14.04.010 - Short title.

This title shall be known and cited and referred to as "Park Rules and Regulations."

14.04.020 - Definitions.

"Park" is a park, reservation, playground, recreation center, or any other public area in the city, owned or used by the city, and devoted to active or passive recreation, or a special taxing district.

14.04.030 - Chapter compliance.

It shall be the duty of every person to comply with and observe each and all of the following rules and regulations relating to public parks within the city which are hereby promulgated, designed, fixed and established in this chapter.

14.04.040 - Unlawful acts in public parks and public places.

Within the said limits of any parks or public places within the city, no person shall do any acts hereinafter specified:

(a) To hitch, fasten, lead, drive or let loose any animal or fowl of any kind, except in areas which may be designated by the recreation and park director; provided that this shall not apply to dogs and cats when led by a leash or chain not more than six feet long and under full control of its owner or custodian;

(b) To ride or drive any horse or other animal; or propel any vehicle, cycle or automobile, except in designated areas;

(c) To remain, stay or loiter in any park or building therein between the hours of ten p.m. and six a.m. the following day without special permission from the city council, park superintendent or recreation and park director;

(d) To light or maintain any fire, cook, prepare or serve or eat any lunch, barbecue or picnic except at a stove, barbecue, fire circle or other place provided for that purpose;

(e) To possess, carry or discharge any firearms, firecrackers, rockets, explosives or any other fireworks, air gun, bow and arrow or sling shot;

(f) To throw, project or propel upon a lawn or across any park, public highway or driveway within a park any missile capable of causing personal injury or damage to personal property;

(g) To cut, break, injure, deface or destroy any tree, shrub, plant, rock, building, cage, pen, monument, sidewalk or paved area, fence, bench or other structure, apparatus or property; or plug, pull up, cut, take or remove any shrub, bush, plant or flower; or mark or write upon, paint or deface in any manner any building, monument, bench, sidewalk, paved area or other structure;

(h) To cut or remove any wood, turf, grass, soil, rock, gravel, sand or fertilizer;

(i) To swim, fish in, bathe, wade in or pollute the water of any fountain, pond, lake or stream; provided, however, that nothing contained herein shall be construed as prohibiting the use for the purpose intended of any casting pool, wading pool or bathing pool specially provided for that particular use;

(j) To camp or lodge therein except by permission in writing by the recreation and park director;

(k) To throw, discard, place or dispose of any garbage or refuse in any place other than in a garbage can or other receptacle maintained for that purpose;

(l) To disturb the peace and quiet by any undue loud or unusual noise or by tooting, blowing or sounding any automobile siren or signal or indulging in riotous, boisterous, threatening or indecent conduct or abusive, threatening, profane or indecent language;

(m) To stand or park any vehicle, except by special permission, on any road or path, except at places designated for parking by the recreation and park director;

(n) To hold any meeting, service, concert, exercise or exhibition without first obtaining written permission from the recreation and park director;

(o) To play or bet at or against any game which is played, conducted, dealt or carried on with cards, dice or other devices for money, chips, shells, credit or other representatives of value; or maintain or exhibit any gambling table or other instrument of gambling or gaming.

14.04.050 - Confining or prohibiting activities.

The recreation and park director may prohibit or confine to posted areas any activities to the extent necessary so that it will not be detrimental to the health, safety and welfare of the general public or damaging to the property of the city or recreation and park district.

14.04.060 - Permission required for certain groups over twenty-five persons.

No person, company, society, organization, gathering or group of more than twenty-five persons shall hold or conduct any picnic, celebration, parade, exercise, gathering, assembly or meeting in any public park within the city without first obtaining a written permit to do so by the recreation and park director; and no person shall attend, take part in or be a participant in any such picnic, celebration, parade, exercise, gathering, assembly or meeting in a public park unless the permission has first been obtained.

14.04.070 - Pool and racquetball court hours.

The Pebble Beach Park Pool and Racquetball Court shall be open to the public during the hours established by the city manager and publicly posted. Any unauthorized person remaining upon or entering upon the premises at any time other than during such posted hours shall be guilty of a misdemeanor.

14.04.090 - Exceptions.

The provisions of Sections 14.04.010 through 14.04.060 shall not be construed to prohibit persons from engaging in organized recreational activities conducted and scheduled by the recreation and park director nor to prohibit the director from conducting such activities.
