2.123.010. - Established.¶
The Yuba County Library Advisory Commission is hereby established.

2.123.020. - Membership.¶
The Yuba County Library Advisory Commission shall consist of seven members as follows:
(1) Five public members selected by the Yuba County Board of Supervisors, one from each of the supervisorial districts, who shall be residents of the district from which appointed.
(2) The Chairman of the Board of Supervisors or another member of the Board as designated by him or her.
(3) The Mayor of the City of Marysville or a member of the City Council of the City of Marysville, as designated by the Mayor.

2.123.030. - Terms.¶
All terms are based upon the calendar year. The terms of all public members shall be the same as the member of the Board of Supervisors from whose Supervisorial District such public member was appointed. The members representing the Board of Supervisors and the City of Marysville shall serve at the pleasure of their appointing authority.

2.123.040. - Vacancies.¶
A vacancy on the Library Advisory Commission shall exist upon the death, resignation, or termination of residence within the area from which appointed. Vacancies shall be filled for the unexpired term. Each member shall serve until the appointment and qualification of his or her successor.

2.123.050. - Duties and responsibilities.¶
The duties and responsibilities of the Yuba County Library Advisory Commission are as follows:
(1) Act in an advisory capacity to the Board of Supervisors and the County Librarian.
(2) Consider the needs of the library program pertaining to services and facilities.
(3) Study and review plans and programs for the long-range development of the County Library.
(4) Consider proposals or requests submitted by individual citizens or groups as may pertain to the County Library.
(5) Review budget proposals and make recommendations on the budget to the Board of Supervisors.
(6) Make such recommendations to the Board of Supervisors as may be necessary and desirable.

2.123.060. - Meetings.¶
Regular meetings of the Yuba County Library Advisory Commission shall be held bi-monthly on a day to be determined by the Commission. Special meetings may be called as provided in Government Code § 54956 by the Chairman, the Secretary, or a majority of the Commission. A quorum to conduct a regular or special meeting shall consist of four members of the Commission. Any three unexcused absences by a public commission member will forfeit their appointment automatically.

2.123.070. - Officers.¶
At the first meeting of each calendar year the members shall elect a Chairman and Vice Chairman to hold office for a 12-month term. The County Librarian shall be the Secretary of the Commission. No person shall hold the office of Chairman for more than two consecutive terms.

2.123.080. - Minutes.¶
A copy of the minutes of each meeting of the Commission shall be kept on file by the secretary and shall be available to the public.

2.123.090. - Severability.¶
If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
