9-13-1: DEFINITIONS:¶
For the purposes of this chapter, the following definitions shall apply:
NUISANCE: Any activity which:
(A) Threatens injury to person or property;
(B) Creates an obstruction or presents a hazard to the free use of public or private property by pedestrians or motorists; or
(C) Generates loud or unreasonable noise.
SKATING OR COASTING DEVICE: Includes any skateboard, roller skate, rollerblade, scooter, coaster or other rolling or wheeled device self-propelled by human, motor or wind power. (Ord. 654-97, 7-1-1997)
9-13-2: NUISANCE:¶
No person shall use a skating or coasting device in a manner which creates a "nuisance" as defined in section 9-13-1 of this chapter. (Ord. 654-97, 7-1-1997)
9-13-3: PROHIBITED:¶
No person shall operate or use any skating or coasting device while:
(A) Upon any roadway, alley or sidewalk in any business district within the city, whether public or private, and all other property owned by the city and upon private property for which a request for the application of this chapter has been established by resolution of the council;
(B) In any public park, playground or recreation area, except where the city or recreation and park district has posted signs permitting the use of the device;
(C) Upon any public sidewalk;
(D) Upon any city owned or operated parking facility;
(E) Upon the civic center complex; (Ord. 654-97, 7-1-1997)
(F) Skating at the west side recreation and park district skatepark located at 500 Cascade Place, Taft, California, without wearing a skate helmet that fulfills certification for CE safety standard requirements, elbow pads and kneepads. (Ord. 708-03, 12-2-2003)
9-13-4: BICYCLES IN THE SKATEPARK PROHIBITED:¶
Bicycles are strictly prohibited from the interior of the skatepark located at 500 Cascade Place.
(A) Signs shall be erected indicating it is a violation of Taft city ordinances to have a bicycle inside of the skatepark. The signs shall be posted at the entrance(s) to the skatepark and have at least one inch (1") lettering.
(B) The fine for a violation of this section is fifty dollars ($50.00) for the first offense, one hundred dollars ($100.00) for the second offense, and two hundred fifty dollars ($250.00) for third and all subsequent offenses.
(C) If a bicycle is seized as prima facie evidence of the violation, it may be held as evidence until such time as the case has been closed either through payment of the fine or hearing disposition. (Ord. 800-13, 7-16-2013)
9-13-5: PERMITTED:¶
The city council, may from time to time, designate certain areas for skating or coasting devices as described. Such areas shall be designated by resolution of the city council and posted with signs which are consistent with the standards for signs utilized by the department of public works.
