12-3-100 - Definitions.

As used in this chapter:

Apartment house shall mean a single building under one (1) roof containing three (3) or more dwelling units complete with kitchen facilities, whether let by day, week or month.

Applicant shall mean the person making application for water or sewer utility services.

Boarding house shall mean a dwelling other than a hotel where lodging or lodging and meals for three (3) or more persons is provided for compensation.

Business, occupancy shall mean any building or portion thereof or a room or rooms, used or occupied by a person to carry on a business, profession, trade or occupation for gain or profit.

Charge or rate shall mean the amount of money to be paid by consumers to the District for water services or materials, minimum charge shall mean the charge to be paid by consumer for each and every connection to the water system irrespective whether or not water is delivered through such connection to consumer during the period for which such charge is made.

Consumer shall mean any person having a connection or more than one (1) connection into the water system owned and operated by the District. The term shall also apply to the customer who has regularly applied for purchase of water.

Cross connection shall mean any physical connection between the piping system from the District water service and that of any other water supply that is not or cannot be, approved as safe and potable for human consumption, whereby water from the unapproved source may be forced or drawn into the District distribution mains.

Deposit shall mean a deposit of money paid in advance by an applicant for water or sewer services.

Dwelling group shall mean a group of two (2) or more detached or semi-detached dwelling units occupying a parcel of land in one (1) ownership, and having any yard or court in common but not including motels or auto courts.

Dwelling unit shall mean one (1) or more rooms under one (1) roof used for living purposes by one (1) family and containing one (1) kitchen.

Duplex shall mean a single building under one (1) roof containing only two (2) dwelling units complete with kitchen facilities.

Guarantor shall mean the person executing a guaranty of payment for an applicant applying for water or sewer utility services.

Guaranty of payment shall mean a written promise by the guarantor to pay unpaid charges of an applicant for water and sewer utility charges due.

Guest house shall mean detached living quarters of a permanent type of construction and without kitchen or cooking facilities and not be leased or rented separately from the main dwelling.

Hotel, motel shall mean any building or portion thereof used or intended to be used, let or hired out, containing one (1) or more guest rooms with automobile storage space provided in connection therewith which is used primarily for the accommodation of transient automobile travelers and in which there are no kitchen facilities, whether the compensation for hire be paid directly or indirectly.

Outside rates, outside users, outside consumers and surplus water. As used herein relate to District water delivered or distributed outside the corporate limits of the District.

Service or water service shall mean one (1) or more connections through which water is supplied or is available to a consumer from the water system owned and operated by the District.

Water department shall mean the Board of Directors, performing functions related to the District water services, together with the General Manager and other duly authorized representatives.

12-3-105 - Creation.

Division 1. of this chapter is a restatement of Ordinance 11 of the Windsor Water District revised as necessary to incorporate changes in State and local Codes. It is intended and a continuation of Ordinance 11, and all acts taken thereunder are hereby continued in full force and effect as if taken under this chapter.

In addition to the rules and regulations set forth in this Code, as may be amended from time to time, the Board may by resolution establish and change rules and regulation relating to fees and charges, personnel matters and any other matter not regulated herein.
