Sec. 2-35.01. - Defendants in criminal proceedings.¶
(a) The provisions of California Penal Code Section 987.5, regarding the establishment of a Twenty-five and no/100ths ($25.00) Dollars registration fee assessment upon defendants in criminal proceedings who receive court-appointed counsel, shall be operative in Siskiyou County.
(b) The fee shall be assessed at the time the services of court-appointed counsel are provided. No fee shall be required to the extent the defendant is financially unable to pay. No defendant shall be denied the assistance of appointed counsel due solely to failure to pay the registration fee.

Sec. 2-35.02. - Parents and other persons liable for the support of minors in Welfare…¶
(a) The provisions of California Welfare and Institutions Code Section 903.15, regarding the establishment of a Twenty-five and no/100ths ($25.00) Dollars registration fee assessment in proceedings involving minors on whose behalf petitions filed under California Welfare and Institutions Code Section 601 or 602 have been filed and who receive court-appointed counsel, shall be operative in Siskiyou County. This fee shall be assessed upon the parent of the minor or any other person who is liable for the support of the minor.
(b) The fee shall be assessed at the time the services of court-appointed counsel are provided. No fee shall be required of any parent or other person to the extent they are financially unable to pay. No minor shall be denied the assistance of appointed counsel due solely to the failure of the parent or other person to pay the registration fee.

Sec. 2-35.03. - Collection procedures, accounting measures and distribution of fee…¶
(a) The fees assessed pursuant to Sections 2-35.01 and 2-35.02 shall be collected by the Siskiyou County Superior Court in accordance with procedures established by the Court. Court costs associated with assessment and collection of the fee will be recovered from Siskiyou County pursuant to procedures established by the Court and the County.
(b) All fee revenues shall be remitted to Siskiyou County through the County Auditor and subject to existing County accounting measures. That portion of the revenues based on fees related to the appointment of the Public Defender shall be used to offset the costs to the Public Defender in providing such service. That portion of revenues based on fees related to appointment of counsel other than the Office of the Public Defender shall be used to offset the County costs in providing such service.
