§ 8.20.010. Adoption and definitions.

  • A. This chapter is adopted pursuant to, and is intended to be consistent with, the State Fireworks Law (Health and Safety Code Sections 12500 and following).

  • B. The meaning and definition of all terms used in this chapter shall be the same as such terms are defined and used in the State Fireworks Law.

§ 8.20.020. Sale, manufacture or use prohibited.

No person or entity shall sell, manufacture, use or discharge any fireworks within the Town limits, except as permitted by Section 8.20.030.

§ 8.20.030. Public display of fireworks.

Public displays of fireworks may be permitted within the Town limits if conducted by a person appropriately licensed under the State Fireworks Law, upon obtaining from the Town a permit applied for and granted in accordance with the provisions of Health and Safety Code Sections 12640 and following, provided, however:

  • A. The application for a permit shall be made at least 45 days prior to the proposed display.

  • B. The Council shall grant a permit only upon finding that the public benefit outweighs the public detriment and that the applicant has complied with the provisions of the State Fireworks Law.

  • C. The Council may grant a permit subject to reasonable conditions. (Ord. 14, 1965; Ord. 299-00)
