2.52.010 - Merit system adopted.

Pursuant to the authority granted to the legislative body of any city within the state under the provisions of Section 4500 through 45210 of the Government Code of the state, a merit service system is adopted for the city.

2.52.020 - Definition.

Whenever "employee" is used in this chapter, it shall be held to include appointed officers as well as employees.

2.52.030 - Classified service.

A. The provisions of this chapter shall apply to the following departments, appointed officers and employees of the city, and shall be placed under the merit service system of the city:

  1. All full-time employees of the police department, except the chief of police;

  2. All full-time employees of the fire department, except the fire chief;

  3. All full-time employees of the public works department, except the director of public works;

  4. All full-time employees of the finance department, except the deputy finance director;

  5. All full-time employees of the planning department;

  6. All full-time employees of the office of the city manager; and

  7. All full-time employees of the recreation department, except the director of community services.

B. The provisions of this section shall not apply to temporary, provisional, hourly employees or persons employed on a daily basis.

2.52.040 - Personnel officer.

The city manager shall be the personnel officer of the city. He/she shall:

A. Administer all the provisions of this chapter and of the personnel rules and regulations issued by the city manager and adopted by the city council;

B. Prepare and recommend to the city council revisions and amendments to the personnel rules;

C. Prepare a position classification plan, including position specifications and revisions of the plan. The plan, and any revisions thereto, shall become effective upon approval of the city council;

D. Prepare a plan of compensation for all classifications in the classified service. The plan, and any revisions thereto, shall become effective upon approval by the city council; and

E. Be the custodian of all personnel records.

2.52.050 - Appointments to positions in classified service.

Pursuant to Section 2.08.070C, all appointments to positions or employments in the classified service shall be made by the city manager except for the positions of city clerk, city treasurer or city attorney. Appointment procedures shall be administered pursuant to the rules and regulations adopted under the authority of this chapter.

2.52.060 - Abolishment of position.

Whenever in the judgment of the city manager it becomes necessary in the interests of economy or because the necessity for the position involved no longer exists, the city manager may, in accordance with the personnel rules and regulations, abolish any position of employment in the classified service and discharge the employee or officer holding such position.

2.52.070 - Amendments.

The city council may from time to time hereafter by ordinance add additional departments, appointed officers or employees of the city to the list designated or enumerated in this chapter and placed under the operation of such system. All full-time employees and officers in the departments or employments designated or enumerated or hereafter placed under the system shall be deemed to be in the classified service.
