Editor's note— Ord. No. 794, § 2, adopted May 31, 2022, repealed the former Ch. 228, §§ 2.28.010 and 2.28.020, and enacted a new Ch. 2.28 as set out herein. The former Ch. 2.28 pertained to the volunteer fire department, and derived from Ord. No. 327, §§ 1, 2, adopted in 1964; and Ord. No. 575, § 2, adopted in 1989.

2.28.010 - Fire department established.

The Suisun City Fire Department is hereby established. The department consists of a fire chief, paid firefighters, and such companies of volunteer firefighters and clerical personnel as the city council from time to time determines. The city council shall fix and pay the compensation of the fire chief and other paid personnel.

2.28.020 - Volunteer fire personnel.

A budget to support the volunteer fire program is to be appropriated in the fire department's fiscal budget. Members of the volunteer fire program and active volunteer firefighters, also referred to as reserve firefighters or reserve volunteer firefighters, perform service for civic, charitable, or humanitarian reasons, at his or her own election, without coercion, and with promise, expectation, or receipt of compensation for services rendered. The number of volunteer firefighters may change from time to time in response to the changing needs of the city.

Members of the volunteer fire program are officially recognized as employees with the full support of the city council pursuant to Section 3361 of the California Labor Code.

Members of the volunteer fire program are recognized as bona fide volunteers, and not employees, pursuant to Section 3(e)(4)(A) and (B) of the Fair Labor Standards Act and Title 29 of the Code of Federal Regulations 553.101 and 553.103.
