Chapter 18.48 — CS SPECIALTY COMMERCIAL ZONE

§ 18.48.010. Description and purpose. ¶
The CS zone is intended to create, preserve and enhance areas for businesses which serve the local community and take full advantage of proximity to recreation and open space areas. The stores are intended to fit into the surrounding residential pattern of development and not create either architectural or traffic conflicts. The CS zone is intended for application in planning area 16 of the San Antonio Lakes specific plan area.

§ 18.48.020. Permitted primary uses and structures. ¶
A. Commercial.
Amusement enterprises;
Antique shops;
Apparel stores;
Art stores;
Bakery (employing not more than five persons and all goods sold on the premises);
Book stores;
Commercial recreation enterprises;
Confectionery store, including fountain;
Delicatessen;
Dry goods or notions store;
Florist;
Game arcade;
Gifts, novelty and souvenir shops;
Hobby supply store;
Ice cream and frozen yogurt stores;
Interior decorating store;
Jewelry store;
Liquor store;
Meat, fish and seafood store;
Music, musical instruments, phonographic record store;
Newsstands;
Pharmacy;
Photography and camera;
Photographic supplies and processing;
Shoe store;
Sporting goods store;
Trunk and leather good stores.
B. Services.
Automatic teller machines;
Banks and financial institutions;
Barber and beauty shop;
Post office;
Wedding chapels.
C. Any compatible general retail commercial uses.
D. Any such other uses as the administrative committee or the commission may deem to be similar to those listed above and which are related to the functioning of a specialty commercial zone. Such uses must not be obnoxious to surrounding property nor be specifically listed in a less restrictive zone.

§ 18.48.030. Permitted accessory uses and structures. ¶

§ 18.48.040. Permitted temporary uses and structures. ¶
The provisions of Section 18.36.040 shall apply. (Prior code § 9633.040)
§ 18.48.050. Conditional uses and structures. ¶
The conditional uses and structures provided for in Section 18.36.050 shall apply, except that the following uses are also permitted subject to a conditional use permit subject to a notice of public hearings.
A. Café-restaurant;
B. Cocktail lounge with dancing or live entertainment;
C. Pet shops.

§ 18.48.060. Prohibited uses and structures. ¶
The provisions of Section 18.36.060 shall apply. (Prior code § 9633.060)
§ 18.48.070. Site development standards. ¶
The provisions of Section 18.36.070 shall apply, excepting as otherwise specified herein. (Prior code § 9633.100)
§ 18.48.080. Building site requirements. ¶
A. Minimum Lot Dimensions.
Minimum Lot Width. No requirement.
Minimum Lot Depth. No requirement.
B. Maximum Lot Coverage. The maximum coverage of the lot by buildings or structures shall not exceed 40 percent of the total area, including easements.

§ 18.48.090. Structural setbacks and yards—General. ¶
Excepting as provided in Section 18.36.100 , Structural setbacks and yards—Exceptions, all lots shall have front, side and rear yards of a minimum depth and area as provided in this section:
A. Front Yard.
25 feet. No parking is permitted in any front yard.
For Corner Lots. The required yards in the residential zones on each side of the nonresidential lot shall determine the required yard on the nonresidential lot which is in the plan of the continuation of the residential frontage.
B. Side and Rear Yards. There is no requirement for side and rear yards bordering nonresidential uses and zones. However, 10-foot minimum landscaped side and rear yards are required for CS zones bordering residential uses and zones and a six-to eight-foot wall shall be erected on the side and rear of the CS property. The side and rear yards may be used for off-street parking or access to off-street parking, provided the walls required in Section 18.48.110 are erected. When the side and rear yard is not used for off-street parking or access thereto, the required side and rear yard shall be landscaped and maintained as a buffer between the commercial and residential uses.

§ 18.48.100. Permitted encroachments into required yards— General. ¶
Notwithstanding the setback and yard provisions of this zone, projections may be permitted into required yards in compliance with the provisions of Section 18.36.120 , Permitted encroachments into required yards—General.

§ 18.48.110. Required fences and walls. ¶

§ 18.48.120. Structural height limitations. ¶
Maximum Structural Height. 40 feet or two stories; provided, however, that buildings higher than 40 feet or two stories may be permitted subject to the issuance of a conditional use permit, as provided for in Chapter 17.16 , Development Application and Review Procedures. (Prior code § 9633.107)
