2.19.010 - Electronic filing of campaign statements and statements of economic interests.¶
(a) Except as specified otherwise in this subsection, any elected officer, candidate, committee or other person required to file statements, reports or other documents required by Chapter 4 (commencing with Section 84100 of the Government Code), shall file such statements, reports or other documents online or electronically with the city clerk, using procedures established by the city clerk in compliance with this chapter.
(1) Subdivision (a) shall not apply to any elected officer, candidate, committee or other person who receives contributions totaling less than one thousand dollars, or makes expenditures totaling less than one thousand dollars, in a calendar year.
(2) Effective as of the date the California Secretary of State certifies a new online filing and disclosure system, subdivision (a) shall not apply to any elected officer, candidate, committee or other person who receives contributions totaling less than two thousand dollars, or makes expenditures totaling less than two thousand dollars, in a calendar year.
(b) Any person holding a position listed in Government Code Section 87200 or designated in a local conflict of interest code adopted pursuant to California Government Code section 87300 shall be also be required to file his/her statement of economic interests reports (Form 700) online or electronically with the city clerk using procedures established by the city clerk in compliance with this chapter.
(c) Procedures established by the city clerk pursuant to this chapter shall:
(1) Ensure that the electronic or online system complies with the requirements set forth in Section 84615 of the Government Code, as such may be amended from time to time; and
(2) Comply with the standards and requirements set by all other applicable laws, including without limitation, Government Code Section 87500.2 and implementing regulations established by the Fair Political Practices Commission, as such may be amended from time to time; and
(3) Ensure the integrity of the data transmitted and include safeguards against efforts to tamper with, manipulate, alter, or subvert the data.
(d) In any instance in which an original statement, report or other document must be filed with the California Secretary of State and a copy of that statement, report or other document is required to be filed with the city clerk, the filer may, but is not required to, file the copy electronically.
(e) Any elected officer, candidate, committee or other person who has electronically filed a statement, report, or other document using the city clerk's online or electronic system is not required to file a copy of that document in paper format with the city clerk.
(f) If the city clerk's electronic system is not capable of accepting a particular type of statement, report or other document, an elected officer, candidate, committee or other person shall file that document with the city clerk in an alternative format.
