§ 2.08.010. Purpose.

The purpose of this policy is to promote environmentally sustainable practices in the City of Stockton through a reduction of single-use plastics.

§ 2.08.020. Policy.

  1. No City officer, official, or employee shall purchase, sell, or distribute any single-use plastic foodware accessories, single-use plastic water bottles, or polystyrene products while acting on behalf of the City.

  2. City representatives, agents, and contractors who are acting pursuant to any contract or agreement with the City are encouraged to refrain from the purchase, sale, or distribution of any single-use plastic foodware accessories, single-use plastic water bottles, or polystyrene products while acting pursuant to such contract or agreement.

  3. The products identified above may be provided as an accommodation to any person with a disability who requests such in order to enjoy equal access to the food or beverages.

  4. This policy will not be applied where prohibited by local, state, or federal regulations or where the application would constitute a risk to health and safety.

§ 2.08.030. Definitions.

"Foodware accessory"

means all items provided alongside ready-to-eat food, including all of the following:

Utensils, which is defined as forks, knives, spoons, and sporks;

Chopsticks;

Condiment cups and packets;

Straws;

Stirrers;

Splash sticks;

Cocktail sticks.

"Polystyrene"

means a synthetic resin which is a polymer of styrene, used chiefly as lightweight rigid foams and films. Polystyrene foam sometimes called StyrofoamTM is generally used to make cups, bowls, plates, trays, meat trays, and egg cartons.

"Single-use"

means designed to be used once and then discarded, and not designed for repeated use and sanitizing.
