Sec. 14-145. - Adopted; purpose; copy on file.

(a) The 2022 California Building Standards Code (this part known as the California Mechanical Code ("CMC")(part 4)), as promulgated by the California Building Standards Commission, which incorporates the adoption of the 2021 edition of the Uniform Mechanical Code as amended with necessary California amendments and the 2021 Uniform Mechanical Code of the International Association of Plumbing and Mechanical Officials, including appendices, is hereby adopted by the City of Sanger, except as otherwise provided herein. The "Administrative Provisions of the Sanger Building Code" as detailed in section 14-6 shall apply to the administration of the CMC, and all references in the administrative provisions of the Sanger Building Code shall mean and include the CMC, as amended by this article.

(b) The following sections, chapters, and appendix chapters are hereby deleted from or amended in the CMC: None.

(c) One copy of the CMC is on file in the office of the building official and is available for public review.

Sec. 14-146. - Administrative provisions of the Sanger Mechanical Code.

The applicable provisions of chapter 1, divisions I and II of the CMC shall hereafter be collectively referred to as the "Administrative Provisions of the Sanger Mechanical Code". Whenever there exists a conflict between the applicable provisions of the administrative provisions of the Sanger Mechanical Code and chapter 1 of the CBC, or chapter 1 of the California Residential Code, or chapter 1 of the California Plumbing Code, or chapter 1 of the California Mechanical Code or article 089 of the California Electrical Code, the applicable provisions of the administrative provisions of the Sanger Building Code shall apply.

Sec. 14-147. - Violations.

Section 111.0 is amended by adding the following:

111.0.1 Penalties. Any person, firm, or corporation violating any of the provisions of this code, including adopted codes and amendments, shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed, continued, or permitted, and upon conviction of any such violation, such person shall be punished in accordance with section 1-7 of the Sanger Municipal Code.

111.0.1.1 Unlawful Equipment. Maintenance of equipment that is unlawful at the time it was installed and which would be unlawful under this section shall constitute a continuing violation.

Sec. 14-148. - Board of appeals.

Section 110.0 is amended as follows:

110.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. As used in this chapter, or in any code adopted in this chapter, all references to the board of appeals shall be interpreted as references to the city council.
