Sec. 2-5.01. - Authority for chapter provisions.

In accordance with the provisions of Article VI of the Constitution of the State and of the Municipal and Justice Court Act of 1949, and amendments thereto, judicial districts are established by this chapter.

Sec. 2-5.02. - Dorris-Tulelake Judicial District.

The Dorris Judicial District and the Tulelake Judicial District shall be consolidated and shall comprise all that portion of the County within the following described boundaries and shall be known and designated as the "Dorris-Tulelake Judicial District":

Sec. 2-5.03. - Southeastern Judicial District.

The Southeastern Judicial District is hereby created within the County, superseding, consolidating, and annexing the Dunsmuir-Mt. Shasta Judicial District, McCloud Judicial District, and Shasta Valley Judicial District. The boundaries for the Southeastern Judicial District shall be as follows:

Beginning at the intersection of the Siskiyou-Trinity County line with the South boundary of Section 31, T 41 N, R 6 W, MDM;

Sec. 2-5.04. - Selection of judges.

The Board finds and declares, based on State Supreme Court decision Phelps vs. Brennan, 16 C.3d 508, that the terms of the judges of the superseded courts expire concurrently with the establishment of the new Southeastern Judicial District, and that there are no judges to succeed to the new office pursuant to subsection (a) of Section 71080 of the Government Code of the State, and that therefore a vacancy will exist which will be filled pursuant to Section 71180.3 of said Government Code which provides in pertinent part: "Any vacancy in the office of judge of a justice court shall, at the option of the Board of Supervisors of the county in which the justice court is situated, be filled by appointment by the board of supervisors, or by election at a special election called by the board of supervisors which shall be conducted in the same manner as the election of city councilman in general law cities as set forth in the Elections Code except that the special elections shall be conducted by the county...".

Sec. 2-5.05. - Selection of judges by appointment.

If the Board decides to fill the new justice court judge position by appointment, the Board may call for and process applications of candidates for appointment to the new office prior to the operative date of this section. However, nothing contained in this section shall give the Board the right to make the appointment before the actual creation of the Southeastern Judicial District at which time a vacancy will exist. Since the terms of the current members of the Board continues until at least noon on Monday, January 2, 1989, the current Board has the power to appoint the first judge of the new Southeastern Judicial District which is established on the first tick of the clock on January 2, 1989. If the Board decides to make the appointment of the first judge of the Southeastern Judicial District, the Board shall do so after the creation of the court and before noon on Monday, January 2, 1989, from eligible candidates for appointment to a vacancy of the office of a judge of a justice court. The eligible list shall be established pursuant to law. Such list and all other activities necessary to make the appointment may be completed before the time set for the creation of the new Southeastern Judicial District; provided, however, the Board may not make the appointment, if it chooses to do so, until after the creation of the vacancy.

Sec. 2-5.06. - Selection of judges by election.

If the Board decides to fill the anticipated vacancy in the newly created Southeastern Judicial District by way of special election, the Board may call a special election for January 2, 1989, to fill the vacancy occurring on said date. Should the Board decide to fill the vacancy by election, the Board shall give notice of the special election pursuant to law. The County Clerk is hereby authorized to publish any required legal notice and to take any other legally required action to conduct a special election on the date the vacancy will be created, which date is January 2, 1989.

If the Board chooses to fill the anticipated vacancy by way of a special election, the eligible person receiving the plurality, or highest number of votes cast for the particular office, shall become the judge of the Southeastern Judicial District. The tenure of the judge elected at said special election is presently prescribed by Section 71180.3 of the Government Code of the State to be until his successor is elected at the general State election next succeeding the occurrence of the vacancy, which election shall be in June 1990. If it is determined that the tenure of the judge elected at a special election is other than that as described in this section, his tenure shall be as prescribed by law.

Sec. 2-5.07. - Assignment of court officers.

So far as practical, upon the organization of the court, the clerks, their deputies and attaches, and employees of the superseded courts shall be assigned to positions in the newly created justice court similar in duties and compensation to the positions held in the superseded court; provided, however, if it appears that two (2) or more clerks, deputies, attaches, or other employees are equally entitled by virtue of the office or employment held in the superseded court to any one office or employment in the newly created court, the judge of the newly created court shall determine which is entitled to office or employment in the position where the conflict exists.

Sec. 2-5.08. - Constables.

The Board shall determine which constable of the superseded courts shall succeed to office in the newly created court. Such constable shall serve for the term prescribed by law and until a successor is elected or appointed and qualifies.

Sec. 2-5.08.1. - Constable salary for Southeastern Judicial District.

The Constable in the Southeastern Judicial District shall be compensated at the rate of Eight Hundred and no/100ths ($800.00) Dollars per month. He shall perform those duties required by law including, but not limited to, bailiff services and other duties as required by the court. In addition, the Constable shall be entitled to retain those fees earned for service of process. However, on an annual basis, on or before August 1 of each year, the Constable shall provide an accounting to the Auditor setting forth those fees earned and expenses incurred in performing those duties.

The foregoing compensation shall be the entire compensation for the full performance of the duties as the Constable of the Southeastern Judicial District.

Sec. 2-5.09. - Pending actions.

All actions pending in, and records of, each superseded court, upon the creation of the Southeastern Judicial District, shall become cases pending in and records of the newly created court.

The Yreka-Happy Camp Judicial District and the Scott Valley Judicial District shall be consolidated and shall comprise all that portion of the County within the following described boundaries and shall be known and designated as the "Yreka-Happy Camp-Scott Valley Judicial District (Western Judicial District)":

Sec. 2-5.14.1. - Constable salary for Western Judicial District.

The Constable in the Western Judicial District shall be compensated at the rate of One Thousand and no/100ths ($1,000.00) Dollars per month and shall receive health insurance benefits as provided to those employees in the Miscellaneous Unit. He shall perform those duties required by law including, but not limited to, bailiff services and other duties as required by the court. In addition, the Constable shall be entitled to retain those fees earned for service of process. However, on an annual basis, on or before August 1st of each year, the Constable shall provide an accounting to the auditor setting forth those fees earned and expenses incurred in performing those duties.

The foregoing compensation shall be the entire compensation for the full performance of the duties as the Constable of the Western Judicial District.

Sec. 2-5.15. - Court sessions: Time and place.

The Judge of each Judicial District Court shall hold a session of said Court at least once each week in each incorporated city within his respective Judicial District, and the Judge of each Judicial District Court is hereby authorized and empowered to make rules and regulations fixing the times and places of holding court within such districts respectively.

Sec. 2-5.16. - Grand Jurors and Trial Jurors: Compensation.

Grand Jurors in the Superior Court shall receive Fifteen and no/100ths ($15.00) Dollars a day for each day's attendance as a Grand Juror, upon regularly called jury meetings or committee meetings, or when appointed by the foreman of the Grand Jury to make individual investigations, plus mileage reimbursement applicable to County employees for each mile actually traveled.

Compensation for Trial Jurors in the Superior Court shall be that amount set forth in California Code of Civil Procedure Section 215 as may be amended from time to time.
