Villa Park Municipal Code Art. 6-5 Partially Completed Streets

It is hereby declared to be a public nuisance for any street to be excavated or left unpaved. If such a condition exists or is permitted to continue for any period in excess of fifteen (15) days, the individual, firm, or corporation responsible for causing such condition to exist shall abate such condition within seven (7) days after the receipt of written notice to said individual, firm, or corporation from the City Manager.

If as a result of any such condition a situation arises whereby an immediate hazard exists, the City Manager is authorized to use whatever steps are necessary to immediately abate any such condition, provided that the City Manager shall first attempt to contact the responsible person to allow him an opportunity to correct the hazardous situation. If that person cannot be reached, or if he fails to take satisfactory steps to correct the hazardous situation, the City Manager is authorized to immediately abate such condition as aforesaid.

If the City is required to expend any funds, or devote any City personnel to abate such condition, then the responsible person shall forthwith reimburse the City for such funds or the actual costs of the City personnel required to abate said condition. If the responsible person fails or refuses to promptly reimburse City for such expenses, said person shall become liable for any additional expenses, including court costs and legal fees, incurred by City to collect the sum due as reimbursement.
