Sec. 8-17.01. Adoption of California Existing Building Code.

That certain Code, designated as the 2025 California Existing Building Code, at least one (1) copy of which is on file in the office of the Building Official for public record and inspection, is hereby adopted by reference and made a part of this chapter as though set forth in this chapter in full, subject, however, to the amendments, additions and deletions set forth in this chapter. Said California Existing Building Code, as amended herein, shall be known as the Existing Building Code of the City.

Sec. 8-17.02. Amendments: California Existing Building Code.

The City Council, after due consideration, finds and determines that the 2025 California Existing Building Code is hereby amended as follows:

Section 101.2 “Scope” is amended, subsections adopted as published, and is to read as follows:

[A]101.2 Scope.

The provisions of this code and Title 8, Chapter 4, the City of Thousand Oaks Code Administration shall apply to the repair, alteration, change of occupancy, addition to and relocation of existing buildings.

Exception: Detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories above grade plane in height, shall comply with this code or the California Residential Code.

101.2.1 Reserved.

101.2.2 Application of Fire Code.

Where work regulated by this code is also regulated by the construction requirements for existing buildings in Chapter 11 of the California Fire Code, such work shall comply with applicable requirements in both codes.

Section 103 “Code Compliance Agency” Refer to Title 8 Chapter 1 of the Thousand Oaks Municipal Code, and Chapter 1, Division II, of the 2025 California Building Code for the following topics:

Powers and Duties of the Building Official, Right of Entry, Stop Orders, Liability, Board of Appeals, Violations, Authority to Disconnect, Permits, Annual Permit, Expiration of Permits, Plan Review, Inspections and Work Exempt from Permits.

Sections 104, 105, 106, 107 108, 109, 110, 111, 112, 113, 114, 115, 116 and 117 of Chapter I, Division II are hereby deleted.

Sec. 8-17.03. Safety Assessment Placards.

Section 118 “Safety Assessment Placards” is hereby added to Chapter 1 Division II-Scope and Administration of the 2025 California Existing Building Code, to read as follows:

Section 118 Safety Assessment Placards.

118.1 Intent.

This section establishes standard placards to be used to indicate the condition of a structure for continued occupancy. The section further authorizes the Building Official and his/her authorized representatives to post the appropriate placard at each entry point to a building or structure upon completion of a safety assessment.

118.2 Application of Provisions

The provisions of this chapter are applicable to all buildings and structures of all occupancies regulated by the City of Thousand Oaks. The City Council may extend the provisions as necessary.

118.3 Definitions

Safety assessment is a visual, non-destructive examination of a building or structure for purpose of determining the condition for continued use or occupancy.

118.4 Placards.

a. The following are descriptions of the official placards to be used to designate the condition for continued occupancy of buildings or structures.

  1. INSPECTED (Green) – Lawful Occupancy Permitted is to be posted on any building or structure wherein no apparent structural hazard has been found. This placard is not intended to mean that there is no damage to the building or structure.

  2. RESTRICTED USE (Yellow) – Restricted Occupancy Permitted is to be posted on each building or structure that has been damaged wherein the damage has resulted in some form of restriction to the continued occupancy. The individual who posts this placard will note in general terms the type of damage encountered and will clearly and concisely note the restrictions on continued occupancy.

  3. UNSAFE (Red) – No Entry or No Occupancy Permitted is to be posted on each building or structure that has been damaged such that continued occupancy poses a threat to life safety. Buildings or structures posted with this placard shall not be entered under any circumstance except as authorized in writing by the Building Official, or his/her authorized representative. Safety assessment teams shall be authorized to enter these buildings at any time. This placard is not to be used or considered as a demolition order. The individual who posts this placard will note in general terms the type of damage encountered.

b. This Municipal Code section, the name of the jurisdiction, its address, and phone number shall be permanently affixed to each placard.

c. Once it has been attached to a building or structure, a placard is not to be removed, altered or covered until done so by an authorized representative of the Building Official. It shall be unlawful for any person, firm or corporation to alter, remove, cover or deface a placard unless authorized pursuant to this section.
