5.28.010 - Permit—Required.

A. It is unlawful for any person, firm or corporation to sponsor, hold or conduct a dance at which more than fifty persons are invited to attend without first obtaining a permit therefor from the city manager upon the approval and direction of the city council.

B. It is unlawful for any person, firm, or corporation, sponsoring, holding or conducting a dance, to allow more than fifty persons to be in attendance at such dance unless such person, firm or corporation holds a permit therefor as provided in subsection A of this section.

5.28.020 - Permit—Application—Issuance.

Application for a permit as required by the provisions of this chapter shall be made and submitted to the city manager on forms furnished by the city manager. Each application for a permit under the provisions of this chapter shall be referred to the chief of police and the chief of the fire department for recommendation. Such permit shall be issued by the city manager only upon the approval and direction of the city council and subject to such conditions as the city council may impose thereon.

5.28.030 - Conduct—Permit revocation.

It shall be the responsibility of any person, firm or corporation sponsoring, holding or conducting a dance for which a permit has been issued as provided herein, to maintain peace and good order at such dance, and the failure to maintain peace and good order at any time in the course of such dance shall provide justification and authorization for the immediate closing of such dace and the revocation of such permit.

5.28.040 - Nonapplicability of provisions.

The provisions of this chapter shall not apply to a dance for which a city business license has been issued in accordance with the provisions of Ordinance No. 153 of the city (and amendments thereto) pertaining to the licensing of certain businesses, trades, etc.
