Sec. 6-10.1. - Definitions.

As used in this Article:

"Electronic smoking device" shall mean an electronic device that can be used to deliver an inhaled dose of nicotine, or other substances, including any component, part, or accessory of such a device, whether or not sold separately. The term includes any such device, whether manufactured, distributed, marketed, or sold as an electronic cigarette, an electronic cigar, an electronic cigarillo, an electronic pipe, an electronic hookah, or any other product name or descriptor.

"Enclosed" shall mean closed in by a roof and four or more connected walls with appropriate openings for ingress and egress.

"Smoke or smoking" shall mean the inhaling, exhaling, burning, or carrying of any lighted or heated cigar, cigarette, pipe, device, or any other lighted or heated tobacco, nicotine, or cannabis and cannabis product intended for inhalation, in any manner or in any form, whether natural or synthetic. "Smoking" also includes the use of any electronic smoking device which creates a vapor or aerosol to be inhaled, in any manner or in any form.

Sec. 6-10.2. - Reasonable Smoking Distance Required—Twenty Feet.

No public employee or member of the public shall smoke a tobacco product inside a public building, or in an outdoor area within twenty (20) feet of a main exit, entrance, or operable window of a public building, or in a passenger vehicle, as defined by Section 465 of the Vehicle Code, owned by the state.

Sec. 6-10.3. - Enforcement.

The provisions of this Article may be enforced by the Orange County Sheriff Department, the code enforcement officer, or other employees designated by the City Manager.

Sec. 6-10.4. - Other Applicable Laws.

This Article shall not be interpreted or construed to permit smoking where it is otherwise restricted by any other applicable local, state and federal health, safety or fire code ordinances or statutes.
