1.12.010 - Violation.

Unless otherwise specified, every act prohibited, declared unlawful or declared substandard or unsafe and every failure to perform an act made mandatory by this Code or any other ordinance of the City of Williams shall constitute either a misdemeanor or an infraction, at the discretion of the city attorney. For purposes of this Code, "person" shall be deemed to include a natural person, corporation, partnership, association, firm or other legal entity.

1.12.020 - Misdemeanor.

Except in cases where a different punishment is prescribed by state law, this Code, or an ordinance of the City of Williams, any person convicted of a misdemeanor for violation of a provision of this Code or an ordinance of the city is punishable by a fine not exceeding one thousand dollars or by imprisonment not exceeding six months, or by both such fine and imprisonment.

1.12.030 - Infraction.

Except in cases where a different punishment is prescribed by state law, this Code, or an ordinance of the City of Williams, any person convicted of an infraction for violation of a provision of this Code or an ordinance of the City of Williams is punishable by:

A. A fine not exceeding one hundred dollars for a first violation;

B. A fine not exceeding two hundred dollars for a second violation of the same provision of this Code or other city ordinance within one year;

C. A fine not exceeding five hundred dollars for each additional violation of the same provision of this Code or other city ordinance within one year.

1.12.040 - Each day a separate offense.

Each person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the City of Williams is committed, continued or permitted by any such person, and he or she shall be punishable accordingly.

1.12.050 - Nuisance.

In addition to any other penalty provided by this Code, any condition caused or permitted to exist in violation of any provision of this Code or any ordinance of the City of Williams shall be deemed to be a public nuisance and may be abated by the city in accordance with the standards and procedures provided by state and other laws.

1.12.060 - Civil action.

The city attorney, by and at the request of the city council or city staff, may institute an action in any court of competent jurisdiction to restrain, enjoin or abate the condition(s) found to be in violation of the provisions of this Code, including its adopted codes, as provided by law. The city attorney, by and at the request of the city council or city staff, may institute an action in any court of competent jurisdiction to collect a civil debt owing to the city. Attorneys' fees may be recoverable in such action pursuant to Section 8.16.095.

1.12.070 - Administrative citation.

As set forth in Chapter 10.33 of this Code and Article VI of Chapter 8.16 of this Code, the city may issue an administrative citation for any violation of this Code.
