Sec. 6-7.1. - Declaration of Policy.

In order to control unnecessary, excessive and annoying noise, the City of Villa Park adopted Ordinance No. 74-210 (codified as section 6-6) constituting a noise control ordinance. It is desirable to supplement such ordinance by prohibiting the use of commercial sound trucks as set forth hereinbelow.

It is determined that such commercial sound trucks are detrimental to the public health, welfare and safety and contrary to public interest, therefore, the City Council does ordain and declare that the use of commercial sound trucks as set forth is a public nuisance and shall be punishable as such. It is also a misdemeanor pursuant to Ordinance No. 66-75A (codified as Article 1-5 Penalty).

Sec. 6-7.2. - Definitions.

For the purposes of this section, the following words and phrases shall have meaning as described below:

"Person" shall mean and include the singular and the plural and shall also mean and include any person, firm, corporation, association, club, partnership, society or any other form of association or organization.

"Sound Truck" shall mean any vehicle or horse drawn vehicle, having mounted thereon, or attached thereto, any sound amplifying equipment for use of commercial purposes.

"Sound Amplifying Equipment" shall mean any machine or device for the amplification of the human voice, music or any other sound. "Sound amplifying equipment" as used herein shall not be construed as including standard automobile radios when used and heard only by occupants of the vehicle in which installed or warning devices on authorized emergency vehicles or horns or other warning devices on other vehicles used only for traffic safety purposes.

Sec. 6-7.3. - Prohibition.

No person shall use or cause to be used a commercial sound truck with its sound amplifying equipment in operation for any purpose within the City of Villa Park.
