6-12.501 - Stormwater Pollution Control Plans.¶
(a) General Requirements. Any Responsible Party who:
(1) Engages in Construction Activities that requires a grading permit;
(2) Is subject to any State general or individual Stormwater permit;
(3) Engages in activity that contributes Pollutants to Stormwater, or to the Storm Drain System; or
(4) Engages in industrial, commercial, and institutional activity for which BMPs have been established, must comply with the following:
(A) All conditions and requirements established by the Clean Water Act which are related to the reduction or elimination of Pollutants in Stormwater from the construction site or facility;
(B) All conditions and requirements established by the City to protect specific Watersheds or drainage basins as contained in the City's ordinances and written policies related to Planning, Building and Safety, and Development;
(C) Provide an approved SWPPP if required by the state;
(D) Provide an SWPCP, which must:
(1) Identify the Responsible Party;
(2) Identify the site location/address and provide phone number(s);
(3) Identify the potential Pollutant sources;
(4) Describe the design, placement, and implementation of BMPs which must prevent Non-Stormwater Discharges and reduce Pollutants in Stormwater Discharges to the Storm Drain System to the Maximum Extent Practicable;
(5) Comply with the conditions and requirements of this chapter.
(E) Amend the SWPCP whenever there is a change in construction or operations which may affect the Discharge of Pollutants to surface waters, groundwaters, or the Storm Drain System; and
(F) Retain a copy of the approved SWPCP on site at all times to be made available to any authorized inspector or Regional Board representative.
(b) The State SWPPP may be accepted as a City required SWPCP, if it is determined by the Director that it meets the City's SWPCP guidelines.
(c) The Director may require additional conditions or BMPs to be included with a SWPPP or require the submission of a separate SWPCP or Local SWPPP if the SWPPP is inconsistent with the City's SWPCP guidelines.
(d) Specific Requirements for Construction Activities on Sites that are One Acre or Greater.
(1) The Responsible Party conducting Construction Activities on sites that are one acre or greater in size must submit to the Director the following:
(A) A local SWPPP that contains the appropriate site-specific construction site BMPs with the specific site locations identified and maintenance schedules;
(B) A local SWPPP which specifies the rationale used to select or reject BMPs for the various construction phases and weather conditions; and
(C) A signed statement by the project architect, engineer of record, or authorized qualified designee, of the Local SWPPP stating the following:
"As the architect/engineer of record, I have selected appropriate BMPs to effectively minimize the negative impacts of this project's construction activities on storm water quality. The project Owner and contractor are aware that the selected BMPs must be installed, monitored, and maintained to ensure their effectiveness. The BMPs not selected for implementation are redundant or deemed not applicable to the proposed construction activity."
(2) Each Owner or the Owner's agent must sign and submit a certification on the Local SWPPP stating the following:
"I certify that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to ensure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system or those persons directly responsible for gathering the information, to the best of my knowledge and belief, the information submitted is true, accurate, and complete. I am aware that submitting false and/or inaccurate information, failing to update the Local SWPPP to reflect current conditions, or failing to properly and/or adequately implement the Local SWPPP may result in revocation of grading and/or other permits or other sanctions provided by law."
(e) Specific Requirements for Industrial, Commercial, and Institutional Activities.
(1) A Responsible Party must submit a SWPCP to and obtain the approval of the Director for the SWPCP pursuant to the City's SWPCP guidelines within thirty (30) calendar days of receiving notice to prepare a SWPCP.
(2) A Responsible Party conditioned to submit a SWPCP must submit a SWPCP to and obtain the approval of the Director in compliance with the City's SWPCP guidelines, before a certificate of occupancy is issued.
(3) A Responsible Party whose Industrial Activity is subject to a State NPDES permit must submit a copy of the Notice of Intent, SWPPP, monitoring plan, if required, and the letter of authorization from the Regional Board to the Director at least ten (10) days prior to conducting regulated activity at the facility or site.

6-12.502 - Best Management Practices (BMPs).¶
(a) A Responsible Party engaged in activities, operations, or owning facilities or property that may cause or contribute to Pollution or Contamination of the Storm Drain System must comply with the BMPs as adopted pursuant to this chapter.
(b) A Responsible Party engaged in activities or operations, or owning facilities or property, that may result in Pollutants entering the Storm Drain System or Watercourse, must implement BMPs to prevent and reduce such Pollutants.
(c) Implementation of BMPs as required in this Section must occur no later than sixty (60) days after the effective date of this chapter.

6-12.503 - Animal Wastes.¶
Any Person who brings any animal into or allows it to remain on any public or private property, without the consent of the Person owning or occupying the private property, is responsible when such animal defecates and must promptly pickup and remove the feces and dispose of it in a trash container.

6-12.504 - Yard Wastes.¶
(a) No Person shall sweep, rake, blow, or otherwise allow yard waste to be deposited in the gutter, street, flood control channel, or any location adjacent or connected to a Watercourse.
(b) All yard waste generated from landscaping or yard maintenance activities must be disposed of in an enclosed container.

6-12.505 - Fertilizer Use.¶
(a) No Person shall apply, spill, or otherwise deposit fertilizer on any impervious surface.
(b) Any fertilizer applied, spilled, or deposited, either intentionally or accidentally, on any impervious surface must be removed immediately.
(c) No Person will apply fertilizer within 25 feet of any pond, stream, water course, lake or canal, retention area, drain or drainage ditch, or in any wetland unless the proper permit has been obtained.

6-12.506 - Household Hazardous Waste.¶
(a) No Person will dispose of household hazardous waste directly or indirectly into the trash, street, gutter, or storm drain.
(b) All household hazardous waste is to be disposed of at a City or County sponsored household hazardous waste event or through a State licensed and permitted hazardous waste vendor.

6-12.507 - Mobile Commercial or Industrial Operations.¶
No Person will Discharge, cause, or permit the Discharge of untreated wastewater from steam cleaning, mobile auto washing, carpet cleaning, mobile or stationary pet grooming facilities, sandblasting, wash water from tools, pumps, equipment, concrete trucks, industrial use trucks, or any commercial or industrial operation into the Storm Drain System.

6-12.508 - City Requirements for Construction Sites and Industrial Facilities with General Permits.¶
(a) A Responsible Party for a construction site, required to apply for a Construction General Permit issued by the State Water Resources Control Board or the Regional Board, will submit the following to the Director:
(1) Proof that a Notice of Intent has been submitted to the State Water Resources Control Board;
(2) Certification that a SWPPP has been prepared; and
(3) Proof that a Change of Information form has been submitted to the State Water Resources Control Board of the modified SWPPP any time a transfer of ownership occurs while Construction Activities are in progress.
(b) A Responsible Party must comply with Section 6-12.508(a) prior to the issuance of any grading, encroachment, building, electrical, construction or demolition permit, or any City authorization for construction or demolition involving land disturbance.
(c) The Responsible Party for an industrial facility, required to apply for an Industrial General Permit issued by the State Water Resources Control Board or the Regional Board, will produce the following upon request to the Director:
(1) Proof of a Notice of Intent has been submitted to the State Water Resources Control Board;
(2) Certification that a SWPPP has been prepared; and
(3) Proof that a Change of Information form has been submitted to the State Water Resources Control Board of the modified SWPPP any time a transfer of ownership occurs.

6-12.509 - Illicit Connections and Discharges.¶
(a) No Responsible Party will construct, use, maintain, operate, or allow any agent, employee, or independent contractor, to construct, maintain, operate, or utilize an Illicit Connection.
(b) A Responsible Party of an Illicit Connection will be required to immediately, or by a date specified by the Director, disconnect the Illicit Connection.
(c) A Responsible Party of an Illicit Discharge will be required to immediately, or by a date specified by the Director, take measures to eliminate the source of the Discharge and discontinue the Illicit Discharge.
(d) The Director may require the Responsible Party of an Illicit Connection or Illicit Discharge to remediate the affected area and restore it to its pre-pollution condition.
(e) The Director may require a Responsible Party of an Illicit Connection to the Storm Drain System to eliminate or secure the proper approval for the connection.

6-12.510 - Storm Drain System Protection.¶
(a) The Responsible Party of property in which a Watercourse or Storm Drain System passes, must maintain the storm drain so as to be free of trash, debris, vegetation, and obstacles.
(b) The Responsible Party whose property contains structures within or adjacent to the Storm Drain System, must maintain the structure so that the structure will not become a hazard to the use, function, or physical integrity of the Storm Drain System.
(c) The Responsible Party will not remove healthy bank vegetation beyond that actually necessary for maintenance of its structures.
(d) The Responsible Party will not remove vegetation in such a manner as to increase the vulnerability of the Storm Drain System to erosion.

6-12.511 - Critical Sources.¶
(a) The Responsible Party for any facility designated a Critical Source must implement the BMPs applicable to their facility's operations.
(b) The Responsible Party for any facility designated a Critical Source must comply with additional BMP's as may be required by the Director pursuant to Part 4.D of the City's Municipal Separate Storm Sewer System, National Pollutant Discharge Elimination System Permit No. CAS004002 or this chapter.

6-12.512 - Public Event Trash Management.¶
(a) Any Person holding an event in the public right of way or one that may generate substantial quantities of trash and litter must obtain a Special Event Permit from the City.
(b) The applicant of a Special Event Permit must comply with all of the following:
(1) Pick up any trash and litter generated at the event and dispose of it in the assigned trash receptacles; and
(2) Place temporary screens on catch basins on the grounds of the event for the duration of the event; or
(3) Clean out catch basins, trash receptacles, and the grounds of the event within 24 hours following the event's conclusion.

6-12.513 - Trash Receptacles.¶
(a) The Director may require the installation of trash receptacles, or equivalent trash capturing devices, in areas of trash generation by the Responsible Party.
(b) The Responsible Party of any establishment, industrial park, or public place in which trash receptacles are required by this chapter must procure and place such receptacles on the subject premises at their own expense.
(c) All outdoor trash receptacles required under this section must have covers.
(d) The Responsible Party of a place of business, who sells or offers food for sale, must provide for customer use, outdoor trash receptacles.
(e) No Responsible Party owning or occupying a place of business will sweep or direct another to sweep or deposit in any gutter, street, or public place the accumulation of waste from any building or lot from any public or private sidewalk or driveway.
(f) A Responsible Party owning or occupying a place of business will keep the sidewalk in front of their business premises free of trash.
(g) The Responsible Party will ensure that spillage and overflow of wastes around containers will be promptly cleaned and disposed of in an appropriate container.
(h) The Responsible Party will ensure that all trash receptacles are cleaned out and maintained properly to prevent trash overflow.
