9.12.010 - Title.

These regulations shall be known as the "Tehama County residential debris burn ban regulations."

9.12.020 - Purpose.

These regulations have been prepared and adopted for the purpose of establishing an annual period when residential debris burning is banned and other periods of burn ban within the unincorporated area of Tehama County.

9.12.030 - Scope.

These regulations do not apply to areas within the city limits of Red Bluff, Corning, and the City of Tehama or within the boundaries of the Capay fire protection district. Affected activities include all burning of any flammable material which requires an LE-62A residential burn permit - BURN PILE. These regulations do not apply to agricultural burning which requires an LE-5 burn permit or other specially permitted burning unless banned under Section 9.12.060.

9.12.040 - Definitions.

As used in this chapter:

A. "Residential debris burning" shall mean the burning of any flammable material for which an LE-62A residential burn permit - BURN PILE is required pursuant to Public Resources Code Section 4423 in order to conduct such burning during the period of May 1st to the end of the declared fire season as determined by the Director of the California Department of Forestry and Fire Protection.

B. "Communities of Mineral, Childs Meadows, Deer Creek and Mill Creek" shall mean that part of Tehama County lying within a ten-mile radius of the summit of Doe Mountain.

9.12.050 - Period of annual burn ban.

A. All residential debris burning shall be banned during the period including June 1st to the end of the declared fire season each year in all areas of Tehama County with the exception of the following: All residential debris burning within the communities of Mineral, Childs Meadows, Deer Creek and Mill Creek shall be banned during the period including July 1st to the end of the declared fire season each year.

B. Notwithstanding subdivision (A), the county fire chief may permit residential debris burning within all or any part of the county prior to the end of the declared fire season in any year, upon finding that such burning will not endanger the public health, safety, or welfare. Such action shall be proclaimed twenty-four hours in advance by press release and posted on the county website, and may be rescinded by the fire chief in the same manner. Any residential debris burning conducted during such period shall require an LE-62A residential burn permit - BURN PILE, issued to the responsible person.

9.12.060 - Other burn bans.

Every person, firm or corporation is prohibited from conducting any and all outdoor burning, when the county fire warden, as empowered by the board of supervisors of the county, declares burning suspended.

9.12.070 - Periods of allowable residential debris burning.

Residential debris burning is allowed without permit during the period after the end of declared fire season, until May 1st. During the month of May, and during any portion of the declared fire season in which residential debris burning is permitted by the Fire Chief pursuant to Section 9.12.050, subdivision (B), residential debris burning is allowed with an LE-62A residential burn permit - BURN PILE, issued to the responsible person. Residential debris burning is allowed within the communities of Mineral, Childs Meadows, Deer Creek and Mill Creek during the months of May and June with an LE-62A residential burn permit - BURN PILE, issued to the responsible person.
