Sec. 14-51. - Adopted; purpose; copy on file.¶
(a) [California Building Code, part 2.] The 2022 California Building Standards Code (this part known as the California Building Code ("CBC") (part 2), as promulgated by the California Building Standards Commission, which incorporates the adoption of the 2021 edition of the International Building Code as amended with necessary California amendments and the 2021 International Building Code, volumes 1 and 2, including appendices of the International Code Council, are hereby adopted by the city, except as otherwise provided herein. The provisions of this article shall be known as the "Sanger Building Code", may be cited as such, and is referenced in this article as "this regulation" or "this building standard" or "this code". Such adoption is for the purpose of prescribing regulations for the protection of the public health, safety, and welfare in governing the construction, alteration, moving, demolition, repair, maintenance, and use of any building or structure within the city; except work located primarily in a public way, public utility towers and poles, mechanical equipment not specifically regulated by this code, and hydraulic flood control structures.
(b) Nationally recognized standards. The 2021 edition of the International Building Code including the codes and standards referenced in this code (chapter 35) shall be considered part of the requirements of this code to the prescribed extent of each such reference and are hereby adopted by the city for the purposes of standard reference documents. The adoption of these provisions which contain material, testing, and installation standards are not intended to prevent the use of any material, alternate design or method of construction not specifically described herein, or any other nationally recognized fire and life safety standards, or structural safety standard that is at minimum equivalent to that prescribed in the Sanger Building Code. Whenever there exists a conflict between the applicable provisions of the code and any proposed alternate or nationally recognized standard, the provisions of the code shall take precedence.
(c) Deletions from the California Building Code. The following sections, chapters, and appendix chapters are hereby deleted from the CBC: chapter 29; chapter 31, sections 3109.1 through 3109.4.3; chapter 31F; appendix A Employee Qualifications; appendix B Board of Appeals.
(d) One copy of the CBC is on file in the office of the building official and is available for public review.

Sec. 14-52. - Administrative provisions of the Sanger Building Code.¶
The applicable provisions of chapter 1 of the CBC shall hereafter be collectively referred to as the "Administrative Provisions of the Sanger Building Code". Whenever there exists a conflict between the applicable provisions of the administrative provisions of the Sanger Building Code and chapter 1 of the California Building Code, or chapter 1 of the California Residential Code, or chapter 1 of the California Plumbing Code, or chapter 1 of the California Mechanical Code or article 089 of the California Electrical Code, the applicable provisions of the administrative provisions of the Sanger Building Code shall apply.

Sec. 14-53. - Permit issuance.¶
Section 105.3.1 CBC is amended by adding the following:
105.3.1.1 Permit Issuance. Except as provided in these articles of this chapter, permits required shall be issued only to contractors licensed by the state to engage in the business or act in the capacity of a contractor in a specialized field or to the owner of the property to be improved, pending review and acknowledgement of the "owner-builder information" letter and "owner-builder verification" which shall be completed and returned to the building official prior to issuance of a permit pursuant to Health and Safety Code §§ 19825 and 19826.

Sec. 14-54. - Temporary structures and uses.¶
Section 108.3 CBC is amended by adding the following:
108.3.1 Temporary occupancy utilities. The building official may permit use of utilities for temporary occupancy of a building or structure when circumstances exist to justify the issuance of a temporary certificate and the owner enters into a security agreement with the City of Sanger, in a form approved by the city attorney, to insure completion of the required improvements. In addition, a deposit to secure such performance shall be made with the city in an amount determined by the building official. The building official may, at his or her sole discretion, waive the requirement of a deposit.

Sec. 14-55. - Schedule of permit fees.¶
Section 109.2 CBC is amended to read as follows:
109.2 Schedule of permit fees. On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each shall be paid as required, in accordance with the schedule as set forth by resolution or ordinance of the city council.

Sec. 14-56. - Investigation fees: work without a permit.¶
Section 109.4 CBC is amended by adding the following:
109.4.1 Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to or up to four times the amount of the permit fee required by this code and shall be at the discretion of the Building Official depending on the nature of the violation. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law.

Sec. 14-57. - Certificate of insurance or consent to self-insure.¶
Section 108 CBC is amended by adding the following:
108.7 Certificate of Insurance or Consent to Self-insure. Before any permit required by this chapter can be issued, the applicant must adhere to all provisions of Labor Code § 3800.

Sec. 14-58. - Certificate of occupancy.¶
Section 111 is amended by adding the following:
111.1.1 Additional requirements for issuance of certificates of occupancy. The payment of all required fees, the dedication of all required rights-of-way, and the installation of all required public improvements must be accomplished either before or contemporaneously with, the issuance of a certificate of occupancy.

Sec. 14-59. - Service utilities.¶
Chapter 112.1 is amended by adding the following:
112.1.1 Final approval for utility connections. Notwithstanding any other provisions of this chapter or the building code adopted in this chapter, the building official shall not authorize final utility (gas and/or electrical) connections and shall not issue a certificate of occupancy for any building or separately occupied space within a building built pursuant to a permit issued until the director of public works has determined and stated that all required improvements and conditions pertaining to subject development have been constructed or accomplished, unless the director of public works or the city council has authorized a waiver of public street improvements and until the development services director has determined and stated that all conditions and requirements imposed by the city's zoning code or any other special approval conditions required have been completed.
112.1.2 General. Utility connections shall not be permitted until compliance with the provisions of the Sanger Municipal Code as set herein. Electrical and gas meters shall be required to be in place and operational prior to final inspection to facilitate testing and acceptance of the entire system. Installation of devices, fixtures, or wiring shall be completed and in working order for testing purposes.
112.1.3 Construction utilities. The building official may permit use of utilities for the purpose of construction provided no potential hazards to life or property is created and compliance with Article 590 CEC (electrical) or Section 1208.0 CPC (gas) is satisfied.

Sec. 14-60. - Board of appeals.¶
Section 113.1 is amended as follows:
113.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. As used in this chapter, or in any code adopted in this chapter, all references to the board of appeals shall be interpreted as references to the City Council.

Sec. 14-61. - Violations.¶
Section 114.1 is amended by adding the following:
114.1.1 Violations. Any person, firm, or corporation violating any of the provisions of this code, including adopted codes and amendments, shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed, continued, or permitted, and upon conviction of any such violation, such person shall be punished in accordance with section 1-7 of the Sanger Municipal Code.

Sec. 14-62. - Drainage and terracing.¶
Section J109.4 CBC is amended to read as follows:
J109.4 Drainage across property lines. No surface drainage across adjacent properties shall be permitted to occur unless disposal occurs through an approved drainage facility. Excess or concentrated drainage shall be contained on site or directed to an approved drainage facility. Erosion of the ground in the area of discharge shall be prevented by installation of non-erosive down drains or other devices.
