15.12.410 - Enforcement.

The provisions of this chapter shall be enforced by the building inspector, who shall inspect all work and require compliance with all the provisions of this chapter.

15.12.420 - Installation of required measures.

The applicant shall install all soil-erosion and sediment control measures in strict compliance with this chapter and in accordance with the approved grading and erosion-control plan.

15.12.430 - Maintenance of required measures.

All soil-erosion and sediment control measures shall be adequately maintained by the applicant for a period of one year or until such measures are permanently stabilized as determined by the director of public works. Upon request of the applicant, the building inspector shall issue a final indication of the date on which the measures in the approved plan were completed.

15.12.440 - Stop work orders.

An order to stop work will be issued and further work shall be prohibited if it is determined that the work does not comply with the provisions of the approved grading and erosion-control plan or with the provisions of this chapter until such time as compliance with this chapter is assured.

15.12.450 - New or modified techniques.

A new or modified erosion and sediment control technique may be allowed to be used provided there is mutual agreement between the city and the applicant that the technique meets the intent of the erosion-control plan.

15.12.460 - Remedial work.

The city may cause remedial work to be done at the applicant's expense if it is determined that it is necessary to protect completed work or to prevent damage.

15.12.470 - Work season.

Except in the case of emergency, all development work shall be confined to the dry period of the year (April 15th-October 15th) and erodible slopes and surfaces exposed by such work will be hydromulched or secured by equally effective erosion control prior to October 15th.

15.12.480 - Fees.

Prior to acceptance of an application as being complete, the applicant shall file the fees as prescribed by ordinances and resolutions of the city.

15.12.490 - Permit and plan review and approval.

Grading permit applications and accompanying maps and plans shall be reviewed by the city and approved when found to be in compliance with the provisions of this chapter, conforming to acceptable grading and erosion-control techniques and meeting the requirements of the California Environmental Quality Act (CEQA). Grading permits required as a condition of a building permit, use permit or other land development permit will be issued only in conjunction with (or subsequent to) approval of such a permit.

15.12.500 - Performance bond.

A performance bond shall be posted by the applicant. The amount of the bond shall be the full cost of the installed grading work, erosion and sediment control measures, in accordance with the grading and erosion control plan by the city. At the discretion of the city, the bond may be held until all grading, erosion and sediment control measures have performed satisfactorily for a period of one year following completion of development or until such measures are permanently stabilized as provided for in this chapter. The bond may be used to provide for the installation of the control measures if not done by the applicant and sediment runoff is occurring as a result.

15.12.510 - Violations.

Penalties for violation of this chapter may be assessed by the city. Such penalties shall conform to local requirements and conditions and may include, but not be limited to, fines, stop-work orders, corrective-action orders or revocation or suspension of the permit.
