16.02.010 - Chapter citation.

This chapter may be cited as the Scotts Valley subdivision ordinance and shall supplement and implement the State Subdivision Map Act contained in Section 66.410 et seq. of the Government Code.

16.02.020 - Applicability.

This chapter shall not apply to:

A. The financing or leasing of apartments, offices, stores, or similar space within apartment buildings, industrial buildings, commercial buildings, mobile home parks, trailer parks or recreational vehicle parks;

B. Mineral, oil, gas or agricultural leases;

C. Land dedicated for cemetery purposes under the Health and Safety Code of the state of California;

D. All subdivisions whose tentative maps were approved by the council or the planning commission prior to the enactment of this chapter; except, that where any of the maps require a time extension, the provisions of this chapter shall become fully applicable to further processing of the subdivision;

E. A lot line adjustment between two or more adjacent parcels, where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created; provided, the lot line adjustment is approved by resolution of the local agency. Processing of Lot Line Adjustments shall be in accordance with Subdivision Map Act, Section 66412(d), except as allowed by the provisions of Section 17.48.090.

16.02.030 - Final map governs subdivisions.

When any area in a subdivision, which a final map has been finally approved by the county and filed for record pursuant to this chapter, is thereafter annexed to the city, the final map and any agreements relating to such subdivision shall continue to govern such subdivision.

16.02.040 - Tentative map—Void upon annexation.

When any area in a subdivision or proposed subdivision of which a tentative map has been filed but a final map or a parcel map has not been finally approved, is annexed to the city, the tentative map approval shall become null and void. Any further consideration of the matter shall be made by the city upon a new application by the subdivider.(Ord. 64 § 3 (part), 1975)
