§ 16.46.010. Purpose and intent.

The intent of this article is to set forth a regulatory framework to provide effective coverage throughout the city of Stanton for the countywide coordinated communication system utilized by police and fire personnel for public safety services.

§ 16.46.020. Definitions.

The following words, terms, and phrases when used in this chapter shall have the meanings ascribed to them in this section, except where the context clearly indicates a differing meaning:

"Countywide coordinated communication system"

means that radio system used by local law enforcement, fire, lifeguard and public works departments within the county of Orange for emergency and non-emergency radio communication on the 800 MHz radio band.

"Specifications"

means the city of Stanton public safety radio system coverage specifications as adopted by the city council. A copy of the specifications is maintained in the office of the city clerk and in the community development department. New or updated specifications may be substituted from time to time as may be necessary to maintain optimum coverage and radio effectiveness without further action from the city council.

§ 16.46.030. Compliance with specifications—Exemptions.

A. Except as otherwise provided in this section, no property owner shall erect, construct, maintain or occupy, any building or structure, or any part thereof, or cause the same to be done, that fails to comply with the requirements of the specifications.

B. Notwithstanding the foregoing, this chapter shall not apply as follows:

  1. Existing buildings or structures for which a building permit has been issued as of the effective date of the ordinance that adopts this chapter;

  2. Elevators;

  3. Buildings and structures that are three stories or less; provided, however, the exemption of this subsection shall not apply to any building or structure that has a subterranean storage or parking area regardless of the height or number of stories of the building or structure;

  4. Any building or structure where coverage consistent with the minimum level of service as set forth in the specifications is naturally provided; and

  5. Any remodel, renovation, alteration or improvement of any commercial building or structure of less than twenty percent of the original square footage or footprint of the building or structure.

§ 16.46.040. Penalties.

Any person violating the provisions of this chapter shall be guilty of a misdemeanor and enforced as provided in Chapter 1.10 of this code.
