Section 10.68.010 Definitions

Bicycle" is any device on which any person may ride, propelled exclusively by human

power or has fully operable pedals and an electric motor of less than 750 watts, or as otherwise defined in California Vehicle Code Section 231 & 312.5 as may be amended from time to time. Prior Code 5-1; Ord. No. 75-36, Amended 2/9/75; Ord. No. 76-3, Amended 2/23/76)

Bicycle Identification” is any bicycle license indica, registration form, serial number, or

identification marks on any bicycle.

Bikeway” means all facilities that provide primarily for, and promote, bicycle travel or as

otherwise defined by California Streets and Highways Code 890.4.

Crosswalk” is any portion of a roadway distinctly indicated for pedestrian crossing by lines

or other markings on the surface or as otherwise defined in California Vehicle Code Section 275.

Motorized Bicycle” or “ Moped” is a two-wheeled device with or without operational

pedals, an automatic transmission, and an electric or gas-powered motor that can propel the device and rider at speeds no greater than 30 miles per hour or as otherwise defined by California Vehicle Code Section 406 as may be amended from time to time.

Motorized Scooter” is any two-wheeled device that has handlebars, has either a

floorboard that is designed to be stood upon when riding and is powered by an electric motor, or as otherwise defined by California Vehicle Code Section 407.5 as may be amended from time to time.

Roadway” means all facilities that are ordinarily used for vehicular travel or as otherwise

defined in California Vehicle Code Section 530.

Sidewalk” means the portion of the public right of way used for pedestrian traffic. The

term “ sidewalk” excludes any area primarily designated for use by vehicles, bicycles, the conveyance of storm water or planted with landscape.

Section 10.68.020 Destroying Bicycle Identification

It is unlawful for any person to willfully or maliciously remove, destroy, alter, tamper with or

mutilate any bicycle license indicia, registration form, serial number or identification marks on any bicycle frame during the time such indicia is operative. However, nothing in this chapter prohibits the license collector from stamping numbers on the frames of bicycles on which no serial number can be found or on which said number is illegible or insufficient for identification purposes. Section 10.68.030 Riding on Sidewalks

Bicycle Restriction. It is unlawful for any person to ride or operate a bicycle upon any sidewalk in the city, with the exception of locations included in the City's Bicycle Master Plan with proper signage and striping as approved by the City's Traffic Engineer. Law enforcement officers shall be exempt from the provision of this section when in the performance of their duties. Ord. No. 98-12, Added, 11/10/98; Ord. No. 2015-3, Amended, 1/27/15)

Section 10.68.040 Riding on Bicycles

A. Any person riding or operating a bike shall always exercise reasonable care and

observe all applicable laws. B. It shall be unlawful for any person to ride in a manner not designed by the bicycle manufacturer for passenger riding. There shall be a manufacturer installed seat for the rider and every passenger on a bicycle. It shall be unlawful for the operator of any bicycle to carry any other person upon the handlebars or pegs of any bicycle.

Section 10.68.060 Dismount in Crosswalk and on Sidewalk

Every bicycle operator, when using a crosswalk to cross an intersection or using a sidewalk,

shall dismount from their bicycle to use the crosswalk or sidewalk. Ord. 2024- 14, Amended 12/10/2024)

Section 10.68.070 Bicycle Parking

A. No person shall park a bicycle on a public street or roadway unless signage or

marked delineation explicitly allows for it. B. It is permissible to park a bicycle on a sidewalk in a bike rack to support the bicycle or against a building or on a sidewalk in such a manner as to afford the least obstruction to pedestrian traffic. Ord. 2024- 14, Amended 12/10/2024)

Section 10.68.080 Traffic and Safety Laws Apply to Persons Riding Bicycles

Every operator or passenger riding a bicycle on a roadway or bikeway shall be granted all of

the rights and shall be subject to all of the duties applicable to the operator or passenger of a vehicle established in this charter and as otherwise provided in Sections 21200-21213 of the California Vehicle Code.

The above is intended to require riders and operators of bicycles to always ride at speeds

appropriate for the road and bikeway conditions, in the same direction of vehicle travel on said road, and to position themselves in accordance with California Vehicle Code Section 21202( b), which allows for exceptions when it is safe and necessary to do so. Section 10.68.090 Motorized Scooters & Motorized Bicycles

Every operator or rider of a motorized scooter or motorized bicycle is required to follow the laws of this charter as if operating as a bicycle rider and as otherwise provided in the California Vehicle Code. In addition, a person may not operate a motorized scooter or motorized bicycle unless that person holds a valid driver’ s license with appropriate classifications as provided by the California Vehicle Code Section 12804. 9. Every operator or rider of a motorized scooter or motorized bicycle is required to comply with all applicable provisions of the California Vehicle Code governing the operation of such devices to ensure consistency and safety. Section 10.68.100 Enforcement

In lieu of the imposition of the penalties authorized by this title and/or the filing of charges in

a court of competent jurisdiction, the Sheriff Captain or designee may allow a first-time violator of this chapter to complete a law enforcement department- approved bicycle safety course.

Section 10. 69. 010 Purpose and Intent

The City Council of the City of Vista is concerned with the safety of its citizens and the

protection of public and private property. The City Council recognizes that skateboarding, roller blading, roller skating, and similar activities are very popular activities. They also recognize that skateboards, roller blades, and roller skates are a popular form of transportation for youth. The City Council also recognizes that such activities are potentially dangerous, not only to the skaters, but also to spectators and pedestrians. Skateboarding and roller blading tricks increase the potential for injuries and damage private and public property improvements. Such activities may increase property owner' s insurance and property maintenance costs. It is the City Council' s purpose and intent in enacting this ordinance to minimize the risk of injury to persons and reduce the damage to property, while at the same time allowing skateboarders and roller skaters to participate responsibly in the recreational activity. Section 10. 69. 020 Skateboarding, Roller Blading and Roller Skating Prohibited - Posted Private Property

It is unlawful for any person to ride a skateboard, roller blades, roller skates, coasters,

scooters or any other similar form of non- motorized wheeled device designed for rapid movement on private property open to the public in an office- professional zone; in a C- 1, C- 2 or C- 3 commercial zone; or in a mobile home park where signs prohibiting such activity are posted by the owner of the property. For the purpose of this section, whenever a property- owner has properly posted the property, the prohibition shall extend to include any public sidewalk constructed within the private property or immediately adjacent to the private property boundary. It is unlawful for any person to ride a skateboard, roller blades, roller skates, coasters,

scooters or any other similar form of non- motorized wheeled device designed for rapid movement on public school property located within the city of Vista when the school district has

enacted a policy prohibiting such activities and posted signs on school grounds. For the purposes of this section, public school property shall include any public sidewalks constructed within the school property or immediately adjacent to the school property boundary. Ord. Section 10. 69. 040 Skateboarding, Roller Blading and Roller Skating Prohibited - Public Property

It is unlawful for any person to ride a skateboard, roller blades, roller skates, coasters, scooters, or any other similar form of non- motorized wheeled device designed for rapid movement on any public property where signs have been posted in addition to the following locations: A. On any sidewalk, public street, public parking lot, or public property in the Central Business District. The Central Business District is defined as that area of the city bounded on the west by North and South Santa Fe Avenue between Eucalyptus Avenue and Jefferson Avenue Vista Village Drive); bounded on the north by Jefferson Avenue ( Vista Village Drive) between North Santa Fe Avenue and Palm Drive, and also by Palm Drive between Jefferson Avenue Vista Village Drive) and East Vista Way ( Main Street); bounded on the east by East Vista Way Main Street) between Palm Drive and South Citrus Avenue, and also by South Citrus Avenue between East Vista Way ( Main Street) and Eucalyptus Avenue; and bounded on the south by Eucalyptus Avenue between South Citrus Avenue and South Santa Fe Avenue. The Central Business District is considered to include the roadway and sidewalks on both sides of all boundary streets as well as for all streets located internally to the boundary streets. B. The Vista City Hall and surrounding sidewalks, landscape barriers, and parking lot. C. The Vista Branch of the San Diego County Public Library at 700 Eucalyptus Avenue and surrounding sidewalks, landscape barriers, and parking lot. D. The Wildwood Public Park and the surrounding sidewalks, landscape barriers, internal roads, bridges and parking lot. E. In any public drainage facility, culvert, ditch or channel, tennis court, or outdoor basketball court. Ord. No. 98- 11, Enacted, 11/ 10/ 98)

Section 10. 69. 050 Interference with Pedestrians and Traffic

A. Any person upon a skateboard, roller skates, roller blades, coaster, scooter or

other similar form of non- motorized wheeled device shall exercise due caution and shall yield the right-of-way to and not interfere with pedestrians on any sidewalk or public right- of-way. B. No person shall ride skateboards, roller skates, roller blades, coaster or scooter, or other similar form of non- motorized wheeled device on any public right-of-way in such a manner as to interfere with or prevent the lawful use of a public right-of-way by vehicular traffic. Section 10. 69. 060 Protective Headgear Required

A. Prohibition 1. It is prohibited and unlawful for anyone to operate a skateboard, roller- skates, roller- blades, scooter, or similar- type wheeled vehicle on any public sidewalks or streets or on any public property, where permitted, unless that person is wearing properly fitted and fastened protective headgear. For the purpose of this section, the term " Protective

Headgear" shall mean a safety helmet that meets the standards of the American National Standards Institute ( ANSI Z 90. 4 Bicycle Helmet Standards) the Snell Memorial Foundation Standard for Protective Headgear for use in Bicycling, or the American Society for Testing Materials ( ASTM F- 1447 Standard). 2. A parent or guardian is responsible for requiring that a child under the age of 18 years wears protective headgear while skateboarding, roller-skating, roller- blading, riding a scooter, or similar wheeled vehicle on any public sidewalk or street or public property, of Vista. As used in this chapter, " Guardian" shall mean an adultwhere permitted, in the City who legally has the care and management of a person under the age of 18. B. Enforcement 1. Criminal Citation. Any person violating this provision of this chapter is guilty of an infraction and upon conviction shall be punished according to the provisions of Section 1. 16. 010 of this code. 2. Administrative Citation. Any person authorized to enforce this provision may issue an administrative citation in lieu of a criminal citation pursuant to the Vista Municipal Code. Enforcing officials are authorized to issue the administrative citations and confiscate the skateboard, roller- skates, roller- blades, scooter, or similar- type wheeled vehicle to be held until such time as an Administrative Hearing is conducted. The use of this remedy by the City shall not bar the use of any other remedy for the purpose of enforcing the provisions of this code. C. Administrative Citation Penalty. Any person violating this provision of this chapter is subject to an administrative citation penalty not to exceed $ 50 and required to attend a safety awareness course. Additionally, any person under the age of 18 must have a parent or guardian attend the safety awareness course along with the offender. D. Administrative Citation Hearing. At the time of the Administrative Hearing, the offender shall deposit $ 50 with the Administrative Hearing Officer. Upon payment of the $ 50 deposit, the skateboard, roller- skates, roller- blades, scooter, or similar- type wheeled vehicle shall be returned to the offender. The offender shall complete the course within 30 days of the Administrative Hearing. Within 30 days of the Administrative Hearing and upon written request to the Director of Administrative Services for the City of Vista or his designee, the offender shall be entitled to one extension not to exceed 30 days from the date of the receipt of the request.
