9.08.010 Curfew--Exceptions.¶
It is unlawful for any person under the age of eighteen years to remain or loiter upon any public thoroughfare or any public place of amusement or entertainment within the corporate limits of the city between the hours of ten p.m. and five a.m. of any day unless the person is accompanied by a parent, guardian, or other adult person having control or charge of the minor. (Ord. 279 §l, 1981; Ord. 11 §1, 1946).
9.08.020 Entry into certain premises prohibited.¶
It is unlawful for any person under the age of eighteen years within the corporate limits of the city to enter, visit or be within any public pool and/or billiard hall and/or public amusement room wherein is played or operated any game of cards, game of chance of any kind or description, and/or any amusement device, as the same is defined in Chapter 5.08 of this code. (Ord. 11 §2, 1946).
9.08.030 Adult--Permitting violation prohibited.¶
It is unlawful for any parent, guardian, or any adult person, having control or charge of any person under the age of eighteen years, to permit, allow, or let such minor person remain upon or loiter upon any public thoroughfare or any public place in violation of Sections 9.08.010 and 9.08.020. (Ord. 279 §1, 1981; Ord. 11 §3, 1946).
9.08.040 Violation of Sections 9.08.010 through 9.08.030--Penalty.¶
Any person violating any provision of Sections 9.08.010 through 9.08.030 shall be guilty of a misdemeanor and, upon conviction, shall be punished as follows:
A. For the first offense, by a fine not exceeding ten dollars or by imprisonment in the county jail for a term not exceeding five days, or by both such fine and imprisonment;
B. For each subsequent offense, by a fine of not less than ten dollars or more than fifty dollars, or by imprisonment in the county jail for a term of not less than five days nor more than twenty-five days, or by both such fine and imprisonment. (Ord. 11 §4, 1946).
9.08.050 Permitting entry to certain premises prohibited.¶
It is unlawful for any person, firm or corporation, either as owner, operator, agent, employee or otherwise, keeping, maintaining, operating, or being in charge of any public pool, and/or billiard hall and/or any public amusement room, as specified in Section 9.08.020, to suffer or permit any person under the age of eighteen years to enter, visit or be within any public place specified in Section 9.08.020. (Ord. 11 §5, 1946).
9.08.060 Violation of Section 9.08.050--Penalty.¶
Any person, firm or corporation violating any provision of Section 9.08.050 shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding five hundred dollars, or by imprisonment in the county jail for a term not exceeding six months, or by both such fine and imprisonment. (Ord. 11 §6, 1946).
