Sec. 14-541. - Authorized to issue permit.¶
No person except a property owner of the premises for which the application for the permit required by this chapter is being made or a person licensed by the state contractor's licensing board of a category permitting the construction of swimming pools, shall be issued a building permit for the construction of a swimming pool.

Sec. 14-542. - Indemnification of city.¶
A building permit required by this article shall not be issued unless the applicant has deposited with the building official the currently required cash bond, certified check, letter of credit, or a security bond, or a deposit, either with the local agency or a responsible escrow agent or trust company, at the option of the local agency, or money or negotiable bonds of the kind approved for securing deposits of public monies, payable to the city, to indemnify the city for any damage to improvements located within the city right-of-way used by contractors.

Sec. 14-543. - Release of bond, etc.¶
The cash bond or any residual thereof required under this article may be released upon certification by the director of public works that any city property damaged by the swimming pool contractor or owner has been restored to as good a condition as it was prior to such damage or that the city property suffered no damage incident to the construction process.

Sec. 14-544. - Director of public works authority generally.¶
The director of public works shall have the right to inspect all trucks, tractors, excavators, and other equipment proposed to be used in the construction of swimming pools in the city. He shall be the sole judge as to the hazard or danger that such equipment may impose upon curbs, gutters, sidewalks, and other improvements as may be located in the city right-of-way at or near the construction site, and he shall be vested with full authority to prescribe measures for the protection of city improvements.

Sec. 14-545. - Duty to repair damages caused to city improvements; costs.¶
Upon damage to any street, curb, gutter, sidewalk, or other public property incident to swimming pool construction, the director of public works shall cause such work as may be necessary to restore the improvements to as good a condition as the same was prior to such damage, and shall charge the cost thereof to the contractor or owner to whom the permit was issued for the particular construction job. Such work may be performed by local contract or by city forces as deemed most economical and appropriate by the director of public works. Such damages as occur may be recovered from the cash bond or other indemnification security as required in this article.
