Section 11.12.010 Purpose

Because the disposal of certain items into sanitary landfills contributes unnecessarily to

the premature closure of those landfills, and because many of those items can be used to replace virgin materials in the manufacture of consumer goods, and because the County of San Diego requires recyclables to be separated from the waste stream prior to disposal at County operated landfills, the declared purpose of this ordinance is to require that recyclable materials be separated from the waste stream prior to disposal. Section 11.12.020 Definitions

Whenever the following words are used in this chapter, they shall have the meaning

ascribed to them in this section. Customer” means any individual who places refuse for collection and disposal by a municipal or private solid waste collection firm. Designated recyclable materials” or “ recyclables” means any materials required to be separated from the waste stream prior to disposal as established by City Council resolution. Waste stream” means all definitions for waste, rubbish, debris, garbage and refuse as defined in Section 13.16.020, except “ hazardous wastes.” Prior Code 19-42; Ord. No. 89-12, Added 4/10/89; Ord. Section 11.12.030 Separation of Recyclable Materials

Designated recyclable materials shall be separated from the waste stream by the

customer prior to placement for collection in accordance with a schedule established by City Council resolution. The City or its authorized agent shall provide for a collection system for all designated residential, commercial and industrial recyclable materials. Prior Code 19-43; Ord. Section 11.12.040 Collection by Unauthorized Persons

From the time of placement at the curb or in recycling shelters for collection through a

City-sponsored program, items shall become the property of the City or its authorized agent. It

is a violation of this chapter for any person unauthorized by the City to collect or pick up or cause to be collected or picked up any such items. Section 11.12.050 Additional Methods of Disposal

Any person may donate or sell recyclables to any other person whether operating for

Section 11.12.060 Enforcement

  1. The City Manager, or his designee, is responsible for enforcement of the

Section 12. 04. 010 Damage or Removal Prohibited

No person shall trim, prune, cut, break, deface, burn or remove any tree, shrub, or flower

growing in any public place within the city, or damage or remove any protective structure around any tree, shrub or flower unless authorized, in writing, to do so by the City Engineer. Prior Code 27- 5. 1. 1; Ord. No. 81- 20, Amended 3/ 9/ 81)

Section 12. 04. 020 Application for Pruning or Trimming

Upon application, a permit may be granted to remove limbs or branches extending over

private property or interfering with overhead utility lines. Such work shall be done at the sole cost and expense of the applicant.
