C5-81. - Generally.

The form and contents, submittal and approval of tentative maps for four or fewer parcels (tentative parcel map) shall be governed by the provisions of this chapter. (Ord. No. 406, § 2, 10-28-2008)

The tentative parcel map shall be prepared in a manner acceptable to the planning director and city engineer and shall be prepared by or under the direction of a registered civil engineer or licensed land surveyor. The form and contents shall comply and be consistent with the requirements of section C5-42 and the accompanying data and reports shall comply with and be consistent with section C5-43 of this division. C5-83. - Filing and pre-consideration review.

The tentative parcel map shall be accepted for review in accordance with the provisions of section C5-44 through C5-47 of this division. (Ord. No. 406, § 2, 10-28-2008)

C5-84. - Planning director action.

A. Upon determining the application to be complete under section C5-46, the planning director shall prepare a report and set the matter for public hearing in accordance with section C5-6. B. The tentative parcel map may be approved, conditionally approved, or denied by the planning director in accordance with the provisions and findings set forth in section C5-48 (B), (C), (D), and (E). In acting on the application the planning director shall have the same authority as the planning commission to modify any requirements based on the factors outlined in section C5-7. (Ord. C5-85. - Extensions of time.

Any applicable time limits for acting on the tentative parcel map may be extended by mutual consent of the subdivider and the planning director. A waiver of applicable time limits may be required to permit concurrent processing of related project approvals or environmental review on the same development project. (Ord. C5-86. - Appeals of planning director action.

A. The subdivider or any interested person may, within ten calendar days after the planning director's decision, file an appeal in writing with the city clerk. B. The planning commission shall consider the appeal at a duly noticed public hearing within thirty calendar days after the date of filing of the appeal, unless the appellant consents to a continuance. The planning commission shall render its decision at the next regularly scheduled meeting following conclusion of the hearing. C. The planning commission may sustain, modify, reject or overrule any recommendations or rulings of the planning director and may make any findings that are consistent with the provisions of the Subdivision Map Act or this division. D. If the planning commission fails to act upon an appeal within the time limits set forth in this chapter, the decision of the planning director on the tentative parcel map shall be deemed to be affirmed or denied insofar as it complies with the Subdivision Map Act, this chapter and this code. C5-87. - Expiration and extensions.

The approval or conditional approval of a tentative parcel map shall expire thirty-six months from its approval, unless this time period is extended by the provisions in Sections C5-51 or C5-52 of this division with the planning director acting as advisory agency or as otherwise extended under the Map Act. C5-88. - Minor amendments to approved of conditionally approved tentative parcel map.

Minor amendments to the approved or conditionally approved tentative parcel map or conditions of approval shall be made in accordance with Section C5-53. (Ord. No. 406, § 2, 10-28-2008)

C5-89. - Waiver of parcel map requirements.

Pursuant to Government Code Section 66428(b), the requirement of a parcel map may be waived by the planning director upon determining that the proposed division of land meets all city requirements as to area, improvement and design, flood water drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection, and sufficient record and survey data are available to accurately determine the location of the parcel. A legal description of the property to be divided shall be submitted with the tentative parcel map. When the requirement of a parcel map is waived, but dedication for the purposes of street widening is necessary, such dedication shall be made by a separate instrument which shall be recorded concurrently with, or prior to, the instrument of waiver of a parcel map being filed for record. Upon the waiver of the parcel map requirement pursuant to this section, the city engineer shall file with the county recorder a certificate of compliance for the land to be divided, in accordance with Section C5-9B, and a plat map showing the division. The certificate shall include a certificate by the county tax collector in accordance with division 8 of the Subdivision Map Act. A waiver by the planning director may be conditioned to provide for payment by the subdivider of parkland dedication, drainage and other fees by a method approved by the city engineer. (Ord. C5-90. - Parcel maps.

The form and contents, submittal, approval and filing of parcel maps shall conform to the provisions of the Subdivision Map Act and this section. A. Survey Required. An accurate and complete survey of the land to be subdivided shall be made by or under the direction of a registered civil engineer or licensed land surveyor. All monuments, property lines, centerlines of streets, alleys and easements adjoining or within the subdivision shall be tied into the survey. The allowable error of closure on any portion of the parcel map shall not exceed 1:10,000 for field closures and 1:20,000 for calculated closures. B. Form and Contents. The form and contents of the parcel map shall conform to the final map form and contents requirements of Sections C5-61 and C5-65. C. Submittals. The subdivider shall submit prints of the parcel map to the city engineer for checking. The preliminary prints shall be accompanied by copies of the data, plans, reports and documents as required for final maps by Section C5-66. D. The city engineer may waive any of the requirements if the location and nature of the proposed subdivision does not need compliance with the requirements of Section C5-66. E. Review and Approval by City Engineer. The city engineer shall review the parcel map and the subdivider shall make corrections and/or additions until the map is acceptable to the city engineer. The subdivider shall submit the original drawing of the map, corrected to its final form

and signed by all parties required to execute the certificates on the map, to the city engineer. Original signatures shall appear on the original drawing and on any duplicates. F. Approval by City Council. The parcel map shall be filed with the city council in accordance with sections C5-69, C5-70 and C5-71. (Ord. No. 406, § 2, 10-28-2008)
