§ 10.48.010. Applicability—Provisions not exclusive.

This chapter shall apply to bicycle registration and parking and operation of bicycles on pedestrian or bicycle facilities in conformity with state law and shall apply to any bicycle operated upon any street or sidewalk, or upon any public path set aside for the use of bicycles. The provisions contained herein are enacted pursuant to Section 21206 of the California Vehicle Code pertaining to bicycle registration and parking and operation of bicycles on pedestrian or bicycle facilities and are not intended to conflict in any way with the provisions thereof.

§ 10.48.020. Definitions.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

"Bicycle"

means any device upon which a person may ride which is propelled by human power through a system of belts, chains, or gears, having either two or three wheels, one of which is at least twenty inches in diameter, or having a frame size of at least fourteen inches.

"Bicycle dealer"

means any person, firm, partnership, or corporation which is engaged, wholly or partly, in the business of selling bicycles, or buying or taking in trade bicycles for the purpose of resale, selling or offering for sale, or otherwise dealing in bicycles, whether or not such bicycles are owned by such person or entity. The term also includes agents or employees of such person or entity.

"Bicycle lane" or "bike path"

means a lane for bicycle riders separated from any vehicular lanes upon a roadway and defined for bike riders by appropriate signs and markings.

"Bicycle plate"

means the license tax or decal designated by the state, in accordance with Section 39001 of the California Vehicle Code, to be permanently affixed to the bicycle, which bears a unique number permanently assigned to that bicycle by the state.

"Bicycle route" or "bike route"

means a suggested route of travel for bicycle riders. A "bicycle route" may offer no physical protection to the bike rider and is normally defined for the bicycle rider only by a sign indicating "Bike Route," which defines a suggested route element of a bicycle system and provides a certain awareness for the motorist that bicycle riders are sharing the roadway.

"Bike"

means the same as bicycle.

§ 10.48.030. Registration and licensing required.

No resident of the City shall operate a bicycle on any street, road, highway or other public property within the City unless the bicycle is licensed and registered under the provisions of this section and bears a current bicycle plate, attached thereto in accordance with this section and state law. Nonresidents of the City are not bound by the license and registration sections of Sections 10.44.030 through 10.44.130.

§ 10.48.040. License application.

Application for a bicycle license or the renewal thereof shall be made upon a form prescribed by the City and shall be made to the Chief of Police or his or her duly authorized representative.

§ 10.48.050. License issuance—Terms and conditions—Records.

A. Upon receipt of a proper application, including proof of ownership, the Chief of Police or his or her duly authorized representative shall issue a license indicia and registration form bearing the owner's name, address, telephone number, bicycle plate number, the bicycle manufacturer, type and frame number and any other descriptive material concerning the bicycle deemed necessary by the Chief of Police. In addition, also at the time of licensing, the owner shall be issued his or her permanent bicycle plate bearing the unique number permanently assigned to the bicycle by the state.

B. The Chief of Police shall keep a record of the number of each license, the date issued, the serial number of the bicycle, the bicycle plate number, and such other information deemed necessary by the Chief of Police.

§ 10.48.060. Display of license devices.

A. The Chief of Police shall cause the bicycle plate to be permanently attached to the rear fender or frame of the bicycle in such a position as to be plainly visible, and, at all times during the period for which the license device is issued, it shall remain attached thereto.

B. No person shall remove, destroy or mutilate any bicycle plate during the period for which it is issued, except upon a transfer of ownership or in the event the bicycle is destroyed by or at the direction of its owner.

§ 10.48.070. License renewal.

Bicycle licenses shall be renewed uniformly throughout the state at periods not to exceed three years. Renewal of a bicycle license shall be indicated by a supplementary adhesive device affixed parallel to and above or below the indicia with expiration date shown.

§ 10.48.080. Transfer of ownership requirements.

A. Whenever any person sells, trades, disposes of, or transfers any bicycle licensed pursuant to the provisions of Sections 10.44.030 through 10.44.130, he or she shall endorse upon the registration form previously issued for such bicycle, a written transfer of the same, setting forth the name, address, and telephone number of the transferee, the date of transfer, and the signature of the transferor, and shall deliver this registration form, so endorsed, to the Chief of Police or his or her duly authorized representative within ten days of the time of transfer. Each bicycle retailer and each bicycle dealer shall supply to each purchaser a preregistration form provided by the Chief of Police and shall include on the sale check or receipt given to the purchaser a record of the following information:

  1. Name of retailer;

  2. Address of retailer;

  3. Year and make of the bicycle;

  4. Serial number of the bicycle if delivered to the purchaser in an assembled state;

  5. General description of the bicycle;

  6. Name of the purchaser; and

  7. Address of the purchaser.

B. A copy of the preregistration form shall be filled out and forwarded by the purchaser to the Chief of Police within ten days from the date of sale.

§ 10.48.090. Address change—Duty to notify officials.

Whenever any bicycle owner changes his or her place of residence, he or she shall notify the Chief of Police or his or her duly authorized representative of such change of address within ten days.

§ 10.48.100. Records to be maintained.

The Police Department shall maintain records of each bicycle licensed during the period of the validity of the license or until notification that the bicycle is no longer to be operated. Such records shall include, but not be limited to, the license number, the serial number of the bicycle, the make and type of the bicycle and the name and address of the owner.

§ 10.48.110. Lost or stolen registration form or bicycle plate—Procedure when.

In the event that any registration form or bicycle plate issued pursuant to Sections 10.44.030 through 10.44.130 be lost or stolen, the owner of such bicycle shall immediately notify the Police Department and, within ten days after such notification, shall apply to the Police Department for a duplicate registration form or bicycle plate.

§ 10.48.120. Requirements imposed upon rental agencies.

A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a bicycle plate is attached thereto, as provided by Sections 10.44.030 through 10.44.130.

§ 10.48.130. Impoundment of unlicensed when.

Bicycles parked or left standing in public places which bear no current bicycle plate or which are in any other way in violation of Sections 10.44.030 through 10.44.130 may be impounded by the Police Department until such time as the owner purchases a license or otherwise complies with Sections 10.44.030 through 10.44.130.

§ 10.48.140. Riding on roadways permitted.

A. Riding or operating a bicycle on any street within the City is permitted in accordance with the California Vehicle Code unless specifically prohibited by action of the City Council.

B. The City Council may, by resolution, establish bicycle lanes, paths or routes within the City as they determine may be required.

C. The City's Traffic Engineer is authorized to erect or place and maintain signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person.

D. The City's Traffic Engineer is authorized to erect or place and maintain signs upon any street or adjacent to any street in the City, indicating the existence of a bicycle path, lane or route or otherwise regulating the operation and use of vehicles and bicycles with respect thereto, as long as the same are consistent with this chapter. Where such a sign is erected, such other designation, including, but not limited to appropriate painting or such other devices as the City's Traffic Engineer shall determine, will provide sufficient notice of the existence of the bicycle path, lane or route. Such signing shall conform with provisions established by the State Traffic-Control Devices Committee.

§ 10.48.150. Riding on sidewalks and playgrounds—Restrictions.

A. Riding of bicycles on any sidewalk or roadway is permitted, unless prohibited by appropriate signs authorized pursuant to the terms of this chapter.

B. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing pedestrians.

C. No persons shall ride or operate a bicycle upon any playground, park or schoolground not designated as a bicycle path or route, where children are playing, without first having secured the permission of the persons having supervision of the playground, park or schoolground.

§ 10.48.160. Parking requirements.

No person shall leave a bicycle lying on its side on any sidewalk, or shall park a bicycle on a sidewalk in any other position, so there is not an adequate path for pedestrian traffic. When a parking rack is available, no person shall park a bicycle on an adjacent street or sidewalk, except in such rack. The City Traffic Engineer may prohibit bicycle parking in designated areas of the public highway, provided that appropriate signs are erected.

§ 10.48.170. Violation.

Every person violating any provision of this chapter shall be deemed guilty of an infraction, unless specifically provided otherwise in this chapter or by state law.
