Sec. 1-9.101. Created.

There is hereby created a Planning Commission for the City.

Sec. 1-9.102. Membership.

The Planning Commission shall consist of five (5) members. Such members shall not be officials or employees of the City but shall be residents of the City.

The Community Development Director, the City Attorney, or their designated representative, shall be ex officio members of the Planning Commission.

Sec. 1-9.103. Membership: Appointment.

After following procedures of Government Code Section 54970, each Councilmember shall have the right to nominate a person for one position on the Planning Commission which nomination shall be approved and appointed by the Council.

Sec. 1-9.104. Membership: Terms.

Each appointment of a Commissioner shall be for a term equal to that of the Councilmember who nominated the Commissioner and shall expire when that council seat is vacated or on the next election day for that nominating Councilmember, whichever event occurs first.

If after any council seat is vacated or a councilmanic election a new commissioner has not been selected, or a commissioner’s term has not been renewed, that commissioner shall serve until the new appointment or renewal is made.

Sec. 1-9.105. Membership: Vacancies.

A vacancy on the Planning Commission occurring by death, resignation, removal, or any other cause before the expiration of a corresponding Councilmember’s term shall be filled by nomination of that Councilmember and appointment by the Council for the unexpired term.

A member of the Planning Commission may be removed by a majority vote of all the members of the Council.

Sec. 1-9.107. Duties and functions.

The Planning Commission shall perform the duties and functions set forth in the State law and in the planning and zoning regulations set forth in Title 9 of this Code, together with such other duties and functions as may be delegated by the City Council.
