Sec. 1-12.101. Issuance of badges.

(a) Except as authorized by Council Resolution, no City badge shall be issued to, or be carried, worn or displayed by any City official or employee.

(b) Those badges authorized by Council Resolution shall be issued by the City Clerk, and shall have placed upon them a serial number. The City Clerk shall maintain records containing the number of each badge, the date of issuance, and the name and residence address of the person to whom the badge is issued.

(c) Each official or employee to whom a badge is issued must reimburse the City for the cost thereof if the badge be lost or destroyed through his/her negligence, or if the badge is not returned at the termination of his/her service with the City.

Sec. 1-12.102. Presentation of badge upon termination.

(a) Notwithstanding any other provision of this Code, the City may present to an employee or official his/her badge upon termination of his/her service with the City. Prior to the presentation, the City shall cause the badge to be affixed permanently to a plaque or within a frame, which will effectively preclude improper use of the badge.

(b) No person shall remove from the plaque or frame any badge presented under this section, or wear such a badge, or display it, except while it is attached to the plaque or within the frame.

Sec. 1-12.103. Unlawful use of city badges.

It shall be unlawful for any person other than one designated by Council Resolution pursuant to this chapter to wear, exhibit, or use the badge of a City official or employee, with the intent of fraudulently impersonating a City official or employee, or of fraudulently inducing the belief that he/she is a City official or employee. Any person violating the provisions of this chapter shall be guilty of a violation of this Code pursuant to Section 1-2.01 of Chapter 2 of Title 1 of this Code.
