo Use Agreement, as applicable.

(b) The County Administrative Officer shall be responsible for the creation and amendment of the Yuba County Seal Use Agreement and the Yuba County Logo Use Agreement.

(c) The County Administrative Officer may terminate the use or display of the County Seal or County Logo if in the judgement of the CAO the manner or nature of such use or display detracts from the County's purpose or interest.

2.160.070. - Penalties.

(a) Unauthorized use of County Seal.

Any use of the Seal not authorized by subsection (a) or (b) of Section 2.160.040 or in violation of regulations adopted by the Board of Supervisors pursuant to subsection (c) of Section 2.160.040 is prohibited. In addition to any other remedy authorized by law, violation of this Chapter shall be subject to an action in equity to enjoin further use of the Seal. Every person who maliciously or for commercial purposes, or without the prior approval of the County Administrator's Office uses, or allows to be used, any reproduction or facsimile of the Seal of the County of Yuba in any manner whatsoever is guilty of a misdemeanor, and shall be punishable by a fine of not more than $500.00 or by imprisonment in the County jail for not more than six months or both such fine and imprisonment.

(b) Unauthorized use of County Logo.

Any use of the Logo not authorized by subsection (a) or (b) of Section 2.160.050, or in violation of regulations adopted by the CAO pursuant to subsection (c) of Section 2.160.050, is prohibited. In addition to any other remedy authorized by law, violation of this Chapter shall be subject to an action in equity to enjoin further use of the Logo. 2.160.080. - Severability.

If any provision, clause, sentence or paragraph of this chapter or the application thereof to any person or circumstance shall be held invalid by a court of competent jurisdiction, such invalidity shall not affect the other provisions or applications of this Chapter which can be given effect without the invalid provisions or application and, to that end, the provisions of this Chapter are declared to be severable.
