§ 15.30.010. Definitions.

For the purpose of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain terms used herein are defined as follows:

"Development project"

means the construction of a new commercial, industrial or institutional building, a new public facility, or a new residential building or buildings, having five or more living units, where solid waste is generated, collected and loaded; and additions to such existing structures that equal or exceed thirty percent of their existing floor area.

"Recycling area" and "areas for recycling"

means space allocated and designated for the collection and loading of recyclable materials.

§ 15.30.020. General requirements.

All development projects for which an application for a building permit is submitted on or after the effective date of the ordinance codified in this chapter, shall include adequate, accessible and convenient areas for the collection and loading of recyclable materials.

§ 15.30.030. Design standards.

The following design standards shall be required for all developments as specified herein:

A. Commercial, industrial and institutional buildings and public facilities shall provide the following to the satisfaction of the city manager or designee:

  1. Area(s) for recycling shall be adequate in capacity, number and distribution to serve the entire development project and which shall be dimensioned to accommodate containers in number(s) and size(s) consistent with the anticipated recycling needs of the project.

  2. Area(s) for recycling shall be designed and constructed in a manner which is compatible with surrounding land uses; provides for securing of the recycling area to prevent theft of recyclable materials by unauthorized persons; and provides protection against adverse environmental conditions which would render the collected materials unmarketable.

  3. Driveways and/or travel aisles shall provide unobstructed access for collection vehicles and personnel to all recycling areas.

B. Residential developments having five or more living units shall provide the following to the satisfaction of the city manager or designee:

  1. All of the provisions of subsection A of this section.

  2. A minimum of three cubic feet of internal storage space for the collection of recyclable materials within each individual living unit.

§ 15.30.040. Location.

Recycling areas shall be located so that they are convenient and accessible to the occupants of the development project. In multifamily residential development projects, no living unit shall be constructed to be more than two hundred fifty feet from a recycling area.

§ 15.30.050. Monitoring.

No building permit, certificate of occupancy, or other entitlement for use may be issued unless the city manager or designee determines that the development project for which the permit, certificate of occupancy, or other entitlement for use is sought fully complies with the requirements of this chapter.

§ 15.30.060. Violation—Penalty.

Any person violating any of the provisions of this chapter is guilty of a misdemeanor punishable by a fine of not to exceed one thousand dollars or by imprisonment in the County Jail for a period not exceeding six months, or by both such fine and imprisonment. Each such person is guilty of a separate offense for every day during any portion of which any violation of any provisions of this chapter is committed, continued or permitted by such person, and shall be punished therefor as provided by this chapter.
